She alleged that she was replaced by a younger gay man and later passed over for another management role given to a lesbian woman who had not initially applied.<\/p>\n<p>Ames&rsquo;s lawsuit was dismissed before trial because she could not satisfy the <a href=\"https:\/\/ogletree.com\/insights-resources\/blog-posts\/dei-under-scrutiny-part-iv-could-the-background-circumstances-rule-for-discrimination-be-primed-for-supreme-court-review\/\" target=\"_blank\" rel=\"noopener\" title=\"\">&ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-steps-in-reverse-discrimination-case-erupts-after-white-straight-woman-axed\/\" title=\"... This standard is used in nearly half of the country&rsquo;s appeals courts, while others do not apply the same standard, leading to a series of circuit splits over the precedent.<\/p>\n<p>Several justices, including some liberals, questioned the fairness of this requirement. Justice <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/sonia-sotomayor\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Sonia Sotomayor<\/a> noted Ames&rsquo;s strong performance record and the circumstances of her dismissal. There&rsquo;s &ldquo;something suspicious about that,&rdquo; she said. &ldquo;It certainly can give rise to an inference of discrimination.&rdquo;<\/p>\n<p>The court&rsquo;s conservative justices also appeared skeptical of the current framework. Justice <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/neil-gorsuch\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Neil Gorsuch<\/a> stated, &ldquo;We are in radical agreement,&rdquo; indicating broad support for eliminating the stricter burden on majority-group plaintiffs.
