Those lies have destroyed Ray&rsquo;s and [his wife] Robyn [Epps&rsquo;s] lives,&rdquo; he alleged. .<\/p>\n<p>Epps further stated that he and his wife received death threats and eventually moved to Utah for their safety.<\/p>\n<p> <script type=\"text\/javascript\"> \t\t\tif ( getCookie( \"ff_subbed\" ) ) { \t\t\t\tdocument.getElementById(\"stnvideo\").remove() \t\t\t} \t\t<\/script> <\/p>\n<p>On Wednesday, Judge Jennifer L. Hall of the U.S. District Court of Delaware <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.83032\/gov.uscourts.ded.83032.28.0.pdf\" target=\"_blank\" rel=\"noopener\">granted<\/a> Fox&rsquo;s motion to dismiss the Epps&rsquo;s suit citing a &ldquo;failure to state a claim&rdquo; as the reason.<\/p>\n<p>&ldquo;Failure to state a claim is a defense asserting that even if all the factual allegations in a complaint are true, they are insufficient to establish a cause of action and the case should therefore be dismissed,&rdquo; Cornell Law School&rsquo;s Legal Information Institute <a href=\"https:\/\/www.law.cornell.edu\/wex\/failure_to_state_a_claim\" target=\"_blank\" rel=\"noopener\">explained<\/a> on its website.<\/p>\n<p>Fox News Media said in a <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/ray-epps-jan-6-defendant-defamation-lawsuit-fox-news-dismissed-rcna182094\" target=\"_blank\" rel=\"noopener\">statement<\/a> in response to Hall&rsquo;s ruling, &ldquo;Following the dismissals of the <a href=\"https:\/\/www.westernjournal.com\/bidens-ex-censorship-czar-announces-lawsuit-plan-fox-news-instantly-backfires-hilarious-results\/\" target=\"_blank\" rel=\"noopener\">Jankowicz<\/a>, <a href=\"https:\/\/www.westernjournal.com\/hunter-biden-whistleblower-tony-bobulinski-suing-liberal-fox-news-host-lies-consequences\/\" target=\"_blank\" rel=\"noopener\">Bobulinski<\/a>, and now Epps cases, FOX News is pleased with these back-to-back decisions from federal courts preserving the press freedoms of the First Amendment.&rdquo;<\/p>\n<p>George Washington Law School professor Jonathan Turley elaborated on why he believes the judge made the ruling she did.<\/p>\n<p>&ldquo;Epps and his wife have clearly been through a nightmare of threats and innuendo. However, this public controversy was discussed by various networks and the Jan. 6th&nbsp; Committee. It was also a matter of legitimate public debate and commentary, with people on both sides expressing their views on the evidence and underlying allegations,&rdquo; he <a href=\"https:\/\/jonathanturley.org\/2024\/11\/29\/epps-loses-defamation-case-against-fox-news\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in a post on his website.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Just months after a judge dismissed Nina Jankowicz&rsquo;s much-hyped defamation lawsuit against Fox, a federal district court judge in Delaware, Judge Jennifer L. The chilling effect on free speech can be immense,&rdquo; Turley added.<\/p>\n<p>He pointed to the U.S. Supreme Court&rsquo;s ruling in 1964 case <a href=\"https:\/\/www.law.cornell.edu\/wex\/new_york_times_v_sullivan_(1964)#:~:text=Primary%20tabs-,New%20York%20Times%20v.,officials%20to%20sue%20for%20defamation.\" target=\"_blank\" rel=\"noopener\">New York Times v. Sullivan<\/a>, which has since been applied to both public officials and public figures &ldquo;requiring a showing of &lsquo;actual malice&rsquo; where media had actual knowledge of the falsity of a statement or showed reckless disregard whether it was true or false,&rdquo; he wrote.<\/p>\n<p>Many people questioned whether Epps was an FBI informant or was otherwise working for the federal government, based on his conduct the day before and the day of the <a href=\"https:\/\/www.westernjournal.com\/capitol-incursion-defendant-who-sat-at-pelosis-desk-rejects-federal-plea-deal\/\" target=\"_blank\" rel=\"noopener\">Jan. 6 Capitol incursion<\/a>.<\/p>\n<p>Epps and the FBI denied there was any working relationship, <a href=\"https:\/\/www.cbsnews.com\/news\/jan-6-committee-staffer-zero-evidence-that-ray-epps-was-a-federal-agent-60-minutes-2023-04-23\/\" target=\"_blank\" rel=\"noopener\">CBS News<\/a> reported in April 2023.<\/p>\n<p>In January 2022, during a Senate Judiciary Committee hearing, Texas GOP Sen. Ted Cruz <a href=\"https:\/\/www.westernjournal.com\/watch-ted-cruz-backs-fbi-corner-relentless-line-questions-jan-6th\/\" target=\"_blank\" rel=\"noopener\">pressed<\/a>&nbsp;then-FBI Assistant Executive Director Jill Sanborn on whether Epps had been working with the bureau during the Capitol incursion.<\/p>\n<p>Cruz recounted that&nbsp;Epps&nbsp;was captured on video among a crowd in Washington, D.C., the night of Jan. 5, 2021, yelling, &ldquo;Tomorrow, we need to get into the Capitol!
