This appeal was backed by a health advocacy organization led by Robert F.\u200b Kennedy Jr., \u200ca prominent figure in the\u2062 push for medical freedom and vaccine\u2062 safety advocacy. The appeal was rejected by Justice Elena Kagan without consultation with the other justices, leading to criticism from \u2064the plaintiffs&#8217; \u200dlawyers.<\/p>\n<p>The case originated when two Washington-based physicians, \u2064Thomas Siler and Richard Eggleston, faced disciplinary \u2063actions for\u200d publishing opinions that deviated from the official stance on COVID-19 and its treatments. Kennedy Jr<\/a>.<\/p>\n<div class=\"article-paywall\">\n<p>Kennedy, President-elect Donald Trump&rsquo;s nominee to head the Department of Health and Human Services, was listed on court documents as one of the trial lawyers for the <a href=\"https:\/\/childrenshealthdefense.org\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Children&rsquo;s Health Defense<\/a> group, which he spearheaded nearly a decade ago.<\/p>\n<p>Todd Richardson, another one of the lawyers for the plaintiffs, criticized Justice Elena Kagan after she blocked the appeal.<\/p>\n<p>&ldquo;Unfortunately, Justice Kagan did not choose to confer w\/ the other justices and denied our application for an injunction,&rdquo; he said in a <a href=\"https:\/\/x.com\/MyAttorneyTodd\/status\/1859673587067892005\" target=\"_blank\" rel=\"noopener\" title=\"\">post<\/a> to X on Thursday.<\/p>\n<p>Richardson said the plaintiffs, two doctors from Washington, had faced prosecution after &ldquo;writing opinion articles in which they did not endorse the official covid narrative and offered their opinions about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-strikes-down-floridas-ban-on-transgender-medical-services-for-children\/\" title=\"Judge Overturns Florida&#039;s Prohibition on Transgender Medical Treatments for Minors\">effective medical treatment<\/a> and prevention.&rdquo;<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">1\/  I am proud to be able to work with RFK, Jr. and Rick Jaffe on this case in an effort to protect the 1A rights of doctors. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-courts-future-hangs-in-the-balance-as-democrats-mobilize-for-2024-washington-examiner\/\" title=\"Supreme Court&#039;s future hangs in the balance as Democrats mobilize for 2024 - Washington Examiner\">nonprofit group&#038;rsquo<\/a>;s stated mission is to <a href=\"https:\/\/amzn.to\/3YuVZYV\">end childhood health epidemics<\/a> by &ldquo;eliminating toxic exposure.&rdquo; The group has a long history of advocating medical freedom, arguing that physicians&rsquo; ability to question vaccine safety is a protected constitutional right.<\/p>\n<p>Children&rsquo;s Health Defense&rsquo;s battle with the courts began in August 2022, when a Washington state agency charged two physicians with unprofessional conduct for spreading what they described as &ldquo;COVID misinformation&rdquo; in newspaper opinion columns and other online platforms.<\/p>\n<p>The Washington Medical Commission&rsquo;s investigation came after Thomas Siler and Richard Eggleston questioned the safety of the COVID-19 vaccines and suggested COVID-19 tests were inaccurate. They also praised alternative treatments for the virus such as ivermectin and hydroxychloroquine.<\/p>\n<p>The Children&rsquo;s Health Defense group helped the doctors take their case to court in March in an effort to keep the commission from enforcing its unprofessional conduct regulations. The physicians argued that their views constituted rights to free speech protected under the First Amendment.<\/p>\n<p>After Kagan rejected their appeal on Wednesday, the plaintiffs&rsquo; lawyers held out hope that the Supreme Court would still eventually take up their plea and protect the physicians&rsquo; public positions on COVID-19 and vaccines as the case remains pending in a federal appeals court.<\/p>\n<p>Critics have labeled Kennedy and his Children&rsquo;s Health Defense organization as &ldquo;anti-vaccine&rdquo; for years, with his stances on COVID-19 and other health matters coming under a microscope as he heads for a likely rough Senate confirmation vote to become the country&rsquo;s next HHS secretary. However, Trump&rsquo;s Cabinet nominee has argued that he is merely in favor of making sure vaccines are safe.
