The ruling\u2062 concluded that\u2063 these provisions do not infringe\u200b upon the First Amendment rights of the \u200dpetitioners. the\u200b legislation to prohibit TikTok and other \u2063applications controlled by foreign adversaries\u2062 was passed by Congress in \u2062April, with President Joe Biden supporting the measure.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Supreme Court upheld legislation to ban Chinese-owned TikTok as constitutional in a Friday ruling.<\/p>\n<p>&ldquo;Congress has determined that divestiture is necessary to address its well-supported national security concerns regarding TikTok&rsquo;s data collection practices and relationship with a foreign adversary,&rdquo; reads the court&rsquo;s ruling. &ldquo;For the foregoing reasons, we conclude that the challenged provisions do not violate petitioners&rsquo; First Amendment rights.&rdquo;<\/p>\n<p>Congress passed a <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/7521\/text\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a> to ban TikTok and any other &ldquo;foreign adversary controlled applications&rdquo; in April, and President Joe Biden <a href=\"https:\/\/www.cnn.com\/2024\/04\/23\/tech\/congress-tiktok-ban-what-next\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a> it into law. But TikTok Inc., under Chinese parent company ByteDance Ltd., <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-656_ca7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> Attorney General Merrick Garland, alleging the ban violated the company&rsquo;s First Amendment right to freedom of speech.&nbsp;<\/p>\n<p>But the Supreme Court unanimously ruled &ldquo;per curiae&rdquo; Friday morning that Congress&rsquo; legislation is constitutional &mdash; enabling the ban to take <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-656_ca7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">effect<\/a> Sunday. However, it enables the president to &ldquo;grant a one-time extension of no more than 90 days&rdquo; if he &ldquo;makes certain certifications to Congress regarding progress toward a qualified divestiture,&rdquo; to ensure the app is &ldquo;no longer being controlled by a foreign adversary.&rdquo;<\/p>\n<p>Plaintiffs including TikTok Inc. <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-656_ca7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> the bill&rsquo;s &ldquo;TikTok-specific foreign adversary controlled application designation&rdquo; and &ldquo;divestiture requirement&rdquo; violate the First Amendment. But the Supreme Court noted the ban is &ldquo;content neutral&rdquo; and its provisions &ldquo;do not target particular speech.&rdquo;&nbsp;<\/p>\n<p>The court even went so far as to point out TikTok&rsquo;s substantial threat to national security. Its parent company ByteDance Ltd. &ldquo;owns TikTok&rsquo;s proprietary algorithm, which is developed and maintained in China,&rdquo; according to the ruling, and is &ldquo;responsible for developing portions of the source code.&rdquo;&nbsp;<\/p>\n<p>&ldquo;ByteDance Ltd. is subject to Chinese laws that require it to &lsquo;assist or cooperate&rsquo; with the Chinese Government&rsquo;s &lsquo;intelligence work&rsquo; and to ensure that the Chinese Government has &lsquo;the power to access and control private data&rsquo; the company holds,&rdquo; the ruling <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-656_ca7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>.&nbsp;<\/p>\n<p>Sen. Tom Cotton, R-Ark., referred to TikTok as &ldquo;a communist spy app.&rdquo;<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">ByteDance and its Chinese Communist masters had nine months to sell TikTok before the Sunday deadline.
