In a blog post, AASA \u200csignaled confidence that\u2062 the courts would block these\u200d reforms and criticized the administration&#8217;s letter from the Office for Civil Rights (OCR), which \u2063outlined the\u200b potential\u200c consequences\u200b for districts \u2062that discriminate\u200c against students \u2062based on race.<\/p>\n<p>Critics,including Erika Sanzi from Parents Defending Education,argue that AASA&#8217;s guidance could lead superintendents to ignore federal laws,including\u2062 the Civil Rights Act of 1964,which\u2062 prohibits racial \u2062discrimination in education. The OCR&#8217;s letter\u200d emphasized that educational institutions \u2064must not separate \u2063or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/indiana-educator-warns-parents-were-lying-about-not-teaching-crt-keep-looking\/\" title=\"Indiana Educator Warns Parents: \u2018We\u2019re Lying\u2019 About Not Teaching CRT, \u2018Keep Looking\u2019\">treat students differently based<\/a> on \u2062race, and warned against using non-racial proxies to circumvent these regulations.<\/p>\n<p>AASA&#8217;s challenge \u2062to \u2063the administration questioned the\u200b enforcement of the OCR&#8217;s guidance, citing an ongoing freeze on investigations initiated\u200c under previous administrations. The group\u2019s civil\u2063 rights attorney suggested that\u2062 schools could rebrand their race-based policies to comply with federal laws without\u200d losing funding.<\/p>\n<p>Democratic senators also expressed skepticism about the Trump administration&#8217;s mandates regarding DEI, implying that the standards are vague and lack authority. this\u200c situation highlights the\u2063 contentious\u200d debate surrounding DEI programs \u200din <a href=\"https:\/\/amzn.to\/3YuVZYV\">educational \u2062institutions\u200d amid shifting political landscapes<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The School Superintendents Association (AASA), which represents the leaders of school districts across the country, told its members to ignore the Trump administration&rsquo;s memorandum telling schools to end their diversity, equity, and inclusion (DEI) programs or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-wants-to-force-public-charter-schools-to-select-students-by-race\/\" title=\"Biden Administration Wants To Force Public Charter ...s To Select ... By ...\">risk losing federal funding<\/a>.<\/p>\n<p>AASA <a href=\"https:\/\/www.aasa.org\/resources\/blog\/ocr-issues-guidance-on-title-vi-compliance-for-districts\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> its members to ignore the guidance in a Monday blog post, <a href=\"https:\/\/thefederalist.com\/2025\/02\/17\/democrats-lawfare-threatens-to-sideline-musk-and-doge\/\" target=\"_blank\" rel=\"noreferrer noopener\">relying<\/a> on courts to stop the Trump administration&rsquo;s reforms and a &ldquo;long-drawn out process for rescinding funding for failure to comply with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-campus-anti-semitism-skyrockets-even-as-coronavirus-forces-remote-learning\/\" title=\"Report: Campus Anti-Semitism Skyrockets Even as Coronavirus Forces Remote Learning\">civil rights laws<\/a>.&rdquo;<\/p>\n<p>&ldquo;It seems unwise for the professional association for superintendents to advise its members to continue flouting longstanding federal law &mdash; perhaps many of them aren&rsquo;t aware of what has happened on their watch, but countless superintendents are currently governing school districts whose policies and practices directly violate the 1964 Civil Rights Act,&rdquo; Erika Sanzi, director of outreach at Parents Defending Education, told The Federalist. &ldquo;They are playing with fire with this terrible advice.&rdquo;&nbsp;<\/p>\n<p>The guidance came in a &ldquo;<a href=\"https:\/\/www.ed.gov\/media\/document\/dear-colleague-letter-sffa-v-harvard-109506.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dear colleague<\/a>&rdquo; letter from the Office for Civil Rights (OCR) last week, detailing how school districts could lose federal funding if investigations find them to be discriminating against students using the racialized system the left has been enforcing for years.<\/p>\n<p>&ldquo;The Department will no longer tolerate the overt and covert racial discrimination that has become widespread in this Nation&rsquo;s educational institutions. The law is clear: treating students differently on the basis of race to achieve nebulous goals such as diversity, racial balancing, social justice, or equity is illegal under controlling Supreme Court precedent,&rdquo; the letter states. &ldquo;Put simply, educational institutions may neither separate or segregate students based on race, nor distribute benefits or burdens based on race.&rdquo;<\/p>\n<p>Anticipating school districts attempting to hide their DEI policies behind other names or obscure them in other ways to bypass federal oversight, the letter warned districts that &ldquo;relying on non-racial information as a proxy for race, and making decisions based on that information, violates the law.&rdquo;<\/p>\n<p>OCR said that programs that tell &ldquo;students that certain racial groups bear unique moral burdens that others do not&rdquo; would be violative of civil rights law because they &ldquo;stigmatize students who belong to particular racial groups based on crude racial stereotypes&rdquo; and &ldquo;deny students the ability to participate fully in the life of a school.&rdquo;<\/p>\n<p>In an attempt to fight the guidance, AASA even issued an underhanded challenge to the administration, questioning the &ldquo;willingness of the Trump Administration to enforce it.&rdquo; The organization said the letter from OCR is &ldquo;not &hellip; very convincing&rdquo; because OCR&rsquo;s guidance does &ldquo;not have the force and effect of law.&rdquo; AASA then cited an <a href=\"https:\/\/www.propublica.org\/article\/department-of-education-civil-rights-office-investigations\" target=\"_blank\" rel=\"noreferrer noopener\">OCR investigation freeze<\/a> &mdash; though it failed to mention that the freeze was on investigations that were started under old race and gender theory standards from the Biden administration.<\/p>\n<p>New investigations, based on new standards that are grounded in reality, have started under the Trump administration.<\/p>\n<p>AASA education civil rights attorney Jackie Wernz noted that branding is key for school districts looking to avoid losing federal funding for keeping their race-based policies, writing that &ldquo;there is much less support for arguments against race-neutral-yet-race-conscious policies like those used in cases in the 1st and 4th Circuit and there certainly is no legal merit for the idea that considering diversity goals or race at all is a problem.&rdquo;<\/p>\n<p>Sen. Patty Murray, D-Wash., also egged AASA on, glomming on to a left-wing bait-and-switch tactic that attempts to make the argument that no one knows what conservatives mean by DEI. Sen. Chris Murphy, D-Conn., tried to <a href=\"https:\/\/thefederalist.com\/2025\/02\/14\/highlights-and-lowlights-from-top-education-nominees-confirmation-hearing\/\" target=\"_blank\" rel=\"noreferrer noopener\">pull the same stunt<\/a> during Education Secretary-designate Linda McMahon&rsquo;s confirmation hearing.<\/p>\n<p>&ldquo;While it&rsquo;s anyone&rsquo;s guess what falls under the Trump administration&rsquo;s definition of &lsquo;DEI&rsquo;, there is simply no authority or basis for Trump to impose such a mandate,&rdquo; she said.<\/p>\n<hr>\n<p>      Breccan F.
