He wants to be freed on &ldquo;compassionate release&rdquo; &mdash; a status normally reserved for &ldquo;seriously ill or disabled patients who are incarcerated,&rdquo; WBTW reported.<\/p>\n<p>&ldquo;The petitioner&rsquo;s subjection to torture is the subsequent result of the petitioner&rsquo;s sentence to death, however, the additional punishment of solitary confinement which is the cause of the psychological harm is in no manner statutorily authorized, mandated, or required by the petitioner&rsquo;s sentence to death,&rdquo; Council declared in a motion in the U.S. District Court of Florence, WBTW reported.<\/p>\n<p>&ldquo;Within the jurisdiction of the United States it is both illegal and unconstitutional to inflict or subject any person to torture as a punitive consequence for a crime a party has been duly convicted of.&rdquo;<\/p>\n<p>Well, there&rsquo;s no denying that solitary confinement can&rsquo;t be a pleasant experience, but &ldquo;torture&rdquo; is a relative term.<\/p>\n<p>And &ldquo;torture&rdquo; could easily describe what Council inflicted on his victims&rsquo; families since the 2017 bank robbery in Conway, South Carolina, where he killed bank employees Donna Major and Katie Skeen.<\/p>\n<p>The women&rsquo;s deaths at Council&rsquo;s hands were recorded on bank surveillance cameras, according to the U.K.&rsquo;s <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-14236357\/murderer-killed-female-bank-workers-entitled-demand-biden-commuted-execution.html\" target=\"_blank\" rel=\"noopener\">Daily Mail<\/a>.<\/p>\n<p>&ldquo;Everyone should see the video of what he did to them,&rdquo; Skeen&rsquo;s mother, Betty Davis, told the Daily Mail.<\/p>\n<p>&ldquo;Everyone should see his face as he killed them. There was no emotion. It&rsquo;s how American cities from <a href=\"https:\/\/www.westernjournal.com\/9-members-violent-tren-de-aragua-gang-arrested-aurora-colorado\/\" target=\"_blank\" rel=\"noopener\">Aurora, Colorado<\/a>, to <a href=\"https:\/\/www.westernjournal.com\/cnn-hosts-appear-stunned-learn-migrants-steal-nyc-not-florida\/\" target=\"_blank\" rel=\"noopener\">New York City<\/a> have become infested with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/speaker-kevin-mccarthy-designate-cartels-as-terrorist-groups-embed-some-military-on-border-to-secure-southern-border\/\" title=\"Speaker Kevin McCarthy: Designate Cartels as Terrorist Groups, \u201cEmbed Some Military\u201d on Border to Secure Southern Border\">international criminal enterprises<\/a> and garden-variety thuggery.<\/p>\n<p>It&rsquo;s how innocent victims like <a href=\"https:\/\/www.westernjournal.com\/illegal-immigrant-accused-murdering-laken-riley-learns-fate\/\" target=\"_blank\" rel=\"noopener\">Laken Riley<\/a> end up dead.<\/p>\n<p>And for the president himself, a man sworn to uphold the laws of the United States, the legal system is a personal weapon. It&rsquo;s a sword to be wielded against his enemies, like now-President-elect Donald Trump or Americans who happen to hold <a href=\"https:\/\/www.westernjournal.com\/bidens-weaponized-doj-targets-pro-life-activists-new-lawsuit\/\" target=\"_blank\" rel=\"noopener\">pro-life views<\/a>, and sheathed when it comes to loved ones, like the crooked son <a href=\"https:\/\/www.westernjournal.com\/biden-pardons-hunter-lefty-outlet-tweets-something-either-hilariously-tone-deaf-brilliantly-ironic\/\" target=\"_blank\" rel=\"noopener\">he pardoned<\/a>.<\/p>\n<p>Biden&rsquo;s 11th-hour pardons and <a href=\"https:\/\/www.westernjournal.com\/biden-gives-christmas-gift-vicious-murderers-commutes-sentences-nearly-every-death-row-inmate\/\" target=\"_blank\" rel=\"noopener\">commutations<\/a> were a mockery of the justice system that lines up perfectly with how he&rsquo;s spent the past four years. He emptied death row in the federal prison system, leaving <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/12\/23\/federal-death-row-dylann-roof-robert-bowers-dzhokhar-tsarnaev\/77168412007\/\" target=\"_blank\" rel=\"noopener\">only three men<\/a> still facing execution:<\/p>\n<p>Dylann Roof, <a href=\"https:\/\/www.westernjournal.com\/jon-ossoff-aoc-stick-white-supremacist-murderer-dylann-roof\/\" target=\"_blank\" rel=\"noopener\">who massacred<\/a> nine <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jon-ossoff-aoc-stick-up-for-white-supremacist-murderer-dylann-roof\/\" title=\"Jon Ossoff, AOC Stick Up for White Supremacist Murderer Dylann Roof\">black church members<\/a> in South Carolina in 2015; Dzhokhar Tsarnaev, the <a href=\"https:\/\/www.westernjournal.com\/supreme-court-rules-boston-marathon-bombers-death-sentence-justice-thomas-crushes-unfair-trial-argument\/\" target=\"_blank\" rel=\"noopener\">Boston Marathon bomber<\/a> who killed three in 2013; Robert Bowers, <a href=\"https:\/\/www.westernjournal.com\/ap-pittsburgh-police-reveal-disturbing-statement-accused-tree-life-synagogue-shooter-attack\/\" target=\"_blank\" rel=\"noopener\">who killed 11<\/a> during a 2018 attack on a Pittsburgh synagogue.<\/p>\n<p>The more observant, or more cynical, reader will note the ecumenical nature of the monsters Biden declined to spare.<\/p>\n<p>Council was lucky. He isn&rsquo;t a white supremacist who killed black church congregants, a Muslim who bombed an iconic American tradition, or a raging anti-Semite who killed Jews. He&rsquo;s just a run-of-the-mill black murderer who killed two white women during the commission of a federal felony.<\/p>\n<p>So, naturally he gets a pass from the Grim Reaper, for now. But he wants more &mdash; and, given the way Biden has treated the law throughout his presidency, and is treating it on his way out the door, why shouldn&rsquo;t Council feels he at least has a chance to get out if he pushes his luck a little further?<\/p>\n<p>There&rsquo;s no doubt the death penalty is a controversial issue in the country, but there&rsquo;s also no doubt that the Founders considered it a part of any justice system. The <a href=\"https:\/\/www.law.cornell.edu\/constitution\/fifth_amendment\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a> states that no person shall &ldquo;be deprived of life, liberty, or property, without due process of law.&rdquo;<\/p>\n<p>That pretty clearly shows the deprivation of life was understood as part of doing business in the Founding era.<\/p>\n<p>The killers whose sentences Biden commuted had been afforded &ldquo;due process of law.&rdquo; And due process decided they deserved death.<\/p>\n<p>And in Council&rsquo;s case, the victims&rsquo; families agreed.<\/p>\n<p>&ldquo;He deserved the sentence he got,&rdquo; Davis told the Daily Mail. &ldquo;My daughter had no choice over her fate. She didn&rsquo;t get to choose what he did to her.&rdquo;<\/p>\n<p>&ldquo;Him getting the death sentence meant everything to us. It meant justice for Katie and Donna.&rdquo;<\/p>\n<p>But thanks to Biden&rsquo;s actions, that&rsquo;s going to be justice denied.<\/p>\n<p>That&rsquo;s bad enough.
