To this day, more than 40 emergencies are still in effect.<\/p>\n<p>However, Trump is applying the statute in unprecedented ways that stretch the definition of a national emergency.<\/p>\n<p>He is using its authorities to speed up drilling and pipeline projects at a time when natural gas exports are at a <a href=\"https:\/\/www.eia.gov\/todayinenergy\/detail.php?id=61823\" target=\"_blank\" rel=\"noopener\" title=\"\">record high<\/a>. His southern border declaration, meanwhile, follows a dramatic decline in illegal crossings at the tail end of the Biden administration.&nbsp;<\/p>\n<p>Border agents made fewer than 1,500 <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3300041\/illegal-crossings-cut-half-november-election-border-patrol-data\/\" target=\"_blank\" rel=\"noopener\" title=\"\">arrests per day<\/a> ahead of Trump&rsquo;s inauguration, down from the 10,000-plus daily crossers apprehended at the height of the border crisis in 2023.<\/p>\n<figure class=\"wp-block-image size-large\"><figcaption class=\"wp-element-caption\">President Donald Trump holds a signed executive order on deregulation in the Oval Office of the White House, Friday, Jan. 31, 2025, in Washington. (AP Photo\/Evan Vucci)<\/figcaption><\/figure>\n<h2 class=\"wp-block-heading\">Critics cry abuse at bypassing Congress<\/h2>\n<p>Critics of the emergency declarations fear a slippery slope in which the NEA&rsquo;s powers are used to sidestep Congress or take dramatic steps that infringe civil liberties.<\/p>\n<p>Emergency declarations unlock powers across <a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/guide-emergency-powers-and-their-use\" target=\"_blank\" rel=\"noopener\" title=\"\">more than 130<\/a> federal provisions that could, in theory, be used to <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/2022-update-reforming-emergency-powers\" target=\"_blank\" rel=\"noopener\" title=\"\">seize assets<\/a> without due process or restrict internet service.<\/p>\n<p>&ldquo;We understand emergencies as sudden and unexpected and responsive to quick fixes,&rdquo; said Soren Dayton, the director of governance at the Washington-based Niskanen Center. &ldquo;Neither the energy or border situations are that.&rdquo;<\/p>\n<p>Dayton also called President Joe Biden&rsquo;s <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/biden-used-emergency-powers-forgive-student-debt-thats-slippery-slope\" target=\"_blank\" rel=\"noopener\" title=\"\">student loan cancellation<\/a> program an &ldquo;abuse&rdquo; given its reliance on the COVID-19 national emergency declaration.<\/p>\n<p>&ldquo;Sometimes administrations use emergencies as a way to bypass regular lawmaking,&rdquo; he said.<\/p>\n<h2 class=\"wp-block-heading\">Trump challenges congressional authority<\/h2>\n<p>Trump&rsquo;s emergency declarations reflect the aggressive posture he is taking in a second term. On his first day, Trump also issued an order <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3294232\/trump-signs-order-keep-tiktok-up-75-days\/\" target=\"_blank\" rel=\"noopener\" title=\"\">delaying a ban<\/a> on TikTok past a congressionally set deadline.<\/p>\n<p>Days later, he fired <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3300649\/trump-fires-17-inspectors-general-overnight\/\" target=\"_blank\" rel=\"noopener\" title=\"\">more than a dozen<\/a> agency watchdogs, ignoring a statutory requirement to inform Congress of his reasoning ahead of time.<\/p>\n<p>Trump&rsquo;s willingness to <a href=\"https:\/\/amzn.to\/3YuVZYV\">challenge congressional authority dates back<\/a> to his first term. He declared his original emergency at the southern border in 2019 to construct a wall that Congress refused to finance fully.<\/p>\n<p>Bipartisan majorities in both chambers tried to repeal the emergency <a href=\"https:\/\/www.nytimes.com\/2019\/10\/17\/us\/politics\/senate-veto-override-border.html\" target=\"_blank\" rel=\"noopener\" title=\"\">twice<\/a>, seeing it as an attempt to usurp their power of the purse, only to face Trump&rsquo;s veto each time.<\/p>\n<p>Trump has stoked new controversies as he seeks to push the envelope further in a second term.<\/p>\n<p>Democrats celebrated last week as the White House issued and then withdrew a&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3304402\/trump-administration-backs-down-on-federal-aid-freeze\/\" target=\"_blank\" rel=\"noopener\" title=\"\">hastily-released memo<\/a>&nbsp;freezing federal aid that threw states into a panic.<\/p>\n<p>The about-face, which came after a judge paused the order, represented the rare case of Trump seemingly backpedaling in the face of a PR disaster. But he has plowed ahead on other executive actions without the same level of resistance, particularly from Republicans.<\/p>\n<p>Republican senators <a href=\"https:\/\/www.politico.com\/news\/2025\/01\/22\/gop-china-trump-tiktok-00199964\" target=\"_blank\" rel=\"noopener\" title=\"\">generally shrugged<\/a> over the TikTok order, viewing the delay as inconsequential if the end result is its sale to a U.S. company. Republican reaction was also muted over the inspector general firings, though Sen. Chuck Grassley (R-IA), a defender of government watchdogs, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3303446\/grassley-durbin-demand-trump-explain-inspectors-general-firings\/\" target=\"_blank\" rel=\"noopener\" title=\"\">sent a letter<\/a> calling for Trump to provide congressionally mandated explanations for each.<\/p>\n<p>On the emergency declarations, Trump has support this time around from corners of the GOP that ordinarily oppose unilateral executive action.<\/p>\n<p>&ldquo;I haven&rsquo;t seen anything that he&rsquo;s done right now that pushes the limits, certainly relative to what other presidents have done,&rdquo; said Sen. Mike Lee (R-UT).<\/p>\n<p>Lee was one of 12 GOP senators who <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1161\/vote_116_1_00049.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">voted to rescind<\/a> Trump&rsquo;s 2019 border declaration. He&rsquo;s also the <a href=\"https:\/\/www.lee.senate.gov\/2023\/6\/sen-lee-reintroduces-article-one-act-to-reclaim-congressional-power\" target=\"_blank\" rel=\"noopener\" title=\"\">lead sponsor<\/a> of the ARTICLE ONE Act, a bill that would rein in the ability to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-suddenly-love-emergency-powers-after-criticizing-trumps-use-of-them\/\" title=\"Democrats Suddenly Love ... After Criticizing ...s Use of Them\">declare national emergencies<\/a>.<\/p>\n<h2 class=\"wp-block-heading\">Trump invites lawsuits<\/h2>\n<p>That&rsquo;s not to say Trump won&rsquo;t face opposition to his emergency declarations.<\/p>\n<p>It&rsquo;s <a href=\"https:\/\/www.reuters.com\/business\/energy\/trump-us-energy-emergency-order-should-withstand-court-challenges-2025-01-22\/\" target=\"_blank\" rel=\"noopener\" title=\"\">unlikely<\/a> a court will rule on what constitutes a national emergency, with judges reluctant to do so in past cases. The NEA itself does not contain a <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10267\" target=\"_blank\" rel=\"noopener\" title=\"\">definition<\/a>.<\/p>\n<p>Trump&rsquo;s expansive use of the statute is expected to provoke legal challenges, however, as his administration eases permitting and review requirements for energy projects.<\/p>\n<p>&ldquo;Is it going to be challenged? Undoubtedly,&rdquo; said Dayton. &ldquo;There is no shortage of money in the environmental movement to challenge whatever actions end up being taken under the emergency.&rdquo;<\/p>\n<p>The Trump administration maintains the powers are justified to counter the &ldquo;active threat&rdquo; of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mass-gubernatorial-candidate-geoff-diehl-earns-trump-endorsement\/\" title=\"Mass. gubernatorial candidate Geoff Diehl earns Trump ...orsement\">high energy costs<\/a>, citing the &ldquo;harmful and shortsighted policies of the previous administration&rdquo; in its emergency declaration.<\/p>\n<p>Republicans also point to competition with China on artificial intelligence in explaining their comfort with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-has-signed-40-executive-orders-and-actions-since-taking-office\/\" title=\"Biden has signed 40 executive orders and ...ions since taking ...\">energy executive order<\/a>. The U.S. is in the process of <a href=\"https:\/\/www.washingtonexaminer.com\/premium\/3291987\/powering-on-efforts-restart-shut-down-nuclear-plant-first-time\/\" target=\"_blank\" rel=\"noopener\" title=\"\">bringing online<\/a> new power plants to keep pace with the vast energy resources required for the technology.<\/p>\n<p>&ldquo;Now, is that a life-or-death type of emergency? Perhaps not, but it is an economic opportunity that if we miss [it], a lot of that stuff could go other places,&rdquo; said Sen. Kevin Cramer, a Republican from energy-rich North Dakota.<\/p>\n<p>On the border, the political climate has shifted in Republicans&rsquo; favor since 2019, with Democrats now reluctant to pick a fight over Trump&rsquo;s executive actions. The GOP also has unified control of Washington in 2025, giving Trump a chance to secure the sort of border funding he wants without a congressional showdown.<\/p>\n<p>Instead, Democrats have focused on the funding freeze as they struggle to find a cohesive message in Trump&rsquo;s second term, with blowback to the White House memo representing their <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3305072\/trump-first-term-mistakes-federal-funding-whiplash\/\" target=\"_blank\" rel=\"noopener\" title=\"\">first chance<\/a> to go back on offense.<\/p>\n<p>&ldquo;I think what happened, and I think this happened for the Left and the Right this week, is just a good reminder that nobody has magical political powers,&rdquo; said Sen. Brian Schatz (D-HI), a member of Senate Democratic leadership. &ldquo;That if you do unpopular things, you get less popular. And if you do illegal things, courts will stop you.&rdquo;&nbsp;<\/p>\n<p>&ldquo;And so, I certainly think on the Left, it was a good reminder that we may be out of power, but we&rsquo;re not powerless, and it&rsquo;s a good reminder for people on the Right, that they may have won, but they are not all-powerful.&rdquo;<\/p>\n<h2 class=\"wp-block-heading\">Congress eyes reform<\/h2>\n<p>The National Emergencies Act was originally enacted as a way to set guardrails on presidents&rsquo; emergency powers. Through the law, <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Congress\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Congress<\/a> gave itself a &ldquo;legislative veto&rdquo; that allowed it to end any national emergency on its own.<\/p>\n<p>But the Supreme Court overturned that provision as unconstitutional in 1983, while other elements of the law have gone ignored by presidents and lawmakers alike.<\/p>\n<p>Dayton, the Niskanen Center director, helped organize a letter in October urging Congress to <a href=\"https:\/\/www.niskanencenter.org\/letter-congress-must-pass-bipartisan-reforms-to-the-national-emergencies-act\/\" target=\"_blank\" rel=\"noopener\" title=\"\">rewrite the statute<\/a>.
