Progressives&rsquo; concerns focused on what they viewed as an <a href=\"https:\/\/amzn.to\/3YuVZYV\">entrenched conservative majority&#038;rsquo<\/a>;s influence on issues such as abortion, voting rights, and environmental regulations. Lawmakers including Sen. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ed-markey\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Ed Markey<\/a> (D-MA) and Reps. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/alexandria-ocasio-cortez\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Alexandria Ocasio-Cortez<\/a> (D-NY), <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ilhan-omar\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Ilhan Omar<\/a> (D-MN), and <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/rashida-tlaib\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Rashida Tlaib<\/a> (D-MI) supported legislative efforts to expand the high court.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3292730\/all-executive-orders-actions-trump-first-day\/\" target=\"_blank\" rel=\"noreferrer noopener\">FULL LIST OF EXECUTIVE ORDERS, ACTIONS, AND PROCLAMATIONS TRUMP HAS MADE AS PRESIDENT<\/a><\/strong><\/p>\n<figure class=\"wp-block-image size-full\"><figcaption class=\"wp-element-caption\">From left, Rep. The <em>Washington Examiner<\/em> reached out to these lawmakers and organizations for comment, but none responded.<\/p>\n<p>Conservative judicial advocates have noticed the shift. <\/p>\n<p>&ldquo;No one is surprised that after the November election, Democrats and far-left activists stopped the pressure campaign to expand the court once it no longer benefited them,&rdquo; Carrie Severino, president of the Judicial Crisis Network, told the <em>Washington Examiner<\/em>. &ldquo;Their hypocrisy is a reminder that calls to alter the judiciary and our nation&rsquo;s highest court have always been about political gain and not the rule of law.&rdquo;<\/p>\n<p>One of the more prominent Biden-era court-packing efforts came with the reintroduction of the&nbsp;Judiciary Act of 2023, sponsored by Rep. <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2440815\/democrats-re-up-supreme-court-term-limit-bill-that-would-shove-thomas-into-senior-status\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Hank Johnson<\/a> (D-GA), alongside Sen. Markey, Sen. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/tina-smith\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Tina Smith<\/a> (D-MN), Rep. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/adam-schiff\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Adam Schiff<\/a> (D-CA), and Rep. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/cori-bush\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Cori Bush<\/a> (D-MO). The bill <a href=\"https:\/\/hankjohnson.house.gov\/media-center\/press-releases\/rep-johnson-sen-markey-announce-legislation-expand-supreme-court\" target=\"_blank\" rel=\"noopener\" title=\"\">proposed<\/a> expanding the Supreme Court from nine to thirteen justices, aiming to &ldquo;restore balance&rdquo; to what they described as a &ldquo;rogue, radical Supreme Court.&rdquo;<\/p>\n<p>At the time, Johnson claimed that the high court had &ldquo;descended into extremist politics&rdquo; and called expansion necessary &ldquo;to save our democracy.&rdquo; Sen. Markey echoed the sentiment, accusing Republicans of having &ldquo;hijacked the confirmation process&rdquo; to build a conservative majority. Smith argued that recent ethics scandals and controversial rulings had created a &ldquo;legitimacy crisis&rdquo; for the high court, saying, &ldquo;Doing nothing is not an option&mdash;we need to abolish the filibuster and reform and expand the Court.&rdquo;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3326024\/trump-doj-remove-agency-judges\/\" target=\"_blank\" rel=\"noopener\" title=\"TRUMP DOJ SEEK PATH TO REMOVE IN-AGENCY JUDGES AT WILL\">TRUMP DOJ SEEK PATH TO REMOVE IN-AGENCY JUDGES AT WILL<\/a><\/strong><\/p>\n<p>But their months of silence since Trump&rsquo;s election victory in November marks a sharp contrast from previous years when court expansion was framed as a necessary check on conservative judicial power. Sen. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/elizabeth-warren\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Elizabeth Warren<\/a> (D-MA) tweeted in July last year, &ldquo;Congress has already used its constitutional authority to expand the Supreme Court six times in the past. Court expansion isn&rsquo;t new. It isn&rsquo;t radical. It&rsquo;s what we must do to rein in a Court that Republicans packed and that clearly doesn&rsquo;t feel limited by the rule of law.&rdquo;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Congress has already used its constitutional authority to expand the Supreme Court six times in the past. Demand Justice&rsquo;s site <a href=\"https:\/\/demandjustice.org\/expandthecourt\/\" target=\"_blank\" rel=\"noopener\" title=\"\">reads<\/a>: &ldquo;Adding four seats is the only way to restore balance to the Court immediately&hellip; All it takes is a bill passed through Congress and signed by the president.&rdquo; Similarly, Alliance for Justice <a href=\"https:\/\/afj.org\/why-courts-matter\/supreme-court-reform\/\" target=\"_blank\" rel=\"noopener\" title=\"\">contends<\/a> that expanding the Supreme Court would help &ldquo;dilute its current partisanship&rdquo; while increasing its capacity to handle more cases.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>Dan McLaughlin, a fellow at the National Review Institute, told the <em>Washington Examiner<\/em> the silence by the Left &ldquo;really shows how none of these people and groups ever meant any of their claims to be high-minded reformers. They just wanted more power for their side.
