Wiley <a href=\"https:\/\/www.nytimes.com\/2024\/12\/06\/nyregion\/daniel-penny-jordan-neely-chokehold-trial.html\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> the more serious manslaughter charge against Penny, which carried a sentence of up to 15 years in prison.<\/p>\n<p>That ruling left the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jury-struggles-as-problem-strikes-daniel-penny-case\/\" title=\"Jury Struggles as Problem Strikes Daniel Penny Case\">criminally negligent homicide charge<\/a> still in place. There is no <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-activates-tactical-border-force-ahead-of-illegal-immigration-surge-at-border\/\" title=\"Texas deploys &#039;Tactical Border Force&#039; to prepare for increase in illegal immigration at the border.\">minimum jail sentence<\/a> for that charge, but the sentence can be up to <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2024\/12\/06\/daniel-penny-jordan-neely-subway-trial-verdict\/76476419007\/\" target=\"_blank\" rel=\"noopener\">four years<\/a>.<\/p>\n<p>Apparently, at least one juror who believed Penny was guilty of manslaughter had a change of heart over the weekend to allow Monday&rsquo;s not-guilty verdict on the lesser offense, which had to be unanimous.<\/p>\n<p>Penny still faces a wrongful death <a href=\"https:\/\/www.westernjournal.com\/daniel-penny-sued-jury-deliberates-sum-exceeds-jurisdictional-limits\/\" target=\"_blank\" rel=\"noopener\">civil suit<\/a> being brought by Neely&rsquo;s father.
