Recently, the Court of Common\u2062 Pleas in Philadelphia denied a \u2063lawsuit from Casey&#8217;s \u2062campaign that sought to count over 2,<a href=\"https:\/\/amzn.to\/3YuVZYV\">000\u2062 provisional ballots deemed invalid due<\/a>\u2064 to missing \u200couter envelope signatures. The\u2064 Democratic \u2064campaign argued\u2062 that mistakes by poll workers should not penalize voters and claimed\u2064 that rejecting these ballots violated their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-our-vote-matters-is-suing-facebook-dominion-mark-zuckerberg-certain-state-officials-others-for-infringing-upon-right-to-vote-assemble-and-speak-freely-you-can-jo\/\" title=\"Group \u201cOur Vote Matters\u201d Is Suing Facebook, Dominion, Mark Zuckerberg, Certain State Officials, Others for Infringing Upon Right to Vote, Assemble and Speak Freely \u2013 You Can Join Too\">due process rights<\/a>.<\/p>\n<p>In contrast, a court in Chester County rejected a request from McCormick\u2019s \u200ccampaign to discard 58 provisional ballots that lacked necessary\u200b signatures from election officials. The ruling upheld a guideline from the \u2063Pennsylvania Department of State, which allowed such ballots \u2063to \u200bbe counted. The ballots were either missing an outer envelope signature or were not enclosed in a secrecy envelope.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/3236505\/bucks-county-voters-vow-kick-commisioners-out\/\" target=\"_blank\" rel=\"noopener\" title=\"IMPASSIONED VOTERS VOW TO KICK BUCKS COUNTY DEMOCRATIC COMMISSIONERS OUT OF OFFICE\"><strong>IMPASSIONED VOTERS VOW TO KICK BUCKS COUNTY DEMOCRATIC COMMISSIONERS OUT OF OFFICE<\/strong><\/a><\/p>\n<p>Democrats argued the ballots should have been counted and were not done so because of mistakes made by poll workers and that thereby violated voters&rsquo; due process rights and the Help America Vote Act.&nbsp;<\/p>\n<p>Specifically, the&nbsp;lawsuit claimed there was proof that some poll workers did not provide voters with inner secrecy envelopes&nbsp;or failed to instruct voters on how to use them and what was required to make sure their ballots were properly counted.&nbsp;The&nbsp;lawsuit also argued that because voters who wished to cast a provisional ballot must first sign an affidavit&nbsp;on the outermost envelope, they should not be penalized for failing to provide a second signature on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bob-casey-files-more-lawsuits-in-search-of-additional-votes\/\" title=\"Bob Casey Files More Lawsuits In Search Of Additional Votes \u00a0\">provisional ballot envelope<\/a>.&nbsp;<\/p>\n<p>&ldquo;Denying qualified voters the right to have their provisional ballot counted, even when election officials have determined that the voter is eligible, and the voter has signed a &lsquo;written affirmation&rsquo; confirming that they are properly registered, id., would violate these federal protections of the right to vote; thus this Court should reverse the decision of the Philadelphia County Board of Elections,&rdquo; the Democratic petition read.&nbsp;<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><figcaption class=\"wp-element-caption\">This combination of photos taken in Pennsylvania shows Sen. (AP Photo)<\/figcaption><\/figure>\n<\/div>\n<p>The Philadelphia County court did not provide any additional detail on the denial.&nbsp;<\/p>\n<p>In Chester County, a court denied a petition from the Republican National Committee and McCormick&rsquo;s campaign to get 58 provisional ballots thrown out that were missing the signature of the judge of elections, minority inspector, or, in some cases, both. The lawsuit claimed guidance issued on Nov. 7 by the Pennsylvania Department of State that provisional ballots should be counted despite missing signatures by election officials violated state law.<\/p>\n<p>Republicans asked the court to force Chester County to stop counting those ballots but were denied.&nbsp;<\/p>\n<p>In all, there are 18 active lawsuits making their way through Pennsylvania&rsquo;s&nbsp;court system, asking judges to count or reject ballots.&nbsp;<\/p>\n<p>On Monday, the Supreme Court of Pennsylvania reiterated a previous ruling that ballots with missing or inaccurate dates written on them should not be counted. The court order specified that Bucks, Montgomery, and Philadelphia counties must not count those ballots.&nbsp;<\/p>\n<p>The order was seen as a victory for McCormick.&nbsp;<\/p>\n<p>As both sides continue their fight for votes in court, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuits-pile-up-as-senate-recount-begins-in-all-pennsylvania-counties-washington-examiner\/\" title=\"Lawsuits pile up as Senate recount begins in all Pennsylvania counties - Washington Examiner\">automatic statewide recount<\/a> in the contentious Senate race has been underway.&nbsp;<\/p>\n<p>The&nbsp;<em>Associated Press&nbsp;<\/em>called the race for McCormick on Nov. 7, saying not enough ballots remained to be counted in areas Casey was winning for him to take the lead.
