However, the\u2062 EO&#8217;s definition of &#8220;mother&#8221; as the &#8220;immediate female biological progenitor&#8221; presents a loophole that can\u2063 be exploited by foreign nationals, \u2063particularly \u2064from China, through advanced reproductive technologies like \u200cin vitro fertilization (IVF) and surrogacy. This has led \u2063to a rise in &#8220;birth \u200dtourism,&#8221; where wealthy foreigners use American surrogates to secure U.S. citizenship\u200c for their children.<\/p>\n<p>Critics argue that the EO&#8217;s reliance on biological parentage might allow for foreign \u200dnationals to claim citizenship for\u2062 their children if American donor eggs or sperm are involved in conception, raising concerns\u200d over the \u2063implications\u200b of defining parenthood \u2064strictly in biological terms.Surrogacy organizations have expressed that if the surrogate is a U.S. citizen, it could lead \u2064to the \u2062child \u200dalso being recognized\u200b as a citizen, despite the biological parents \u200bbeing foreign. <\/p>\n<p>The demand for American surrogates has surged, \u2064particularly among Chinese nationals, causing a significant increase in contracts for such services. In this very way, \u200cit is indeed deemed essential that the EO explicitly address various forms \u200bof birth tourism to prevent continued exploitation of U.S. citizenship.\u200b Emma waters from The Heritage Foundation\u2062 emphasizes the need for clear definitions in the EO to ensure that citizenship benefits are not\u200c commoditized by \u2063foreign nationals.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President Trump&rsquo;s executive order (EO) on&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">birthright citizenship<\/a>&nbsp;clarifies a longstanding&nbsp;<a href=\"https:\/\/www.dailysignal.com\/2025\/01\/24\/debunking-4-big-errors-made-in-lawsuit-to-stop-trumps-birthright-citizenship-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">debate<\/a>: Children of non-U.S. citizens who are&nbsp;<a href=\"https:\/\/www.dailysignal.com\/2025\/01\/23\/new-bill-would-codify-trumps-birthright-citizenship-executive-order-into-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">unlawfully<\/a>&nbsp;or temporarily in the United States are not&nbsp;<a href=\"https:\/\/www.heritage.org\/immigration\/commentary\/9-things-know-about-birthright-citizenship\" target=\"_blank\" rel=\"noreferrer noopener\">automatically eligible<\/a>&nbsp;for&nbsp;<a href=\"https:\/\/www.dailysignal.com\/2024\/12\/11\/trump-can-end-universal-birthright-citizenship-constitution-never-required-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">citizenship<\/a>. Still, the EO&rsquo;s definition of mother &mdash; &ldquo;the immediate female biological progenitor&rdquo; &mdash; creates an unintentional loophole that foreign nationals, predominately from China, will continue to exploit.<\/p>\n<p>Advances in reproductive technology, including&nbsp;in vitro&nbsp;fertilization (IVF) and commercial surrogacy, have enabled a pervasive industry of high-tech birth tourism. Instead of requiring a woman to travel to the United States to give birth, wealthy foreign nationals may contract with an American surrogate to bear children for them in the U.S. This loophole exploits the privilege of citizenship and reduces it to a global commodity.<\/p>\n<p>Since the EO defines mother and father as the&nbsp;<em>biological<\/em>&nbsp;progenitors of the child, this raises an important question: What does this mean for foreign nationals who use an American&rsquo;s donor egg or sperm to conceive a child?<\/p>\n<p>Even though the foreign nationals are the legal and intended parents, a strict reliance on the child&rsquo;s <a href=\"https:\/\/amzn.to\/3YuVZYV\">biological parent means foreign nationals<\/a> could claim citizenship for their child. And, depending on the court&rsquo;s interpretation of &ldquo;immediate&rdquo; and &ldquo;progenitor,&rdquo; this could apply to the&nbsp;<a href=\"https:\/\/www.dailysignal.com\/2023\/11\/09\/whose-baby-is-it-complications-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">surrogate mother<\/a> too.<\/p>\n<p>While this may seem far-fetched, the use of IVF and surrogacy means a child could be born with as many as&nbsp;<a href=\"https:\/\/www.dailysignal.com\/2021\/05\/08\/how-surrogacy-harms-women-and-children\/\" target=\"_blank\" rel=\"noreferrer noopener\">three &ldquo;mothers&rdquo;<\/a>: her biological mother (the egg donor), her birth mother (the surrogate), and her legal mother (the woman who will legally raise her). Similarly, she may have two &ldquo;fathers,&rdquo; her sperm donor and her legal father.<\/p>\n<p>For those actively working to protect the privilege of U.S. citizenship, it is imperative for the EO&rsquo;s definition of &ldquo;mother&rdquo; and &ldquo;father&rdquo; to include children created through U.S. donor egg or sperm and surrogacy.<\/p>\n<p>Surrogacy organizations have begun to weigh in. The&nbsp;<a href=\"https:\/\/www.tsonglaw.com\/post\/will-trump-s-executive-order-affect-international-intended-parents\" target=\"_blank\" rel=\"noreferrer noopener\">Tsong Law Group<\/a>&nbsp;argues that the use of &ldquo;progenitor&rdquo; subtly implies that if the woman giving birth is a U.S. citizen, in this case a surrogate, then the child would be too, even if the parents are foreign nationals. Other surrogacy agencies, such as&nbsp;<a href=\"https:\/\/creativefamilyconnections.com\/resources\/surrogacy-trump-birthright-international\/\" target=\"_blank\" rel=\"noreferrer noopener\">Creative Family Connections<\/a>, have announced &ldquo;a 2-step birth certificate process&rdquo; to ensure that children of American surrogates and foreign nationals still get U.S. citizenship.<\/p>\n<p>As the&nbsp;<a href=\"https:\/\/surrogatefirst.com\/surroblog\/trumps-call-to-end-birthright-citizenship-what-does-it-mean-for-surrogacy-in-the-us-in-2025\/\" target=\"_blank\" rel=\"noreferrer noopener\">Surrogate First<\/a>&nbsp;agency recognizes, &ldquo;For <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americas-rent-a-womb-industry-lures-an-alarming-number-of-chinese-nationals\/\" title=\"China&#039;s Citizens Flock to America&#039;s Surrogacy Business\">international intended parents<\/a>, the certainty of their child obtaining U.S. citizenship at birth is a significant factor in choosing the U.S. for surrogacy arrangements.&rdquo; These are blatant examples of surrogacy agencies selling citizenship to foreign buyers via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/viral-video-reveals-the-true-dehumanizing-horror-of-surrogacy\/\" title=\"Discover the Harsh Reality of Surrogacy in a Compelling Video Gone Viral\">commercial surrogacy agreements<\/a>.<\/p>\n<p>Over the last 15 years, major news outlets such as NPR (<a href=\"https:\/\/www.npr.org\/2022\/09\/22\/1124441144\/chinas-covid-rules-complicate-things-for-parents-whose-surrogates-live-in-the-u-\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>,&nbsp;<a href=\"https:\/\/www.npr.org\/sections\/parallels\/2014\/04\/21\/305514689\/made-in-the-u-s-a-childless-chinese-turn-to-american-surrogates\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>,&nbsp;<a href=\"https:\/\/www.npr.org\/2020\/04\/28\/847466191\/american-surrogate-30-months-later\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>,&nbsp;<a href=\"https:\/\/www.npr.org\/transcripts\/547332434\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, and&nbsp;<a href=\"https:\/\/www.npr.org\/2022\/10\/22\/1128837495\/surrogacy-birth-tourism-china-california\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>),&nbsp;<a href=\"https:\/\/www.nytimes.com\/2019\/09\/24\/opinion\/china-america-surrogacy.html\" target=\"_blank\" rel=\"noreferrer noopener\">The New York Times<\/a>,&nbsp;<a href=\"https:\/\/money.cnn.com\/2015\/08\/24\/news\/surrogacy-china-american-mom\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">CNN<\/a>,&nbsp;<a href=\"https:\/\/www.pbs.org\/pov\/films\/howtohaveanamericanbaby\/\" target=\"_blank\" rel=\"noreferrer noopener\">PBS<\/a>, the&nbsp;<a href=\"https:\/\/www.latimes.com\/business\/la-xpm-2012-feb-19-la-fi-china-surrogate-20120219-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">Los Angeles Times<\/a>, and&nbsp;<a href=\"https:\/\/abc7.com\/surrogate-surrogacy-covid-19-china\/6426485\/\" target=\"_blank\" rel=\"noreferrer noopener\">more<\/a>&nbsp;have reported on the curious case of foreign nationals, specifically from China, using American surrogates to secure citizenship for their children. As one Chinese man, Zheng, explained in an&nbsp;<a href=\"https:\/\/www.npr.org\/2022\/10\/22\/1128837495\/surrogacy-birth-tourism-china-california\" target=\"_blank\" rel=\"noreferrer noopener\">interview with NPR<\/a>, &ldquo;In the foreseeable future, China and the U.S. will definitely be the two strongest countries in the world,&rdquo; adding, &ldquo;If the U.S. is not the first, then China will be and it will definitely be a win-win situation for your children in the future if they have both these nationalities.&rdquo;<\/p>\n<p>&ldquo;Before the pandemic, Zheng says, Chinese demand for surrogacy and birth tourism services was so high he used to rent out entire apartment buildings for Chinese families,&rdquo; NPR reported.<\/p>\n<p>Indeed, in 2024, the American Society for Reproductive Medicine&rsquo;s academic journal released a&nbsp;<a href=\"https:\/\/www.fertstert.org\/article\/S0015-0282(23)02142-8\/abstract\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>&nbsp;revealing that contracts between foreign nationals and American surrogates increased by 78 percent between 2014 (2,758 cycles) and 2019 (4,905 cycles). Chinese nationals make up 41.7 percent of cases. While we do not know the exact number of births, surrogacy agencies estimate hundreds, if not thousands, of births annually.<\/p>\n<p>Such foreign nationals are not only relying on American surrogates but pursuing American egg donors too. To this point, Jennifer Garcia, a surrogacy case coordinator with Extraordinary Conceptions,&nbsp;<a href=\"https:\/\/www.npr.org\/sections\/parallels\/2014\/04\/21\/305514689\/made-in-the-u-s-a-childless-chinese-turn-to-american-surrogates%23:~:text=Made%2520In%2520The%2520USA%253A%2520Childless%2520Chinese%2520Turn%2520To%2520American%2520Surrogates,-Listen%25C2%25B7%25206%253A43&amp;text=Song%252FReuters%252FLandov-,After%2520failed%2520attempts%2520with%2520Chinese%2520surrogates%252C%2520Tony%2520Jiang%2520and%2520his,thanks%2520to%2520an%2520American%2520surrogate.&amp;text=Chinese%2520couples%2520who%2520are%2520unable,for%2520help%2520these%2520days%253A%2520America.\" target=\"_blank\" rel=\"noreferrer noopener\">told NPR<\/a>, &ldquo;They [Chinese clients] all say the same thing: tall, blond, blue-eyed and pretty.&rdquo;<\/p>\n<p>An entire&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/04\/17\/chinas-stateside-rent-a-womb-industry-poses-yet-another-national-security-nightmare\/\" target=\"_blank\" rel=\"noreferrer noopener\">boutique industry<\/a>&nbsp;of surrogacy agencies caters to this lucrative market, with many specializing in Chinese clientele. These families want citizenship not only for their children but also for themselves.&nbsp;As I argue in&nbsp;<a href=\"https:\/\/americanmind.org\/salvo\/california-new-handmaids-tale\/\" target=\"_blank\" rel=\"noreferrer noopener\">The American Mind<\/a>, there are many benefits to creating a child in the United States. Those children get full American citizenship, birth certificates, and Social Security numbers.
