Legal fentanyl used in medical settings would keep its Schedule II rating and continue to be allowed for research purposes.<\/p>\n<p>Six Senate Democrats and one independent have <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/331\/cosponsors\" target=\"_blank\" rel=\"noopener\" title=\"\">co-sponsored the legislation<\/a>, meaning it has the 60 votes needed to clear the filibuster if all Republicans vote in favor, but the final vote could be far more comfortable.<\/p>\n<p>Four additional Democrats supported the bill in a <a href=\"https:\/\/www.judiciary.senate.gov\/committee-activity\/hearings\/02\/27\/2025\/executive-business-meeting-1\">committee hearing<\/a> last week, and Sen. Dick Durbin (D-IL), the No. 2 Senate Democrat, told the <em>Washington Examiner<\/em> he would support it on the floor.<\/p>\n<p>The bill passed the House in February, attracting <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3313359\/stricter-penalties-fentanyl-related-drugs-passes-house-bipartisan-vote\/\" target=\"_blank\" rel=\"noopener\" title=\"\">98 Democratic votes<\/a>, but small differences in the Senate version mean the House will have to vote again for it to be sent to Trump&rsquo;s desk.<\/p>\n<p>The White House <a href=\"https:\/\/www.grassley.senate.gov\/imo\/media\/doc\/halt_fentanyl_omb_endorsement.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> last month that the administration &ldquo;strongly supports&rdquo; the HALT Fentanyl Act.<\/p>\n<p>The bill would hand Trump his second legislative victory since returning to the White House in January. His first, the Laken Riley Act, requires federal authorities to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3297074\/laken-riley-act-heads-trump-desk-passes-house\/\" target=\"_blank\" rel=\"noopener\" title=\"\">detain illegal immigrants<\/a> accused of theft-related crimes.<\/p>\n<p>Republicans have used the bills to reinforce Trump&rsquo;s crackdown on the southern border in the early weeks of his second term. He imposed 25% tariffs on Canada and Mexico this week in response to what the White House called &ldquo;unchecked drug trafficking.&rdquo;<\/p>\n<p>Meanwhile, Trump&rsquo;s broader agenda could take months to usher through Congress as House Speaker Mike Johnson (R-LA) negotiates a tax reform bill that sweeps in hundreds of billions for defense and the border.<\/p>\n<p>Democrats attempted to expand the HALT Fentanyl Act to provide funding for fentanyl test strips and substance abuse programs, but Republicans rejected all changes to the bill at a Judiciary Committee hearing last Thursday, <a href=\"https:\/\/amzn.to\/3YuVZYV\">citing law enforcement groups<\/a> that <a href=\"https:\/\/d1dth6e84htgma.cloudfront.net\/Law_Enforcement_HALT_Fentanyl_Support_Letter_5_1d8ea47769.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">asked<\/a> Congress to pass the legislation &ldquo;without delay or modification.&rdquo;<\/p>\n<p>Congress has until March 31 before the Schedule I classification for fentanyl knockoffs lapses.<\/p>\n<p>The bill marks the&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/press-releases\/sen-ossoffs-bipartisan-bill-to-prevent-treat-opioid-addiction-signed-into-law\/\" target=\"_blank\" rel=\"noopener\" title=\"\">latest step<\/a>&nbsp;taken by Congress to address the tens of thousands of deaths attributable to synthetic opioids such as fentanyl each year. Martin Heinrich (D-NM), the lead Democratic co-sponsor of the HALT Fentanyl Act. &ldquo;We&rsquo;re gonna get it done.&rdquo;<\/p>\n<p>He is joined by Sens.
