This lawsuit,the first of its kind challenging a meaningful aspect of Trump&#8217;s Defense Department agenda,was filed by GLAD Law and \u200bthe National Center for Lesbian Rights in\u2064 Washington,D.C. The\u200b plaintiffs include six\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/army-investigating-chaplain-who-said-transgender-people-unqualified-to-serve\/\" title=\"Army Investigating Chaplain Who Said Transgender People \u2018Unqualified To Serve\u2019\">transgender service members<\/a> and two individuals wishing to enlist, claiming the order violates the\u200b Fifth Amendment&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/unc-chapel-hill-bars-use-of-race-and-sex-in-admissions\/\" title=\"UNC-Chapel Hill prohibits use of race and sex in admissions.\">equal protection\u2064 clause<\/a>.<\/p>\n<p>The contentious executive order declares that expressing a gender identity different from one&#8217;s biological \u200csex at birth is incompatible with military standards. It also prohibits the use of non-traditional pronouns within the armed forces, while leaving ambiguous\u2062 the status \u200bof \u2064currently serving transgender troops.\u2062 This order\u2063 follows\u200c Trump&#8217;s earlier attempts to restrict transgender military service, \u200bincluding a total ban proposed in 2017.<\/p>\n<p>Advocates argue that an estimated 15,000 transgender service \u200cmembers are currently in the military, although this\u2062 number is contested. The lawsuit has been\u2064 met \u2062with strong criticism\u2062 from LGBT organizations and some Democratic lawmakers, who argue the order is \u2062discriminatory. The lawsuit marks the first legal challenge to a key aspect of Trump&rsquo;s conservative agenda at the Defense Department.<\/p>\n<div class=\"article-paywall\">\n<p>The lawsuit, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276845\/gov.uscourts.dcd.276845.1.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">filed<\/a> by GLAD Law and the National Center for Lesbian Rights in a federal court in the District of Columbia, alleges that the executive order violates the equal protection clause of the Fifth Amendment. (AP Photo\/Armando Franca)<\/figcaption><\/figure>\n<p>&ldquo;When you put on the uniform, differences fall away and what matters is your ability to do the job,&rdquo; <a href=\"https:\/\/www.glad.org\/glad-law-and-nclr-file-challenge-to-trumps-transgender-military-ban\/\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> Army 2nd Lt. Nicolas Talbott, one of eight <a href=\"https:\/\/amzn.to\/3YuVZYV\">military service member plaintiffs named<\/a> in the lawsuit.<\/p>\n<p>Trump&rsquo;s executive order, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3302523\/trump-executive-orders-military-excellence\/\" target=\"_blank\" rel=\"noopener\" title=\"\">signed<\/a> Monday, declared that expressing a gender identity different from one&rsquo;s biological sex at birth is inconsistent with military standards. It also banned the use of &ldquo;invented&rdquo; pronouns within the armed forces.<\/p>\n<p>However, the order left some questions unanswered, such as whether currently serving transgender troops would be allowed to remain in uniform and how removals would be handled if not.<\/p>\n<p>This move represents a continuation of Trump&rsquo;s previous efforts to restrict transgender service in the military. In 2017, during his first term, Trump announced plans to ban transgender troops entirely, citing <a href=\"https:\/\/www.cnn.com\/2017\/07\/26\/politics\/trump-military-transgender\/index.html\" target=\"_blank\" rel=\"noopener\" title=\"\">&ldquo;tremendous medical costs and disruption.&rdquo;<\/a> While his administration froze new transgender recruitment, serving personnel were allowed to remain. Then-President Joe Biden reversed that policy in 2021, allowing transgender people to serve openly.<\/p>\n<p>Transgender rights advocates <a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/trans-military-service-us\/?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\" title=\"\">claim there are as many<\/a> as 15,000 transgender service members in the U.S. military, though a RAND Corporation study from 2016 found the number to be in the low thousands.<\/p>\n<p>The executive order has <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/green-premium-wall-streets-leftist-esg-standards-are-making-inflation-worse\/\" title=\"\u2018Green Premium\u2019: Wall Street\u2019s Leftist ESG Standards Are Making Inflation Worse\">drawn sharp criticism<\/a> from LGBT advocacy groups, rights organizations, and some Democratic lawmakers.
