Chip Roy of Texas, with the support of 25 Republican cosponsors, reintroduced <a href=\"https:\/\/roy.house.gov\/sites\/evo-subsites\/roy.house.gov\/files\/evo-media-document\/Bill%20Text%20-%20Roy_FACE%20ACT%20REPEAL_119th.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a> on Tuesday that seeks to prevent the political prosecution of peaceful pro-lifers by repealing the <a href=\"https:\/\/thefederalist.com\/2022\/10\/28\/the-face-act-is-unconstitutional-its-past-time-congress-got-rid-of-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">Freedom of Access to Clinic Entrances (FACE) Act<\/a>.<\/p>\n<p>Congress first passed the FACE Act in 1994. It was at the direction of President Joe Biden after the Supreme Court&rsquo;s 2022 <em>Dobbs v. Jackson<\/em> decision nearly two decades later, however, that the FBI and Department of Justice started to arrest and hand down <a href=\"https:\/\/thefederalist.com\/2024\/05\/14\/peaceful-pro-lifer-gets-years-in-prison-after-biden-doj-targeted-her-under-face-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">uncharacteristically harsh sentences<\/a> to dozens of people, many Christians, who peacefully protested ending life in the womb. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1034715428\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>&ldquo;Americans just spent the last four years being targeted by a weaponized justice system. The FACE Act was one of the primary weapons of abuse &mdash; being used to politically target, arrest, and jail pro-life Americans for speaking out and standing up for life,&rdquo;&nbsp;Roy said in <a href=\"https:\/\/roy.house.gov\/media\/press-releases\/rep-roy-reintroduces-legislation-repeal-face-act#:~:text=WASHINGTON%20%E2%80%94%20Rep.%20Chip%20Roy%20(,by%20a%20weaponized%20justice%20system.\" target=\"_blank\" rel=\"noreferrer noopener\">a statement<\/a>.<\/p>\n<p>Former FBI Director Christopher Wray <a href=\"https:\/\/thefederalist.com\/2024\/07\/24\/christopher-wray-says-fbi-does-not-target-peaceful-pro-lifers-the-stats-prove-otherwise\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> Congress during a House Judiciary Committee hearing in July 2024 that his agency did not single out those who made their opposition to abortion known. As Roy noted, however, &ldquo;97% of FACE Act prosecutions from 1994-2024 were against pro-life Americans.&rdquo;&nbsp;<\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2024\/07\/24\/christopher-wray-says-fbi-does-not-target-peaceful-pro-lifers-the-stats-prove-otherwise\/\" target=\"_blank\" rel=\"noreferrer noopener\">Only five<\/a>&nbsp;of the 60 FACE Act<strong>&nbsp;<\/strong>cases brought under the Biden regime zeroed in on pro-abortion extremists. The other 55 mostly <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/now-that-hoodies-are-the-senate-uniform-republicans-should-show-up-sporting-these-slogans\/\" title=\"Republicans should rock hoodies with catchy slogans now that they&#039;re the Senate uniform.\">targeted peaceful pro-lifers<\/a> who dedicated their time to<a href=\"https:\/\/thefederalist.com\/2024\/06\/19\/yes-bidens-department-of-justice-wants-to-imprison-peaceful-pro-lifers-for-praying\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;praying, singing, and evangelizing<\/a> at abortion facilities. <\/p>\n<p>Roy said that, while he appreciates the Trump administration&rsquo;s vigilance in &ldquo;reversing the damage of the J6 political prosecutions&rdquo; and its <a href=\"https:\/\/thefederalist.com\/2025\/01\/16\/petitions-ask-trump-to-pardon-the-pro-lifers-he-promised-to-get-out-of-the-biden-gulags\/\" target=\"_blank\" rel=\"noreferrer noopener\">potential<\/a> to do the same for <a href=\"https:\/\/amzn.to\/3YuVZYV\">persecuted pro-lifers<\/a>, it is Congress&rsquo;s duty &ldquo;to do our part to eliminate the laws used for the weaponization, including the FACE Act.&rdquo;<\/p>\n<p>&ldquo;Now that we have a Republican trifecta in the House, Senate, and White House, Congress should move quickly to repeal this law and ensure that no future president can weaponize it against pro-lifers ever again. No more excuses, let&rsquo;s get it done,&rdquo; Roy said. <\/p>\n<p>The attempt to repeal the FACE Act is not isolated to the Republican-controlled House. GOP Sen. Mike Lee, who has <a href=\"https:\/\/x.com\/BasedMikeLee\/status\/1871637267208720403\" target=\"_blank\" rel=\"noreferrer noopener\">long<\/a> stood <a href=\"https:\/\/www.newsweek.com\/congress-must-stop-bidens-weaponization-government-against-pro-lifers-opinion-1895588\" target=\"_blank\" rel=\"noreferrer noopener\">with Roy<\/a> in calling for the end of the act, is expected to mirror the move in the upper chamber. <\/p>\n<p>Thomas More Society Senior Counsel Stephen Crampton, who has led the legal effort to represent pro-lifers unfairly persecuted under Biden in court, told The Federalist that abolishing the FACE Act has been a long time coming.<\/p>\n<p>&ldquo;The fact is, FACE, we believe, was unconstitutional from day one. It was beyond Congress&rsquo;s authority,&rdquo; he said. &ldquo;Since the<em> Dobbs<\/em> decision in 2022, clarifying the fact that abortion never was a federal constitutional right, the whole purpose for the FACE Act has vanished, and consequently the law itself ought to be done away with.&rdquo;<\/p>\n<p>In his testimony before the House Subcommittee on the Constitution and Limited Government in December, Crampton <a href=\"https:\/\/docs.house.gov\/meetings\/JU\/JU10\/20241218\/117765\/HHRG-118-JU10-Wstate-CramptonS-20241218.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">declared<\/a>, &ldquo;There is therefore no federal constitutional right to abortion, and the very reason for FACE&rsquo;s existence no longer exists.&rdquo;<\/p>\n<p>The only way to ensure this lost purpose and constitutional validity is properly addressed, he acknowledged to The Federalist on Tuesday, is for Congress to act while Republicans have control.<\/p>\n<p>&ldquo;Congress created the mess that has been the Face Act and its abuses, and Congress ultimately ought to be the one to fix it,&rdquo; Crampton said.<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
