Lewis Voting rights Act, which had\u200d previously been challenged as \u2064unconstitutional by a state Supreme Court ruling. The appellate decision reversed this earlier ruling, reaffirming that the \u2064Voting Rights Act remains valid. The Act requires municipalities with discrimination histories\u2063 to obtain preclearance before\u2063 altering their voting systems, which has led to lawsuits\u200b challenging at-large voting systems in towns\u200d like Newburgh and mount Pleasant. Critics argue that these provisions may unintentionally\u2062 divide \u200dcommunities by prioritizing \u2062racial and ethnic representation \u200dover collaborative governance. Lewis Voting Rights Act constitutional, reversing a decision that came down from the state Supreme Court in Orange County.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1092865884\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The legislation was signed into law in 2022 and, in part, forces municipalities with a record of discrimination to obtain preclearance before making changes to how they conduct voting systems. The legislation was being used by some to sue towns for how they conduct their elections.<\/p>\n<p>For example, six black and Hispanic residents in the town of <a href=\"https:\/\/nypost.com\/2024\/07\/10\/us-news\/gop-official-slams-ny-election-lawsuits-as-secret-effort-to-knock-conservatives-from-office\/\" target=\"_blank\" rel=\"noreferrer noopener\">Newburgh<\/a> challenged the town&rsquo;s &ldquo;at-large&rdquo; voting system, which lets all voters choose every board member instead of electing representatives from specific districts. The plaintiffs argued the system inhibits their ability to elect a candidate of their choice. <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/03\/2024-11-07-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Newburgh had a population<\/a> of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-nixes-law-dems-were-leveraging-to-take-over-ny-towns\/\" title=\"Court Nixes Law Dems Were Leveraging To Take Over NY ...s\">approximately 60 percent white<\/a>, 15 percent black and 25 percent Hispanic. The suit alleged that black and Hispanic voters couldn&rsquo;t elect a candidate of their choice without having specific districts drawn in which only voters in the specific district could vote for the candidate of their choice.<\/p>\n<p>Similarly, five Hispanic voters sued the <a href=\"https:\/\/thefederalist.com\/2024\/07\/24\/dems-use-new-election-law-to-bully-a-new-york-town-that-wont-accept-illegal-aliens\/\" target=\"_blank\" rel=\"noreferrer noopener\">Town of Mount Pleasant<\/a>, hoping to force the town to abandon its at<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-orders-mission-viejo-to-pay-700000-in-legal-fees-for-term-limit-lawsuits\/\" title=\"Mission Viejo ordered to pay 0k in legal fees for term limit lawsuits by judge.\">-large voting system<\/a>.<\/p>\n<p>The New York State Supreme Court in Orange County <a href=\"https:\/\/thefederalist.com\/2024\/11\/08\/judge-overturns-new-york-voting-law-dems-were-using-to-strong-arm-towns-into-accepting-illegal-migrants\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in November that the John R. Lewis Voting Rights Act &ldquo;on its face, classifies people according to their race, color and national origin&rdquo; and is a &ldquo;race-based&rdquo; statute that violates the Equal Protection Clause of the 14th Amendment of the U.S Constitution.<\/p>\n<p>But the Second Appellate Division overturned the state Supreme Court&rsquo;s decision, finding that &ldquo;even if the vote dilution provisions of the NYVRA did violate the Equal Protection Clause, the Supreme Court had no authority to invalidate the remaining portions of the NYVRA,&rdquo; <a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/politics\/2025\/01\/30\/court-rules-n-y--john-r--lewis-voting-rights-act-constitutional\" target=\"_blank\" rel=\"noreferrer noopener\">according to Spectrum News 1<\/a>.<\/p>\n<p>New York Assemblyman Anil Beephan told The Federalist the court&rsquo;s decision was disappointing. <\/p>\n<p>&ldquo;I am disappointed in the court&rsquo;s decision to reinstate the New York Voting Rights Act, as it may unintentionally undermine the very communities it claims to support. Having served as an at-large councilman, I have seen firsthand how ward-based systems can foster division rather than unity, forcing representatives to compete for resources instead of working collaboratively for the common good,&rdquo; Beephan said.<\/p>\n<p>&ldquo;In an at-large system, every board member is accountable to the entire community, ensuring that aid reaches those most in need. As I often say, a victory for one is a victory for all.
