No country has ever made an offer of friendship such as this,&rdquo; Rubio said.<\/p>\n<p>A U.S. official told <a href=\"https:\/\/www.cbsnews.com\/news\/rubio-el-salvador-us-deportees-extraordinary-offer\/\" target=\"_blank\" rel=\"noopener\">CBS News<\/a> afterward that the Trump administration has no plans to take Bukele up on his offer to jail U.S. citizens. CBS pointed out such a move would face serious legal challenges.<\/p>\n<p>For one, U.S. citizens are protected by the Eighth Amendment&rsquo;s prohibition against cruel and unusual punishment. &ldquo;These rights extend to the existence of humane living conditions, adequate medical care, and protection from violence by other inmates,&rdquo; the Justice Department explains on its <a href=\"https:\/\/www.ojp.gov\/ncjrs\/virtual-library\/abstracts\/prison-overcrowding-eighth-amendments-prohibition-against-cruel-and#:~:text=The%20eighth%20amendment%20provides%20prisoners,from%20violence%20by%20other%20inmates.\" target=\"_blank\" rel=\"noopener\">website<\/a>.<\/p>\n<p>None of this could be guaranteed in El Salvador.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">&ldquo;No country has ever made an offer of friendship such as this.&rdquo; &mdash; <a href=\"https:\/\/twitter.com\/SecRubio?\">@SecRubio<\/a> on President <a href=\"https:\/\/twitter.com\/nayibbukele?\">@nayibbukele<\/a>&rsquo;s historic proposal to the United States. &#127480;&#127483;&#127482;&#127480;<a href=\"https:\/\/t.co\/IQqlbSBWXs\">pic.twitter.com\/IQqlbSBWXs<\/a><\/p>\n<p>&mdash; Herbert Esmahan (@HerbertEsmahan) <a href=\"https:\/\/twitter.com\/HerbertEsmahan\/status\/1886652461655437547?\">February 4, 2025<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>However, President Donald Trump has made it a top priority to remove members of the <a href=\"https:\/\/www.westernjournal.com\/biden-doj-gives-disgraceful-plea-deal-vicious-ms-13-leader-admitted-involvement-7-murders\/\" target=\"_blank\" rel=\"noopener\">MS-13<\/a> and Tren de Argua gangs from U.S. soil.<\/p>\n<p>On his first day in office, he issued an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/designating-cartels-and-other-organizations-as-foreign-terrorist-organizations-and-specially-designated-global-terrorists\/\" target=\"_blank\" rel=\"noopener\">executive order<\/a> designating both as foreign terrorist organizations and directing the expedited removal of their members.<\/p>\n<p>Bukele is famous for locking up tens of thousands of gang members in his country and seeing the <a href=\"https:\/\/amzn.to\/3YuVZYV\">crime rate drop dramatically afterward<\/a> to among the lowest in Latin America, according to <a href=\"https:\/\/www.nytimes.com\/2024\/02\/08\/opinion\/el-salvador-bukele-election.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>.<\/p>\n<p>Some may argue that federal law prohibits sending those convicted of federal crimes to overseas prisons.<\/p>\n<p>For example, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3621\" target=\"_blank\" rel=\"noopener\">18 U.S. Code &sect; 3621<\/a> clearly states the standard is &ldquo;to the extent practicable,&rdquo; prisoners are to be jailed 500 miles from their residence.<\/p>\n<p>But the Trump administration can determine it&rsquo;s not practical or in the best interest of the country to have noncitizens filling U.S. jails and send them on their way to El Salvador or wherever.<\/p>\n<p>Last week, Trump <a href=\"https:\/\/www.westernjournal.com\/trump-announces-plans-send-worst-criminal-migrants-guantanamo-bay\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> plans to use the American military installation at Guantanamo Bay, Cuba, to house the &ldquo;worst&rdquo; criminal illegal aliens.<\/p>\n<p>At a bill-signing ceremony at the White House for the&nbsp;Laken Riley Act, Trump said, &ldquo;I&rsquo;m also signing an executive order to instruct the Departments of Defense and Homeland Security to begin preparing the 30,000-person migrant facility at Guantanamo Bay.
