(Photo by Steven Hirsch-Pool\/Getty Images)<\/figcaption><\/figure>\n<p>The contentious gag order was imposed ahead of the criminal trial in New York earlier this year before Trump&rsquo;s May conviction on 34 felony counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/more-than-half-of-trumps-fake-electors-in-georgia-accept-immunity-deals-after-being-designated-criminal-targets-report\/\" title=\"Over 50% of Trump&#039;s &#039;fake electors&#039; in Georgia agree to immunity deals after being labeled &#039;criminal targets&#039;, per report.\">falsifying business records stemming<\/a> from hush money payments made to porn star Stormy Daniels during his 2016 presidential campaign.<\/p>\n<p>Judge Juan Merchan, who presided over the trial, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3058444\/merchan-partially-lifts-trumps-gag-order\/\" target=\"_blank\" rel=\"noopener\" title=\"\">partially lifted<\/a> portions of the gag order earlier this year but maintained provisions aimed at protecting court personnel and jurors.<\/p>\n<p>Trump, however, has continued to challenge the remaining restrictions, arguing they infringe on his <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/first-amendment\/\" target=\"_blank\" rel=\"noopener\" title=\"\">First Amendment<\/a> rights.<\/p>\n<p>The Supreme Court&rsquo;s decision follows <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3111103\/supreme-court-rejects-missouris-effort-block-trumps-new-york-sentencing\/\" target=\"_blank\" rel=\"noopener\" title=\"\">an earlier attempt<\/a> by Missouri Attorney General Andrew Bailey (R-MO) to challenge the gag order on behalf of the state&rsquo;s voters.<\/p>\n<p>Trump&rsquo;s legal team&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3248932\/trump-cites-hunter-pardon-grounds-dismiss-new-york-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked Merchan to dismiss the conviction last week<\/a>, citing the words President Joe Biden recently used when issuing a sweeping pardon for his own son, Hunter Biden. The president said his son had been &ldquo;selectively, and unfairly, prosecuted&rdquo; and that &ldquo;raw politics has infected this process,&rdquo; and Trump&rsquo;s lawyers argued his remarks are similarly applicable to the criminal case in New York.<\/p>\n<p>Merchan has <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3238866\/judge-indefinitely-postpones-trump-new-york-sentencing\/\" target=\"_blank\" rel=\"noopener\" title=\"\">delayed<\/a> Trump&rsquo;s sentencing, previously scheduled for Nov. 26, while he considers arguments from both sides on whether the president-elect is immune from criminal prosecution. <\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>If the case is not dismissed, it remains in question whether the conviction will stand as Trump reenters the Oval Office. Both of Trump&rsquo;s federal criminal cases have been dismissed, which he points to in legal documents seeking to overturn the New York conviction.
