That&rsquo;s all fine and good by the news media because they also hate Trump. But what they didn&rsquo;t anticipate was the zeal with which Trump 2.0&rsquo;s legal team would fight not just Democrats but also their presumed authority on the Constitution, a governing document still relatively young and far from fully tested.<\/p>\n<p>After several judges in recent days ordered the Trump administration to stop exercising the president&rsquo;s authority over the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/campaign-2024-an-early-look-at-the-possible-republican-contenders\/\" title=\"Campaign 2024: An Early Look At The Possible Republican Contenders\">executive branch<\/a>, one of them then accused the administration of <a href=\"https:\/\/www.nytimes.com\/2025\/02\/10\/us\/trump-unfreezing-federal-grants-judge-ruling.html\" target=\"_blank\" rel=\"noreferrer noopener\">defying an order<\/a> to continue pushing billions of dollars to God knows where. The news media are using it all as an opportunity to microwave their &ldquo;threat to democracy&rdquo; hysteria.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1949813011\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>&ldquo;Trump&rsquo;s Actions Have Created a Constitutional Crisis, Scholars Say,&rdquo; a New York Times <a href=\"https:\/\/www.nytimes.com\/2025\/02\/10\/us\/politics\/trump-constitutional-crisis.html\" target=\"_blank\" rel=\"noreferrer noopener\">headline<\/a> blared on Monday. CNN legal analyst Joan Biskupic <a href=\"https:\/\/www.cnn.com\/2025\/02\/10\/politics\/constitutional-crisis-trump-overhaul-analysis-biskupic\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">warned<\/a> of &ldquo;a possible constitutional breakdown of American government.&rdquo; NBC News also <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/white-house-officials-bristle-courts-throttle-trump-agenda-rcna191504\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> with alarm that &ldquo;the nation may be edging closer to a constitutional crisis.&rdquo;<\/p>\n<p>To be sure, it&rsquo;s always some kind of &ldquo;crisis&rdquo; when the Washington status quo <a href=\"https:\/\/thefederalist.com\/2025\/02\/07\/if-elons-doge-is-to-successfully-cut-government-waste-there-can-be-no-but-about-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">is threatened<\/a>. The possibility of cutting one dollar from the federal budget or removing one middling bureaucrat from a bloated agency is always &ldquo;unprecedented&rdquo; and sure to result in <a href=\"https:\/\/www.foxnews.com\/media\/bill-gates-worried-about-scaling-back-usaid-you-could-have-literally-millions-deaths\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;literally millions of deaths.&rdquo;<\/a>  The pattern has played out this way for decades.<\/p>\n<p>But now there&rsquo;s someone in office who&rsquo;s serious about changing it and who isn&rsquo;t waving a white flag at the first bit of pushback from the judiciary. Under the radical theory that the executive branch of the federal government is in fact controlled by the executive (that&rsquo;s the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/history-repeats-itself-democrats-are-using-tactics-of-the-marxists-of-1917-in-russia-to-steal-2020-election\/\" title=\"History Repeats Itself: Democrats Are Using Tactics of the Marxists of 1917 in Russia to Steal 2020 Election\">duly elected president<\/a>), the Trump administration is appealing these court orders issued by unelected judges. And to the extent that the administration is defying them, there&rsquo;s a non-obscure legal argument that they&rsquo;re not even constitutional.<\/p>\n<p>White House Deputy Chief of Staff Stephen Miller made that point in a social media post <a href=\"https:\/\/x.com\/stephenm\/status\/1888680181096645028?s=46\" target=\"_blank\" rel=\"noreferrer noopener\">on Sunday<\/a>. &ldquo;Hey Pete,&rdquo; he wrote in a response to former Transportation Secretary Pete Buttigieg, &ldquo;care to show us the line in the Constitution where it says a lone unelected district judge can assume decision-making control over the entire executive branch affecting 300M citizens? Any mention of nationwide district court [temporary restraining orders]? Or permanent all-powerful bureaucracy?&rdquo;<\/p>\n<p>Vice President J.D. Vance similarly <a href=\"https:\/\/x.com\/JDVance\/status\/1888607143030391287\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> on X, &ldquo;Judges aren&rsquo;t allowed to control the executive&rsquo;s legitimate power.&rdquo;<\/p>\n<p>The short version of what&rsquo;s been happening is Trump has issued a slew of executive orders directing federal agencies to do various things, some more controversial than others, like deny formal citizenship documents to the children of illegal aliens on U.S. soil. Democrat and activist judges have reacted by issuing their own orders compelling the administration to stop some of these policies, including &mdash;&nbsp;get this &mdash; a freeze on spending some money. Yes, a judge has demanded that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/terrence-p-jeffrey-biden-has-increased-debt-33521-per-income-tax-payer\/\" title=\"Terrence P. Jeffrey: Biden Has Increased Debt ,521 Per Income Tax Payer\">government spend money<\/a> it literally doesn&rsquo;t have. That&rsquo;s where we are in this &ldquo;constitutional crisis,&rdquo; and we should think long and hard about who got us here.<\/p>\n<p>Whether district judges even have the authority to issue a nationwide injunction orders is also up for debate.
