She&rsquo;s the one who failed the people and protected this fraudster.<a href=\"https:\/\/t.co\/VmJTBz7rQ7\">https:\/\/t.co\/VmJTBz7rQ7<\/a> <a href=\"https:\/\/t.co\/9dp6cWsqUu\">pic.twitter.com\/9dp6cWsqUu<\/a><\/p>\n<p>&mdash; Jeanne Ives (@JeanneIves) <a href=\"https:\/\/twitter.com\/JeanneIves\/status\/1859630207747113087?\">November 21, 2024<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>However, <a href=\"https:\/\/www.westernjournal.com\/kim-foxx-faces-utter-ruin-judge-orders-investigation-person-office-involved-smollett-case\/\" target=\"_blank\" rel=\"noopener\">Smollett<\/a> appealed, and on Thursday emerged the winner after the Illinois Supreme Court tossed out the conviction, according to <a href=\"https:\/\/wgntv.com\/news\/chicago-news\/illinois-supreme-court-reverses-actor-jussie-smolletts-conviction\/\" target=\"_blank\" rel=\"noopener\">WGN-TV<\/a>.<\/p>\n<p>The ruling focused on the deal Foxx cut with Smollett.<\/p>\n<p>&ldquo;Today we resolve a question about the State&rsquo;s responsibility to honor the agreements it makes with defendants,&rdquo; the court ruling said.<\/p>\n<p>&ldquo;Specifically, we address whether a dismissal of a case by nolle prosequi allows the State to bring a second prosecution when the dismissal was entered as part of an agreement with the defendant and the defendant has performed his part of the bargain,&rdquo; the ruling said.<\/p>\n<p>&ldquo;We hold that a second prosecution under these circumstances is a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/you-are-bloodthirsty-for-ratings-trump-attorney-tears-into-media-rips-off-his-mic\/\" title=\"\u2018You Are Bloodthirsty For Ratings\u2019: Trump Attorney Tears Into Media, Rips Off His Mic\">due process violation<\/a>, and we therefore reverse defendant&rsquo;s conviction,&rdquo; the ruling said.<\/p>\n<p>The court ruling said while &ldquo;many people&rdquo; were unhappy that Smollett essentially went unpunished for all the fuss and furor he caused, it &ldquo;would be more unjust than the resolution of any one criminal case would be a holding from this court that the State was not bound to honor agreements upon which people detrimentally relied.&rdquo;<\/p>\n<p>Webb issued a statement <a href=\"https:\/\/www.westernjournal.com\/subway-shop-central-jussie-smolletts-fabricated-hate-crime-gets-bad-news-report\/\" target=\"_blank\" rel=\"noopener\">critical<\/a> of the ruling, according to WGN.<\/p>\n<p>&ldquo;We are disappointed in the Illinois Supreme Court&rsquo;s decision today to overturn Jussie Smollett&rsquo;s convictions and sentence, including the award of over $120,000 in restitution to the City of Chicago for its overtime expenses in investigating Mr. Smollett&rsquo;s fake hate crime,&rdquo; he said.<\/p>\n<p>&ldquo;We respectfully disagree with the Court&rsquo;s factual and legal reasoning which upends long-standing Illinois precedent,&rdquo; he wrote.<\/p>\n<p>&ldquo;Indeed, the special prosecutor&rsquo;s brief to the Illinois Supreme Court was replete with Illinois case law that would not preclude a second, new prosecution following a dismissal without prejudice via nolle prosequi.
