return false;\" title=\"Printer Friendly, PDF &amp; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>President Donald Trump&rsquo;s Department of Justice is dismissing a lawsuit the Biden administration brought against Idaho in an attempt to force its abortion activism on the pro-life state, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.idd.56097\/gov.uscourts.idd.56097.31.2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">c<\/a><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.idd.50547\/gov.uscourts.idd.50547.182.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ourt filings reveal<\/a>. <\/p>\n<p>The DOJ&rsquo;s decision to drop the lawfare should have opened the door for the Gem State to enforce its August 2022 Defense of Life Act. Idaho&rsquo;s largest hospital system, however, filed a separate suit against the state after repeatedly claiming that it had to airlift women out of state to get emergency abortions. Despite previously failing to <a href=\"https:\/\/www.washingtontimes.com\/news\/2024\/nov\/11\/idaho-challenges-abortion-airlift-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">provide proof for that claim<\/a>, St. Luke&rsquo;s Health System was handed a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.idd.56097\/gov.uscourts.idd.56097.33.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">temporary restraining order<\/a> by U.S. District Judge B. Lynn Winmill, a President Bill Clinton nominee, one day before the Trump DOJ acted. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1903281375\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The Ronald Reagan administration enacted the Emergency Medical Treatment and Labor Act (EMTALA) in 1986 to stop hospitals from turning away patients based on their inability to pay for their expenses. The <a href=\"https:\/\/amzn.to\/3YuVZYV\">law requires adequate treatment<\/a> for an&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/1395dd\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;unborn child&rdquo;<\/a>&nbsp;but also explicitly does &ldquo;not preempt any State or local law requirement, except to the extent that the requirement&nbsp;directly&nbsp;conflicts with&rdquo; EMTALA.<\/p>\n<p>President Joe Biden&rsquo;s regime, however, expanded EMTALA in the wake of the Supreme Court&rsquo;s <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-07-13\/pdf\/2022-15138.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Dobbs v. Jackson<\/em>&nbsp;ruling<\/a> to include abortion as a <a href=\"https:\/\/www.cms.gov\/files\/document\/qso-22-22-hospitals.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;stabilizing&rdquo;<\/a> procedure in certain cases &ldquo;irrespective of any state laws or mandates that apply to specific procedures.&rdquo; The Democrat administration then used its redefinition to <a href=\"https:\/\/thefederalist.com\/2022\/08\/04\/killing-babies-isnt-stabilizing-treatment-but-the-lying-biden-administration-already-knows-that\/\" target=\"_blank\" rel=\"noreferrer noopener\">target<\/a> Idaho over its lifesaving law, which prohibits abortion except in cases of rape or incest, or if a physician deems it necessary to save the mother&rsquo;s life.<\/p>\n<p>The U.S. Supreme Court had a chance in June of last year to shut down the Biden administration&rsquo;s abortion activism. Even though U.S. Solicitor General Elizabeth Prelogar&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/04\/24\/biden-admins-top-lawyer-cant-explain-to-scotus-how-a-1986-law-suddenly-mandates-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">struggled during arguments to explain<\/a>&nbsp;why a federal law that promotes preserving the health of a mother and her &ldquo;unborn child&rdquo; in medical emergencies should require Idaho hospitals to perform abortions outside of the exceptions outlined in its state law, the high bench instead ruled&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-726_6jgm.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">6-3<\/a>&nbsp;to toss the case back to the&nbsp;<a href=\"https:\/\/www.law.com\/nationallawjournal\/2023\/04\/13\/how-liberal-is-the-9th-circuit-new-study-takes-deep-dive\/#:~:text=For%20decades%2C%20the%20U.S.%20Court,extremely%20liberal%20federal%20appellate%20court.\" target=\"_blank\" rel=\"noreferrer noopener\">leftist<\/a>&nbsp;San Francisco-based Ninth Circuit Court of Appeals. <\/p>\n<p>&ldquo;It has been our position from the beginning that there is no conflict between EMTALA and Idaho&rsquo;s Defense of Life Act,&rdquo; Idaho Attorney General Raul Labrador&nbsp;<a href=\"https:\/\/idahonews.com\/news\/local\/department-of-justice-dismisses-lawsuits-against-idahos-defense-of-life-act\">said in his statement<\/a> confirming the DOJ dropped the suit. &ldquo;The goal of each is to save lives in every circumstance, both the mother and their unborn child. We are grateful that meddlesome DOJ litigation on this issue will no longer be an obstacle to Idaho enforcing its laws. Idaho will continue defending life as intended by the legislature and our people.&rdquo;<\/p>\n<p>Idaho&rsquo;s pro-life protections, when enforced, are estimated to save the lives of more than <a href=\"https:\/\/sbaprolife.org\/lifesavinglaws\" target=\"_blank\" rel=\"noreferrer noopener\">1,500 unborn babies every year. <\/a><br \/>&nbsp;<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
