Kato Crews<\/a>, of the U.S. District Court for the District of Colorado, ruled that San Jose Spartans volleyball co-captain Brooke Slusser and other plaintiffs sought an emergency injunction in the case too late for the tournament, which tips off Wednesday.<\/p>\n<p>Crews also ruled that schools that had forfeited matches against San Jose State rather than play against the male player would have their forfeits on their records as losses.<\/p>\n<p> <script type=\"text\/javascript\"> \t\t\tif ( getCookie( \"ff_subbed\" ) ) { \t\t\t\tdocument.getElementById(\"stnvideo\").remove() \t\t\t} \t\t<\/script> <\/p>\n<p>Those losses helped San Jose State win a No. 2 seed in the Mountain West Conference championship tournament, <a href=\"https:\/\/www.foxnews.com\/sports\/judges-ruling-allow-sjsu-trans-womens-volleyball-player-complete-tournament-receives-backlash\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> reported.<\/p>\n<p>According to the Mercury News, the plaintiffs had wanted the male player &mdash; identified as &ldquo;Blaire Fleming,&rdquo; born <a href=\"https:\/\/www.westernjournal.com\/media-piles-third-team-forfeits-game-undefeated-womens-college-team-trans-man-player\/\" target=\"_blank\" rel=\"noopener\">Brayden Fleming<\/a> to be banned from the tournament.<\/p>\n<p>They also wanted the forfeit losses stricken from the record and the tournament standings recalibrated.<\/p>\n<p>&ldquo;The movants have failed to meet their burden to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ny-judge-orders-gop-candidate-be-certified-winner-of-house-race\/\" title=\"NY Judge Orders GOP Candidate Be Certified Winner Of House Race\">show irreparable harm<\/a>, a likelihood of success on the merits, or that the balance of harms or equities is in their favor,&rdquo; Crews wrote, according to Fox.<\/p>\n<p>Women who play against Fleming might have a different perspective of &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nv-supreme-court-orders-counting-mail-ballots-without-postmark\/\" title=\"NV Supreme Court Orders Counting Mail Ballots Without Postmark\">irreparable harm&#038;rdquo<\/a>; from the one Crews does, sitting in his judicial chambers.<\/p>\n<p>Female volleyball players taking on the Spartans have <a href=\"https:\/\/www.westernjournal.com\/watch-transgender-ncaa-volleyball-player-sends-opponent-floor-vicious-shot-head\/\" target=\"_blank\" rel=\"noopener\">taken serious shots<\/a> from &ldquo;kill spikes&rdquo; Fleming has slammed over the net.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">It&rsquo;s one thing to hear about the male advantage in volleyball: higher jumps, harder spikes, faster serves.<\/p>\n<p>But it&rsquo;s another thing to see it. They&hellip;<\/p>\n<p>&mdash; Just Dave (@drobjr813) <a href=\"https:\/\/twitter.com\/drobjr813\/status\/1861156962656002342?\">November 25, 2024<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Monday&rsquo;s court decision is just the latest in an <a href=\"https:\/\/amzn.to\/3YuVZYV\">increasingly complicated story surrounding<\/a> the San Jose State volleyball team.<\/p>\n<p>In October, as the sports website <a href=\"https:\/\/www.outkick.com\/sports\/sjsu-investigation-allegation-transgender-blaire-fleming-brooke-slusser\" target=\"_blank\" rel=\"noopener\">Outkick<\/a> reported, the team&rsquo;s associate coach, Melissa Batie-Smoose, filed a Title IX complaint against the school, alleging that Fleming &mdash; the transgender player &mdash; had conspired with a Colorado State women&rsquo;s volleyball player to not only fix a match between the two teams, but to have have Slusser targeted for injury during the competition.<\/p>\n<p>According to Outkick, the conspiracy occurred after Slusser joined a lawsuit by women against the NCAA for letting men play in women&rsquo;s sports.<\/p>\n<p>In interview with <a href=\"https:\/\/www.outkick.com\/sports\/sjsu-volleyball-brooke-slusser-blaire-fleming-exclusive-interview\" target=\"_blank\" rel=\"noopener\">Outkick<\/a> published Sept. 30, Slusser said she was initially unaware that Fleming was actually a man.<\/p>\n<p>Slusser transferred to San Jose State in fall of 2023, according to Outkick, and d a residence with four teammates, including Fleming.<\/p>\n<p>She said she played the 2023 season with Fleming, including sharing a residence and rooming with him on road trips, without being aware of his actual sex.<\/p>\n<p>&ldquo;At no point during her recruitment, nor during the 2023 season, was Slusser informed that a male athlete was on the team,&rdquo; Outkick reported.<\/p>\n<p>Slusser told the outlet the news was difficult to process.<\/p>\n<p>&ldquo;It was a really hard pill to swallow, because I couldn&rsquo;t comprehend the fact that there was a man on the team, and it was almost as if I was in denial for a really long time that this was happening,&rdquo; Slusser told Outkick. &ldquo;So it was just really hard for me to wrap my head around.&rdquo;<\/p>\n<p>Batie-Smoose has been suspended indefinitely after filing a Title IX complaint.<\/p>\n<p>On Saturday, Batie-Smoose told <a href=\"https:\/\/www.yahoo.com\/news\/suspended-sjsu-womens-volleyball-coach-140041731.html?fr=sycsrp_catchall\" target=\"_blank\" rel=\"noopener\">Fox News Harris Faulkner<\/a> that she had no regrets about filing the complaint, and said &ldquo;I just couldn&rsquo;t take any more.&rdquo;<\/p>\n<p>Despite the controversy even within its own ranks, San Jose State issued a statement Monday expressing appreciation to Crews for his ruling.<\/p>\n<p>&ldquo;We are gratified that the Court rejected an eleventh-hour attempt to change those rules,&rdquo; the statement said, according to Fox. &ldquo;Our team looks forward to competing in the Mountain West volleyball tournament this week.&rdquo;<\/p>\n<p>In an interview published Friday by <a href=\"https:\/\/www.ktvu.com\/news\/why-san-jose-state-volleyball-player-outted-her-transgender-teammate\" target=\"_blank\" rel=\"noopener\">KTVU-TV<\/a> in Oakland, Slusser said her concerns about Fleming&rsquo;s presence on the volleyball court was a question of <a href=\"https:\/\/www.westernjournal.com\/girl-paralyzed-volleyball-match-trans-player-goes-woke-olympics-endangering-women\/\" target=\"_blank\" rel=\"noopener\">safety and fairness<\/a> &mdash; even if Fleming is on her team.<\/p>\n<p>&ldquo;I just don&rsquo;t think it&rsquo;s right in women&rsquo;s sports,&rdquo; she said, according to the station.<\/p>\n<p>&ldquo;It has nothing to do with the way someone wants to live their life day to day, that&rsquo;s not an issue.
