This order follows an emergency motion filed by Trump&#8217;s \u2064co-defendants, Waltine Nauta and Carlos De Oliveira, aimed at preventing the report&#8217;s imminent release. Amy Perkins (@adhesive_piece_) <a href=\"https:\/\/twitter.com\/adhesive_piece_\/status\/1876695456362942474?\">January 7, 2025<\/a><\/p>\n<\/blockquote>\n<p> <script type=\"text\/javascript\"> \t\t\tif ( getCookie( \"ff_subbed\" ) ) { \t\t\t\tdocument.getElementById(\"stnvideo\").remove() \t\t\t} \t\t<\/script> <\/p>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The judge&rsquo;s order specified that the report must not be made public until three days after the resolution of an emergency appeal that <a href=\"https:\/\/www.westernjournal.com\/trump-calls-arrest-jack-smith-prosecutors-admit-misleading-judge-evidence-tampered\/\" target=\"_blank\" rel=\"noopener\">Nauta<\/a> and Oliveira made to the 11th Circuit Court of Appeals in Atlanta to block the release of the report, according to Fox News.<\/p>\n<p><a href=\"https:\/\/abcnews.go.com\/US\/special-counsel-responds-after-trump-defendants-judge-block\/story?id=117413916\" target=\"_blank\" rel=\"noopener\">ABC News<\/a> reported, &ldquo;The special counsel&rsquo;s office assured Judge Cannon in their filing that Smith would not release that specific volume of the report [regarding the classified documents case] anytime before 10 a.m. Friday and that they would submit a fuller response to Nauta and DeOliveira&rsquo;s emergency motion no later than 7 p.m. Tuesday evening.&rdquo;<\/p>\n<p>ABC added that Trump&rsquo;s attorneys also sent a letter to Attorney General Merrick Garland, calling for Smith to be immediately removed from his position as special counsel and that any decision to release his report be deferred until after Trump&rsquo;s attorney general nominee, Pam Bondi, takes office.<\/p>\n<p>&ldquo;No report should be prepared or released, and Smith should be removed, including for even suggesting that course of action given his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/russian-olympic-committee-handed-immediate-ban-says-ioc\/\" title=\"IOC announces immediate ban on Russian Olympic Committee.\">obvious political motivations<\/a> and desire to lawlessly undermine the transition,&rdquo; attorneys Todd Blanche and Emil Bove wrote.<\/p>\n<p>Trump pleaded not guilty in July 2023 to 37 counts of mishandling classified materials.<\/p>\n<p>He, Nauta, and De Oliveira also pleaded <a href=\"https:\/\/www.westernjournal.com\/another-win-trump-jack-smith-withdraws-mar-lago-documents-case\/\" target=\"_blank\" rel=\"noopener\">not guilty<\/a> to a superseding indictment alleging the three had attempted to delete surveillance footage at Trump&rsquo;s Mar-a-Lago estate.<\/p>\n<p>Smith&rsquo;s team <a href=\"https:\/\/www.westernjournal.com\/another-win-trump-jack-smith-withdraws-mar-lago-documents-case\/\" target=\"_blank\" rel=\"noopener\">withdrew<\/a> last week from the Justice Department&rsquo;s appeal to the 11th Circuit of the classified documents case against Nauta and De Oliveira.<\/p>\n<p>Last month, Smith formally <a href=\"https:\/\/www.westernjournal.com\/nothing-like-ever-happened-trump-reacts-jack-smiths-final-act-closes-rough-chapter\/\" target=\"_blank\" rel=\"noopener\">dropped charges<\/a> against Trump in both the classified documents case and the 2020 election interference case.<\/p>\n<p>Smith <a href=\"https:\/\/www.westernjournal.com\/breaking-report-jack-smith-cases-trump-headed-exit\/\" target=\"_blank\" rel=\"noopener\">cited<\/a> the long-standing DOJ policy that sitting presidents cannot be criminally prosecuted.<\/p>\n<p>In an unusual move in October, Smith <a href=\"https:\/\/www.westernjournal.com\/cnn-legal-analyst-says-simply-no-defending-cheap-shot-jack-smith-just-took-trump\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> a 165-page brief containing &ldquo;evidence&rdquo; he planned to present if the election interference case ever went to trial.<\/p>\n<p>&ldquo;Trump&rsquo;s team objected, and the judge acknowledged that Smith&rsquo;s request to file first was &lsquo;procedurally irregular&rsquo; &mdash; moments before she ruled in Smith&rsquo;s favor, as she&rsquo;s done at virtually every consequential turn,&rdquo; CNN senior legal analyst Elie Honig <a href=\"https:\/\/www.westernjournal.com\/cnn-legal-analyst-says-simply-no-defending-cheap-shot-jack-smith-just-took-trump\/\" target=\"_blank\" rel=\"noopener\">noted<\/a> in a piece in New York Magazine&rsquo;s Intelligencer, titled &ldquo;Jack Smith&rsquo;s October Cheap Shot.&rdquo;<\/p>\n<p>So the filing became public just before November&rsquo;s election.<\/p>\n<p>Former federal prosecutor Andrew McCarthy agreed with Honig, writing in a piece for <a href=\"https:\/\/www.nationalreview.com\/2024\/10\/jack-smiths-damning-political-and-legally-flawed-j6-filing-against-trump\/\" target=\"_blank\" rel=\"noopener\">National Review<\/a>, &ldquo;This is not a legal exercise, it&rsquo;s a political one.&rdquo;<\/p>\n<p>He wrote, &ldquo;A prosecutor&rsquo;s case, like a football team&rsquo;s game plan, never looks better than it does on paper, before it experiences first contact with the opposing team.&rdquo;<\/p>\n<p>McCarthy explained that evidence is not really evidence that matters until it goes through the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-program-allowing-migrants-from-venezuela-other-countries-challenged-in-texas-court\/\" title=\"Texas Court Challenges Biden&#039;s Program Allowing Venezuelan and Other Migrants\">proper legal process<\/a>. &ldquo;As a rule, we don&rsquo;t get to see all the evidence until the trial begins.
