He retaliated by stabbing one of\u2064 his attackers, Stalin Moya, who died, while others were injured. Queens District Attorney Melinda Katz steadfast \u200bthat the homeless man would face no charges for Moya&#8217;s death, stating that he was \u200csimply \u200bdefending himself. \u2063Four assailants were indicted for their roles in the attack, facing charges of robbery and \u2064assault. Neely later died. A jury found Penny <a href=\"https:\/\/www.westernjournal.com\/daniel-penny-sends-scathing-message-leftist-city-leaders-fox-news-interview\/\" target=\"_blank\" rel=\"noopener\">not guilty<\/a>.<\/p>\n<p>Over in Queens, a victim who fought back, killing an attacker, will not be charged with a crime, but all four of his attackers have been indicted, according to the <a href=\"https:\/\/nypost.com\/2025\/01\/09\/us-news\/homeless-man-seen-stabbing-thugs-terrorizing-him-on-nyc-subway-killing-1-wont-face-charges-da\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>.<\/p>\n<p>&ldquo;This is a case that almost every commuter, or every individual who has taken the subway can relate to &mdash; an individual who is sleeping with his possessions with him and who suddenly gets woken up to a robbery and wants to simply get his property back and protect his self,&rdquo; Queens District Attorney Melinda Katz said, according to <a href=\"https:\/\/www.cbsnews.com\/newyork\/news\/new-york-city-subway-train-robbery-queens\/\" target=\"_blank\" rel=\"noopener\">CBS<\/a>.<\/p>\n<p>The incident took place on a <a href=\"https:\/\/www.westernjournal.com\/illegal-immigrant-arrested-connection-womans-nightmarish-nyc-subway-death-report\/\" target=\"_blank\" rel=\"noopener\">New York City subway<\/a> at about 12:30 a.m. on Dec. 22 when, according to video evidence, one man took a bag from a 69-year-old homeless man and went into another car from where the man was sleeping, the Post reported.
