The <em>Washington Examiner <\/em>reached out to their attorneys for comment.<\/p>\n<p>Trump submitted an amicus brief in support of his co-defendants, arguing that since a judge ruled this year that Smith was not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-appeals-to-dismiss-gun-charges-denied-ahead-of-june-trial\/\" title=\"Hunter Biden&#039;s requests to dismiss firearm charges rejected before June trial\">lawfully appointed special counsel<\/a>, Smith is not authorized to complete a special counsel report.<\/p>\n<p>&ldquo;The report is nothing less than another attempted political hit job which sole purpose is to disrupt the Presidential transition and undermine President Trump&rsquo;s exercise of executive power,&rdquo; attorneys wrote on behalf of Trump.<\/p>\n<p>Federal regulation requires special counsels to compile a confidential report explaining their prosecutorial decisions, and the attorney general has discretion over whether to publish it.<\/p>\n<p>Trump&rsquo;s attorneys had fumed in a letter to Garland on Monday about the prospect of the attorney general releasing either volume of the report to anyone. They said that after they reviewed a draft of it in recent days in Washington, they determined that making it public would create a &ldquo;media storm of unfair criticism&rdquo; that would interfere with Trump&rsquo;s transition into the White House.<\/p>\n<p>They also pointed to Judge Aileen Cannon&rsquo;s decision earlier this year to toss out all of the classified documents charges against Trump and his co-defendants after she found that Smith&rsquo;s appointment as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rejects-hunter-bidens-bid-to-dismiss-tax-charges-over-special-counsel-argument-washington-examiner\/\" title=\"Judge rejects Hunter Biden\u2019s bid to dismiss tax charges over special counsel argument - Washington Examiner\">special counsel violated<\/a> the Constitution.
