Following his disclosures in\u2062 May\u200b 2023, which included evidence presented to\u2063 conservative activist Christopher Rufo, Texas lawmakers voted \u2063to \u200bban \u2063these procedures.\u2064 <\/p>\n<p>Despite the ongoing investigations into TCH,\u2064 the\u200c DOJ has\u200d pressed charges against Haim, \u2064accusing\u200b him of unauthorized\u200c access to confidential patient information, which he claims could\u2063 lead to significant jail time. Haim has\u200c appealed \u200bto \u2063President Trump to intervene, \u200carguing that his prosecution is a misuse of federal power and an attack on his whistleblowing efforts.<\/p>\n<p>Haim stated he is facing a de facto gag order\u2063 imposed by a judge, and has called the prosecution&#8217;s actions &#8220;shameless,&#8221; \u200dclaiming they disregard \u2064law\u2062 and order. \u2063Highlighting trends of intimidation, after the exposures \u200dcame to light, <a href=\"https:\/\/amzn.to\/3YuVZYV\">federal agents\u2064 allegedly\u2062 targeted<\/a> him and other whistleblowers. Amid investigations, \u2062a prosecutor involved in Haim&#8217;s case had to step down due to conflicts of interest linked to \u2064her family&#8217;s ties with TCH.<\/p>\n<p>The DOJ has faced \u2064criticism for alleged incompetence in its handling of Haim&#8217;s case, having issued multiple indictments\u2062 filled with errors.haim asserts his access to patient information was legitimate, thus challenging the merits of the DOJ&#8217;s case. As he approaches a federal trial,\u200c the whistleblower remains vocal about his situation and \u200dthe government&#8217;s actions in what\u200c he\u200d terms an\u200d orchestrated attack\u200b on dissent\u200b regarding transgender medical practices\u2062 for \u200bminors.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Department of Justice is still pursuing charges against a Texas doctor who exposed transgender operations on kids. He told The Federalist he could face jail time in just days and pled with President Donald&#8203; Trump to stop the lawfare.<\/p>\n<p>&ldquo;This case needs to be dropped with prejudice because this illegal application of HIPAA will destroy the medical profession,&rdquo; the whistleblower, Eithan Haim, told The Federalist. &ldquo;Not only that but the prosecutors and FBI agents involved need to be investigated for potential criminal abuse of power.&rdquo;<\/p>\n<p>Haim, a Dallas-area doctor, <a href=\"https:\/\/www.city-journal.org\/article\/sex-change-procedures-at-texas-childrens-hospital\" target=\"_blank\" rel=\"noreferrer noopener\">exposed<\/a> Texas Children&rsquo;s Hospital in May 2023 for performing transgender procedures on children as young as 11. Texas Attorney General Ken Paxton had classified the operations as &ldquo;<a href=\"https:\/\/www.google.com\/search?client=safari&amp;rls=en&amp;q=texas+ag+paxton+trans+minors+child+abuse&amp;ie=UTF-8&amp;oe=UTF-8\" target=\"_blank\" rel=\"noreferrer noopener\">child abuse<\/a>,&rdquo; and TCH <a href=\"https:\/\/www.texastribune.org\/2022\/03\/04\/texas-transgender-children-hormone-therapy\/#:~:text=Texas%20Children's%20Hospital%20in%20Houston%20has%20stopped%20providing%20hormone%20therapy,affirming%20care%20to%20their%20children.\" target=\"_blank\" rel=\"noreferrer noopener\">lied<\/a> about no longer providing them. But Haim <a href=\"https:\/\/www.city-journal.org\/article\/sex-change-procedures-at-texas-childrens-hospital\" target=\"_blank\" rel=\"noreferrer noopener\">exposed<\/a> TCH to conservative activist Christopher Rufo for continuing these procedures. The next day, the Texas state Senate voted to <a href=\"https:\/\/legiscan.com\/TX\/votes\/SB14\/2023\" target=\"_blank\" rel=\"noreferrer noopener\">ban<\/a> the practice, and Paxton launched multiple <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/paxton-announces-second-investigation-texas-hospital-potentially-unlawfully-performing-gender\" target=\"_blank\" rel=\"noreferrer noopener\">investigations<\/a> into the hospital.<\/p>\n<p>Starting last year, President Joe Biden&rsquo;s DOJ pressed <a href=\"https:\/\/www.justice.gov\/usao-sdtx\/pr\/doctor-charged-unauthorized-access-personal-information-pediatric-patients-texas\" target=\"_blank\" rel=\"noreferrer noopener\">charges<\/a> against Haim. Though President Donald Trump has taken office and <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-the-weaponization-of-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> an end to federal &ldquo;weaponization,&rdquo; the DOJ is continuing to persecute the doctor for exposing the secret child mutilation.&nbsp;<\/p>\n<p>A judge has placed a <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">de-facto gag order<\/a> on the doctor and said if he violates it, he could be held in jail until trial. Haim told The Federalist he could &ldquo;possibly&rdquo; face jail time in a matter of days for alleged &ldquo;contempt.&rdquo;<\/p>\n<p>&ldquo;These people have proven themselves to be shameless, absolutely shameless. They have a complete and utter disregard for law and order,&rdquo; Haim said. &ldquo;They&rsquo;re willing to do anything to prosecute the people they don&rsquo;t like.&rdquo;<\/p>\n<p>The doctor posted on Wednesday that he can &ldquo;no longer afford to stay silent&rdquo; as he <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">approaches<\/a> federal trial in February. He said the &ldquo;weaponized prosecution is being accelerated behind closed doors in direct <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-the-weaponization-of-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">violation<\/a> of the President&rsquo;s Executive Order.&rdquo;<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>I can no longer to afford to stay silent. <\/p>\n<p>I am scheduled to go to trial in a few weeks in a place which has up until this point been nothing less than a kangaroo court. But I can assure you that today that weaponization is just as alive as it was January 19th, 2025.&rdquo;&nbsp;<\/p>\n<h2>Crushing Dissent<\/h2>\n<p>The month after Haim &mdash; then a <a href=\"https:\/\/www.justice.gov\/usao-sdtx\/pr\/doctor-charged-unauthorized-access-personal-information-pediatric-patients-texas\" target=\"_blank\" rel=\"noreferrer noopener\">resident<\/a> at the Baylor College of Medicine &mdash; exposed the secret transgender procedures on children, federal agents came to his door.&nbsp;<\/p>\n<p>&ldquo;They sent agents to my home on the day of my graduation, the most important day of my life, like two hours before the ceremony,&rdquo; Haim said. &ldquo;They were sending agents in order to use the importance of my accomplishments &mdash; what that day meant &mdash; as the means of their extortion.&rdquo;<\/p>\n<p>They served him with a letter informing he was a &ldquo;potential target&rdquo; of a &ldquo;criminal investigation.&rdquo;<\/p>\n<div>\n<figure><figcaption>\n<div>\n<p>The first letter agents served to Eithan Haim informing him he was under investigation. <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">Andrea Haim | Twitter<\/a><\/p>\n<\/div>\n<\/figcaption><\/figure>\n<\/div>\n<p>Vanessa Sivadge &mdash; an RN at TCH &mdash; <a href=\"https:\/\/www.city-journal.org\/article\/texas-childrens-hospital-whistleblower-speaks-out\" target=\"_blank\" rel=\"noreferrer noopener\">corroborated<\/a> Haim&rsquo;s story to Rufo. They&rsquo;re like, &lsquo;We have to find out who this other whistleblower is,&rsquo;&rdquo; Haim said. &ldquo;But they already knew who I was.&rdquo;&nbsp;<\/p>\n<p>In January 2024, Haim went <a href=\"https:\/\/www.city-journal.org\/article\/a-whistleblower-on-gender-affirming-care-speaks-out\" target=\"_blank\" rel=\"noreferrer noopener\">public<\/a>. And in June of that year, Sivadge followed &mdash; alleging that the hospital committed <a href=\"https:\/\/www.city-journal.org\/article\/the-murky-business-of-transgender-medicine\" target=\"_blank\" rel=\"noreferrer noopener\">Medicaid fraud<\/a> to pay for child transgender procedures.&nbsp;<\/p>\n<p>Also in June, the DOJ indicted Haim. The indictment <a href=\"https:\/\/www.justice.gov\/usao-sdtx\/pr\/doctor-charged-unauthorized-access-personal-information-pediatric-patients-texas\" target=\"_blank\" rel=\"noreferrer noopener\">accused<\/a> Haim of &ldquo;obtaining protected individual health information for patients that were not under his care and without authorization&rdquo; &mdash; and said he could face up to 10 years in prison.<\/p>\n<h2>Conflicts of Interest<\/h2>\n<p>Tina Ansari, assistant U.S. attorney for the Southern District of Texas, prosecuted Haim. She was ultimately forced to <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/terminated-doj-attorney-prosecuting-whistleblower-dr-eithan-haim-has-been-removed-from-case-over-conflicts-of-interest\/\" target=\"_blank\" rel=\"noreferrer noopener\">step down<\/a> from the case in November due to various <a href=\"https:\/\/www.foxnews.com\/media\/doj-lead-attorney-prosecuting-trans-medicine-whistleblower-taken-off-case-over-apparent-conflict-interest\" target=\"_blank\" rel=\"noreferrer noopener\">conflicts of interest<\/a>.<\/p>\n<figure><figcaption>\n<div>\n<p>Tina Ansari&rsquo;s conflicts of interest. As the lawfare was underway, her brother Ali Ansari and her aunt Sima Ladjevardian <a href=\"https:\/\/www.texaschildrens.org\/support\/events\/once-upon-time-amrina\/once-upon-time-amrina-sponsors\" target=\"_blank\" rel=\"noreferrer noopener\">sponsored<\/a> <a href=\"https:\/\/eppc.org\/wp-content\/uploads\/2024\/11\/2024-11-13-Letter-re-Ansari-Conflict75.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">multiple<\/a> <a href=\"https:\/\/www.texaschildrens.org\/support\/events\/evening-with-legends\/sponsors\" target=\"_blank\" rel=\"noreferrer noopener\">fundraisers<\/a> for the hospital.<\/p>\n<p>The prosecutor&rsquo;s family has various Democrat political ties. Her aunt Sima <a href=\"https:\/\/ballotpedia.org\/Sima_Ladjevardian\" target=\"_blank\" rel=\"noreferrer noopener\">unsuccessfully<\/a> ran as a Democrat against Republican Rep. Dan Crenshaw in 2020. Sima and her husband, Masoud, <a href=\"https:\/\/www.texastribune.org\/2015\/06\/04\/clinton-caps-two-days-texas-houston-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">hosted<\/a> a fundraiser for Hillary Clinton in 2015 &mdash; which Tina&rsquo;s brother Ali <a href=\"https:\/\/houston.culturemap.com\/news\/society\/06-05-15-inside-hillary-clintons-private-houston-fundraiser-after-fiery-speech-dem-frontrunner-charms-top-donors\" target=\"_blank\" rel=\"noreferrer noopener\">attended<\/a> (he was even noted as a &ldquo;classmate and friend&rdquo; of Chelsea Clinton).&nbsp;<\/p>\n<p>After these revelations &mdash; and Tina Ansari&rsquo;s law license <a href=\"https:\/\/eppc.org\/wp-content\/uploads\/2024\/09\/2024-09-18-Doc-49-Defendants-Motion-to-Show-Cause-re-Tina-Ansari.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lapsed<\/a> during the proceedings &mdash; she stepped down and was <a href=\"https:\/\/houstonlanding.org\/doctor-accused-of-leaking-trans-patient-data-attacks-prosecution-on-social-media-ahead-of-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">replaced<\/a> by Assistant U.S. Attorney Jessica Feinstein, who has <a href=\"https:\/\/www.opensecrets.org\/donor-lookup\/results?name=Jessica+Feinstein\" target=\"_blank\" rel=\"noreferrer noopener\">donated<\/a> to a Democrat campaign in the past.&nbsp;<\/p>\n<h2>Incompetent Lawfare<\/h2>\n<p>The DOJ has refiled its indictment against Haim <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/dojs-new-indictment-of-whistleblower-eithan-haim-is-even-more-outrageous\/\" target=\"_blank\" rel=\"noreferrer noopener\">twice<\/a> due to serious errors.&nbsp;<\/p>\n<p>Prosecutors initially <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> Haim used &ldquo;false pretenses&rdquo; to access patients&rsquo; medical records. They said he &ldquo;emailed an administrator at TCH urgently requesting that his login credentials be restored so he could access &lsquo;operative cases&rsquo; he was &lsquo;covering.&rsquo; This was a lie.&rdquo;<\/p>\n<p>But prosecutors should have <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">known<\/a> Haim had authorized access to the systems, as he was operating on an adult patient in the hospital at the time &mdash; as revealed in the DOJ&rsquo;s own discovery. TCH staff even admitted Haim had authorized access to the system.<\/p>\n<figure><figcaption>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/figcaption><\/figure>\n<p>But the FBI still <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">pushed<\/a> the claim that &ldquo;an asteroid would have to strike Galveston Bay&rdquo; for Haim to have authorized access.<strong> <\/strong>Prosecutors were ultimately forced to admit they &ldquo;did not <em>knowingly<\/em> provide false evidence to the grand jury&rdquo; (emphasis added).&nbsp;<\/p>\n<p>In October, the DOJ <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">doubled down<\/a> with its second indictment &mdash; making adjustments to the first, suggesting prosecutors knew their case was weak. One change was in the language of Haim&rsquo;s charges, from &ldquo;obtain and\/or wrongfully disclose&rdquo; patient information to &ldquo;obtain and\/or use&rdquo; patient information. But the judge called out Ansari, as this vague language is found nowhere in the law.<\/p>\n<div>\n<figure><figcaption><\/figcaption><\/figure>\n<\/div>\n<p>The second indictment included other <a href=\"https:\/\/x.com\/AndreaCohenHaim\/status\/1881078336979714554\" target=\"_blank\" rel=\"noreferrer noopener\">mistakes<\/a>, such as citing a nonexistent &ldquo;subchapter XL.&rdquo;<strong> <\/strong>Haim pointed out other gaping issues.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Friday, we had a Motion to Dismiss hearing. <\/p>\n<p>DOJ so thoroughly embarrassed themselves, it&#8217;s hard to comprehend how this is still ongoing. <\/p>\n<p>There&#8217;s nothing I can say to translate how bad it was. <\/p>\n<p>You have to read it for yourself. <\/p>\n<p>And this was only first few minutes! <a href=\"https:\/\/t.co\/vbRldxfR9w\">pic.twitter.com\/vbRldxfR9w<\/a><\/p>\n<\/div>\n<p>&mdash; Eithan Haim MD (@EithanHaim) <a href=\"https:\/\/twitter.com\/EithanHaim\/status\/1859242476160115020?ref_src=twsrc%5Etfw\">November 20, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>When Feinstein replaced Ansari as lead prosecutor, the DOJ cleaned up the indictment and <a href=\"https:\/\/www.thefp.com\/p\/biden-prosecution-eithan-haim-gender-care-childrens-hospital-transitions\" target=\"_blank\" rel=\"noreferrer noopener\">refiled<\/a> again. Presumably because Haim embarrassed federal prosecutors for their past shortcomings online, they sought a <a href=\"https:\/\/thefederalist.com\/2024\/11\/27\/biden-doj-seeks-to-gag-texas-doctor-who-blew-whistle-on-child-trans-surgeries\/\" target=\"_blank\" rel=\"noreferrer noopener\">gag<\/a> order &mdash; which the judge declined to formally issue, but with a warning that &ldquo;similar conduct&rdquo; could land him in jail.&nbsp;<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">17\/ First, he cannot appeal and second, he doesn&#8217;t know what court would consider sanctionable conduct.
