The Utah Supreme Court upheld Lovell&#8217;s murder conviction but annulled the death penalty, <a href=\"https:\/\/amzn.to\/3YuVZYV\">citing ineffective legal representation<\/a> during his sentencing in \u20642015. It was steadfast that Lovell&#8217;s attorneys did not adequately \u200daddress the impact of his excommunication from the Church of Jesus Christ of Latter-day Saints on the jury&#8217;s decision-making. Although \u200bLovell&#8217;s original\u200d claims of church\u200c interference in his trial were dismissed by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/timeline-andrew-cuomos-scandalous-covid-19-response\/\" title=\"Timeline: Andrew Cuomo\u2019s Scandalous COVID-19 Response\">state judge<\/a>, the court concluded that there were significant shortcomings in his defense. (Trent Nelson \/The Salt Lake Tribune, via AP, Pool)<\/figcaption><\/figure>\n<p>Lovell was charged in 1992 for the 1985 murder of Joyce Yost to prevent her from testifying against him in a trial that he raped her. Lovell&rsquo;s wife, who he is now divorced from, helped Lovell prepare for the murder, authorities said. She cooperated with investigators in exchange for immunity.&nbsp;<\/p>\n<p>The Utah Supreme Court last year upheld Lovell&rsquo;s murder conviction but threw out the death sentence. It determined that during Lovell&rsquo;s sentencing in 2015, his attorneys did not sufficiently respond to testimony about his excommunication from the Church of Jesus Christ of Latter-day Saints. Lovell said his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/he-spent-three-years-in-jail-for-a-false-accusation-of-rape-now-hes-finally-free\/\" title=\"He Spent Three Years In Jail For A False Accusation Of Rape. Now He\u2019s Finally Free.\">court-appointed attorney<\/a> never contacted witnesses and that they were also silenced by the church, meaning jurors could not fairly weigh evidence before sentencing Lovell to death.&nbsp;<\/p>\n<p>In 2021, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-supreme-court-takes-up-trump-lawsuit-days-ahead-of-electoral-college-vote\/\" title=\"Wisconsin Supreme Court Takes Up Trump Lawsuit Days Ahead of Electoral College Vote\">state judge ruled<\/a> that the church did not interfere in Lovell&rsquo;s trial.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3334951\/thomas-alito-dissent-supreme-court-rejects-college-free-speech-case\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>THOMAS AND ALITO DISSENT AFTER SUPREME COURT REJECTS COLLEGE FREE SPEECH CASE<\/strong><\/a><\/p>\n<p>State officials said Lovell originally tried to hire two people to kill Yost so that she wouldn&rsquo;t testify that he raped her, but he eventually abducted and strangled her.<\/p>\n<p>Lovell said he buried Yost&rsquo;s remains in the Wasatch Mountains.
