But when Musk &mdash; now deputized by the democratically elected president to rein in the leviathan of an unchecked bureaucracy &mdash; embarks on his crusade to eliminate wasteful spending, Democrats suddenly claim the nation is on the verge of a &ldquo;constitutional crisis.&rdquo;<\/p>\n<p>&ldquo;We are at a point where we are basically on the cusp of a constitutional crisis,&rdquo; Sen. Andy Kim, D-N.J., <a href=\"https:\/\/thehill.com\/homenews\/administration\/5134797-andy-kim-government-shutdown-trump-musk\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> on NBC&rsquo;s &ldquo;Meet the Press&rdquo; on Sunday.<\/p>\n<p>Sen. Cory Booker, D-N.J., said the same thing that night.<\/p>\n<p>&ldquo;We really do have a constitutional crisis,&rdquo; Booker <a href=\"https:\/\/www.msnbc.com\/inside-with-jen-psaki\/watch\/-constitutional-crisis-sen-booker-reacts-to-possibility-that-elon-musk-defy-court-orders-231502405627\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in response to a question about whether Trump might triumph over activist judges.<\/p>\n<p>&ldquo;We&rsquo;ve got our toes right on the edge of a constitutional crisis here,&rdquo; <a href=\"https:\/\/thehill.com\/homenews\/senate\/5137982-warren-trump-executive-orders-constitutional-crisis\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Sen. Elizabeth Warren, D-Mass., on MSNBC one day later.<\/p>\n<p>&ldquo;That&rsquo;s the new buzzword,&rdquo; Fox News host Kayleigh McEnany <a href=\"https:\/\/dailycaller.com\/2025\/02\/10\/kayleigh-mcenany-democrats-buzzword-trump-elon-musk\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> this week, with Musk&rsquo;s unelected status seemingly at the heart of Democrats&rsquo; complaints. House Democrats even <a href=\"https:\/\/stansbury.house.gov\/media\/press-releases\/rep-stansbury-introduces-nobody-elected-elon-musk-act\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a> the &ldquo;Nobody Elected Elon Musk Act&rdquo; on Monday as lawmakers fume outrage over the tech entrepreneur&rsquo;s recent moves to gut taxpayer waste from unaccountable agencies.<\/p>\n<p>&ldquo;It may be the case that Donald Trump is so full of confidence that he thinks he can wave his wand, and whatever he wants to happen will happen,&rdquo; Senator Warren said on prime-time television on Monday night. &ldquo;And particularly, Elon Musk would like nobody to notice that he just wants to get rid of them before he launches his new financial product.&rdquo;<\/p>\n<p>Democrats are desperate for the courts to stop the newly elected administration from delivering on the mandate given by voters after the president <a href=\"https:\/\/thefederalist.com\/2024\/09\/05\/trump-pledges-to-create-elon-musk-led-government-efficiency-commission-in-major-economic-address\/\" target=\"_blank\" rel=\"noreferrer noopener\">campaigned<\/a> with Musk on a platform of government efficiency. <\/p>\n<p>&ldquo;In recent days dozens of lawsuits have been filed against the Trump administration by Democrat attorneys general and various left-wing groups. These groups have carefully selected their venues, ensuring the lawsuits come before rabidly anti-Trump activist judges,&rdquo; <a href=\"https:\/\/thefederalist.com\/2025\/02\/11\/ousted-from-power-by-voters-dems-turn-to-activist-judges-to-defy-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> Federalist Senior Editor John Davidson. &ldquo;So far, the tactic seems to be working. As of this past weekend, eight different rulings from the federal bench have temporarily halted the president&rsquo;s executive orders.&rdquo;<\/p>\n<p>But Democrats are concerned their latest round of lawfare targeting their political opponents in the executive branch may not work in every case.<\/p>\n<p>&ldquo;My view right now is the courts are where we are hanging on to our constitutional structure,&rdquo; Warren said. &ldquo;They still have the power to hold everybody else in this country in contempt if they do not follow lawfully issued court orders.&rdquo;<\/p>\n<p>The Massachusetts senator, however, was eager to &ldquo;<a href=\"https:\/\/www.warren.senate.gov\/newsroom\/press-releases\/warren-sanders-and-colleagues-commend-biden-on-historic-student-debt-relief-effort-and-offer-feedback-to-strengthen-proposal\" target=\"_blank\" rel=\"noreferrer noopener\">commend<\/a>&rdquo; Biden on circumventing judicial blocks on student debt payments characterized as &ldquo;forgiveness&rdquo; when Democrats controlled the White House. <\/p>\n<p>&ldquo;Let me be very clear, President Biden has the legal authority to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jacob-sullum-the-aclus-latest-step-to-becoming-just-another-progressive-scold-at-civil-liberties-expense\/\" title=\"Jacob Sullum: The ACLU\u2019s Latest Step to Becoming Just Another Progressive Scold \u2014 At Civil Liberties\u2019 Expense\">cancel student-loan debt<\/a>,&rdquo; Warren <a href=\"https:\/\/www.marketwatch.com\/story\/elizabeth-warren-president-biden-has-the-legal-authority-to-cancel-student-loan-debt-87795016\">sai<\/a><a href=\"https:\/\/www.marketwatch.com\/story\/elizabeth-warren-president-biden-has-the-legal-authority-to-cancel-student-loan-debt-87795016\" target=\"_blank\" rel=\"noreferrer noopener\">d<\/a> in 2023, accusing legal efforts to derail the payments as &ldquo;baseless.&rdquo;<\/p>\n<p>President Joe Biden <a href=\"https:\/\/www.foxnews.com\/media\/biden-brags-supreme-court-stop-canceling-student-loans-happy-break-law\" target=\"_blank\" rel=\"noreferrer noopener\">bragged<\/a> about his success in circumventing the judicial branch on student loans months later.<\/p>\n<p>&ldquo;Early in my term, I announced a major plan to provide millions of working families with debt relief for their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/5-questions-biden-should-be-asked-if-the-debate-is-fair\/\" title=\"5 Questions ... Should Be Asked If The Debate Is Fair\">college student debt<\/a>,&rdquo; Biden said at a speech in California. &ldquo;And the Supreme Court blocked it. But that didn&rsquo;t stop me.&rdquo;<\/p>\n<p>Nor did the courts stop Biden from engaging in all kinds of executive overreach, with unelected bureaucrats passing new rules such as <a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/us-court-upholds-epa-decision-approve-california-electric-vehicle-rules-2024-04-09\/\" target=\"_blank\" rel=\"noreferrer noopener\">strict emissions standards<\/a> and agency <a href=\"https:\/\/thefederalist.com\/2025\/01\/22\/mark-zuckerberg-confirmed-the-supreme-court-ignored-direct-evidence-of-massive-federal-censorship-scheme\/\" target=\"_blank\" rel=\"noreferrer noopener\">censorship<\/a> of American speech.<\/p>\n<p>While Democrats used Congress&rsquo;s vague laws to expand the federal government&rsquo;s role under the executive branch, Musk is merely using them to shrink the agencies as a presidential designee.
