Prosecutors revealed their series of errors in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.606899\/gov.uscourts.nysd.606899.630.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"New Jersey Senator\">letter<\/a> last month, in which they told the Southern District of New York they had inadvertently given the jury access to evidence a judge ruled jurors should not see.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3251640\/intelligence-community-insiders-warn-against-tulsi-gabbard-dni\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>INTEL COMMUNITY INSIDERS WARN AGAINST TULSI GABBARD AS DNI<\/strong><\/a><\/p>\n<p>Immediately after reports that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/menendez-requests-new-trial-after-prosecutors-admit-error-washington-examiner\/\" title=\"Menendez requests new trial after prosecutors admit error - Washington Examiner\">prosecutors found improper evidence<\/a> placed on computers accessed by jurors, Menendez <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.606898\/gov.uscourts.nysd.606898.642.0.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">asked a federal court<\/a> to throw out his conviction and grant him a new trial, saying the outcome is now &ldquo;unavoidable.&rdquo; The push for a new trial comes as Menendez is expected to be sentenced Jan. 29.<\/p>\n<p>If Menendez and his attorneys get his way, the former senator could be on track to beat corruption charges a second time after a mistrial in a separate case in 2017 after jurors could not come to a unanimous verdict.<\/p>\n<figure class=\"wp-block-image size-full\"><figcaption class=\"wp-element-caption\">Senator Bob Menendez, D-N.J., arrives at Manhattan federal court, Tuesday, May 14, 2024, in New York. ON ULTRAPROCESSED FOOD: THE SCIENCE ON FOOD DYES, GLYPHOSPHATE, AND SEED OILS<\/strong><\/a><\/p>\n<p>Prosecutors <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3245024\/menendez-requests-new-trial-prosecutors-admit-error\/\" target=\"_blank\" rel=\"noopener\" title=\"\">argued<\/a> it&rsquo;s &ldquo;vanishingly unlikely&rdquo; and unreasonable to think any juror actually viewed all the documents on the laptop and came across the sensitive material, claiming &ldquo;there is no reasonable likelihood any juror ever saw any of the erroneously less-redacted versions.&rdquo;<\/p>\n<p>&ldquo;The prosecution gift-wrapped them one here,&rdquo; Jonathan Kravis, a former federal prosecutor, <a href=\"https:\/\/www.politico.com\/news\/2024\/12\/24\/evidence-menendez-corruption-charges-00195952\" target=\"_blank\" rel=\"noopener\" title=\"\">told<\/a><em>  Politico.<\/em><\/p>\n<p>Menendez&rsquo;s lawyers claim the exhibits &ldquo;exposed the jury to a theory of criminality that the government was barred from presenting under the Speech or Debate Clause &mdash; namely, that Senator Menendez made specific decisions with respect to military sales to Egypt in exchange for bribes.&rdquo;<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/3252864\/border-patrol-agents-see-trump-scott-nomination-pivot-right-direction\/\" target=\"_blank\" rel=\"noopener\" title=\"\"><strong>EXCLUSIVE: BORDER PATROL AGENTS WELCOME TRUMP NOMINATION OF RODNEY SCOTT<\/strong><\/a><\/p>\n<p>The Speech or Debate Clause under the Constitution requires members of Congress &ldquo;shall not be questioned&rdquo; for &ldquo;any speech or debate&rdquo; in either the House or Senate. The judge had ruled certain <a href=\"https:\/\/amzn.to\/3YuVZYV\">material referencing arms sales<\/a> and military aid to Egypt had been legislative acts that were shielded by the clause.<\/p>\n<p>Stan Brand, a former counsel to the House of Representatives, <a href=\"https:\/\/www.politico.com\/news\/2024\/12\/24\/evidence-menendez-corruption-charges-00195952\" target=\"_blank\" rel=\"noopener\" title=\"\">told<\/a><em>  Politico <\/em>the breach could lead to the judge making a decision to &ldquo;dismiss the indictment or give this guy a new trial.&rdquo;<\/p>\n<p>Menendez was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3095972\/bob-menendez-to-resign-following-guilty-verdict\/\" target=\"_blank\" rel=\"noopener\" title=\"\">charged<\/a> on <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/us-senator-robert-menendez-his-wife-and-three-new-jersey-businessmen-charged-bribery\" target=\"_blank\" rel=\"noopener\" title=\"\">16 federal counts<\/a> in late July, including extortion, honest services wire fraud, obstruction of justice, acting as a foreign agent for Egypt, bribery, and conspiracy. He was found guilty on all 16 counts last week after the jury deliberated for more than 12 hours over the course of three days.&nbsp;<\/p>\n<p>As a result, Menendez <a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3095972\/bob-menendez-to-resign-following-guilty-verdict\/\" target=\"_blank\" rel=\"noopener\" title=\"\">resigned<\/a> from the Senate on Aug. 20, following his felony conviction in the case. The third-term Democrat from New Jersey was accused of taking hundreds of thousands of dollars, a luxury convertible, furniture, and 13 gold bars in exchange for steering aid to Egypt, setting up a lucrative halal meat monopoly, and disrupting criminal investigations on behalf of his friends and family.&nbsp;<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>He is the first senator to be charged with acting as a foreign agent and the first to be indicted in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bob-menendez-convicted-on-all-charges-in-bribery-trial-washington-examiner\/\" title=\"Bob Menendez convicted on all charges in bribery trial - Washington Examiner\">separate bribery cases<\/a>.<\/p>\n<p>U.S. District Judge Sidney Stein has yet to address the laptop issues or calls for a new trial for Menendez. If sentencing moves forward, the most serious charges of extortion and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/17-florida-sheriffs-deputies-accused-of-stealing-about-500000-in-pandemic-relief-funds\/\" title=\"17 Florida deputies accused of stealing 0,000 in pandemic relief funds.\">wire fraud carry<\/a> a statutory maximum sentence of 20 years in prison. Menendez faces a maximum of 222 years in prison for all 16 charges, but it&rsquo;s likely any sentences would run concurrently.
