This seems to be the prevailing opinion after the once-respected publication was seen as overly entitled in its portrayal of Marine veteran Daniel Penny. Penny’s trial has garnered national interest as he defends his actions from a May 2023 incident involving Jordan Neely, a mentally disturbed Michael Jackson impersonator, which ended with Neely’s death following a physical altercation. During this encounter, Neely allegedly threatened other subway passengers before Penny intervened and placed him in a headlock. Supporters of Penny argue that he acted heroically to neutralize a public threat.

On the other hand, critics have attempted to depict him as an unhinged vigilante with racial motives (Penny is white and Neely is black). The Times’ coverage began straightforwardly enough with the headline: “Daniel Penny Is Acquitted in Death of Jordan Neely on Subway,” which is hard to dispute. However, subsequent sections raised eyebrows; for instance, one header stated: “Mr. Penny choked Mr. Neely in a minutes-long struggle on the floor of an F train.” While factual, this language seemed aimed at influencing public perception.

The article continued by framing Penny as someone who sought trouble on the subway rather than portraying him as someone responding to an immediate threat. Critics have taken note of this slant; Commentary magazine editor John Podhoretz criticized it by sharing an image of the print edition featuring another headline: “Jury Acquits Man Who Was Choking Rider on Subway,” suggesting it fails to provide context.

Elon Musk also expressed disdain for what he called a “garbage publication.” Following backlash over its initial framing, the New York Times updated its front page description of Neely—now referred to merely as “a fellow subway rider who was homeless with mental health issues,” omitting any mention of his violent past—a change noted by reporter John LeFevre who highlighted how poorly received their original angle was

[42466,33295,33263
post-2378460","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-daniel-penny","tag-media-criticism","tag-new-york-times
["GET
