The decision required Smith to redo his indictment and pushed a potential trial until after the election.<\/p>\n<p>And in Florida, Smith indicted Trump for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-responds-to-claims-he-disclosed-sensitive-nuclear-sub-information\/\" title=\"Trump denies disclosing sensitive nuclear sub information.\">allegedly retaining classified documents<\/a> containing national defense information, as well as obstruction and making false statements.<\/p>\n<p>But Judge Aileen Cannon<a href=\"https:\/\/www.westernjournal.com\/trump-handed-massive-win-right-assassination-attempt-classified-docs-case-gets-hit-hard\/\" target=\"_blank\" rel=\"noopener\"> ruled<\/a> in July that the DOJ&rsquo;s appointment of Smith as special counsel was unconstitutional, concluding the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-report-jack-smith-and-his-cases-against-trump-are-headed-for-the-exit\/\" title=\"Breaking Report: Jack Smith and His Cases Against Trump Are Headed for the Exit\">move needed congressional approval<\/a>. The DOJ has appealed the case to the 11th U.S. Circuit Court of Appeals.<\/p>\n<p>Presumably, Smith&rsquo;s office will also be filing a motion to dismiss the documents case.<\/p>\n<p><a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/jack-smith-files-drop-jan-6-charges-donald-trump-rcna181667\" target=\"_blank\" rel=\"noopener\">NBC News<\/a> reported that Smith and his team plan to resign before Trump takes office, according to a source.<\/p>\n<p>That leaves <a href=\"https:\/\/www.westernjournal.com\/new-york-times-op-ed-end-criminal-cases-trump-people-spoken\/\" target=\"_blank\" rel=\"noopener\">two state criminal cases<\/a> still outstanding against the president-elect.<\/p>\n<p>On Friday New York Judge Juan Merchan&nbsp;<a href=\"https:\/\/www.westernjournal.com\/judge-merchans-new-ruling-hush-money-case-called-massive-trump-win\/\" target=\"_blank\" rel=\"noopener\">removed&nbsp;<\/a>the sentencing hearing from the court calendar in Trump&rsquo;s business records case by Manhattan District Attorney Alvin Bragg and is allowing the president-elect&rsquo;s attorneys to file a motion to dismiss it.<\/p>\n<p>Finally, Fulton County, Georgia, District Attorney Fani Willis&rsquo; 2020 election interference case against Trump is currently at the state Court of Appeals.
