This decision follows frustrations from President Donald Trump’s administration regarding judicial obstacles to their executive actions. The letter, authored by acting U.S. Solicitor General Sarah Harris and addressed to Republican Senator Chuck Grassley of Iowa, asserts that the multiple layers of removal restrictions for administrative law judges violate the Constitution. Consequently, the administration will no longer defend these restrictions in court. Harris cited a 2010 Supreme Court ruling indicating that providing “multilayer protection from removal” to executive officers contradicts Article II’s allocation of executive power to the President. The Justice Department also contends that a federal law limiting the dismissal of administrative law judges “only for good cause” similarly infringes upon Article II by restricting presidential authority over principal executive officers and their ability to remove subordinate officials. Administrative law judges handle various regulations across sectors like banking and immigration, distinct from Article III federal judges recognized by the Constitution. Harris’s letter comes amid efforts by Trump and billionaire ally Elon Musk to diminish federal agency power while cutting costs through government efficiency measures. Recent Supreme Court rulings have also limited federal agencies’ regulatory authority, including one declaring the Securities and Exchange Commission’s use of in-house administrative law judges unconstitutional. Chad Mizelle, chief of staff for Attorney General Pam Bondi, stated that this move aims to hold “unelected and constitutionally unaccountable” administrative law judges accountable while restoring constitutional oversight within the executive branch<\/p>\n","protected":false},"author":1,"featured_media":2405634,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_mo_disable_npp":"","fifu_image_url":"https:\/\/www.westernjournal.com\/wp-content\/uploads\/2025\/02\/Picture-41.jpg","fifu_image_alt":"","footnotes":""},"categories":[],"tags":[50899,7076,46275,45476,3634],"class_list":["post-2405633","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-administrative-judges","tag-doj","tag-legal-shield","tag-pam-bondi","tag-trump"],"fifu_image_url":"https:\/\/www.westernjournal.com\/wp-content\/uploads\/2025\/02\/Picture-41.jpg","_links":{"self":[{"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/posts\/2405633","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/comments?post=2405633"}],"version-history":[{"count":3,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/posts\/2405633\/revisions"}],"predecessor-version":[{"id":2405637,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/posts\/2405633\/revisions\/2405637"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/media\/2405634"}],"wp:attachment":[{"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/media?parent=2405633"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/categories?post=2405633"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-json\/wp\/v2\/tags?post=2405633"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
