Bragg and Biden, separately, have denied this charge.<\/p>\n<p>Trump was originally scheduled to be sentenced for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-big-problem-with-the-stormy-daniels-hush-money-case-against-trump\/\" title=\"The Big Problem With The Stormy Daniels Hush Money Case Against Trump\">hush money case<\/a> in July. However, his sentencing date was pushed back due to the impact of the Supreme Court&rsquo;s presidential immunity ruling, which Trump&rsquo;s legal team has cited when engaging in back-and-forth appeals with Merchan for months.<\/p>\n<p>The Trump team saw a&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3238866\/judge-indefinitely-postpones-trump-new-york-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">boost<\/a>&nbsp;in November when Merchan indefinitely postponed sentencing in the case to give both the president-elect and Bragg time to make arguments for and against dropping the case entirely.<\/p>\n<p>However, Merchan&rsquo;s ruling on Monday struck a blow to Trump&rsquo;s argument that he is protected by the high court&rsquo;s presidential immunity finding.<\/p>\n<p>Trump spokesman Steven Cheung called the decision &ldquo;a direct violation of the Supreme Court&rsquo;s decision on immunity, and other longstanding jurisprudence,&rdquo; in comments to the <em>Washington Examiner<\/em>.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>&ldquo;This lawless case should have never been brought, and the Constitution demands that it be immediately dismissed, as President Trump must be allowed to continue the Presidential Transition process, and execute the vital duties of the presidency, unobstructed by the remains of this, or any other, Witch Hunt,&rdquo; Cheung said. &ldquo;The sooner these hoaxes end, the sooner our country can unite behind President Trump for the betterment of all Americans.&rdquo;<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-cant-deny-responsibility-for-our-so-so-divided-nation\/\" title=\"Biden Can\u2019t Deny Responsibility For Our \u2018So, So Divided\u2019 Nation\">president-elect&#038;rsquo<\/a>;s legal defense has also separately argued that the judge should toss the case because Trump won a second term in the Oval Office.
