Penny&#8217;s defense argued that \u2062he was acting in self-defense against a volatile individual perceived as a threat, \u2063while\u200d prosecutors\u2062 contended that Penny&#8217;s response was excessively forceful. A more serious <a href=\"https:\/\/www.westernjournal.com\/just-major-charge-dismissed-daniel-penny-case\/\" target=\"_blank\" rel=\"noopener\">manslaughter charge was dismissed<\/a> earlier in deliberations because the jury deadlocked on that count.<\/p>\n<p>Both charges were felonies and carried the possibility of prison time.<\/p>\n<p>Penny put Jordan Neely in a chokehold for around 6 minutes, which other subway passengers partially captured on video.<\/p>\n<p>Penny&rsquo;s lawyers said he was protecting himself and other subway passengers from a volatile, mentally ill man who was making alarming remarks and gestures.
