(AP Photo\/John Minchillo, File)<\/figcaption><\/figure>\n<p>The <a href=\"https:\/\/s3.documentcloud.org\/documents\/25275418\/carnell.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">request<\/a> is one that is likely to be replicated in outstanding Jan. 6 cases as Trump prepares to reenter the White House.<\/p>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Joe Biden<\/a>&lsquo;s Justice Department has already been rebuked for its handling of Capitol riot cases involving the use of <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1512\" target=\"_blank\" rel=\"noopener\" title=\"\">Section 1512(c)(2)<\/a>, an obstruction charge that the Supreme Court found was used <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3152409\/doj-drops-jan-6-obstruction-charges-more-than-half-pending-cases\/\" target=\"_blank\" rel=\"noopener\" title=\"\">overly broadly in its application to dozens of rioters<\/a>, in addition to Howell last week <a href=\"https:\/\/www.politico.com\/news\/2024\/11\/02\/judge-department-justice-bid-revive-jan-6-charges-00186926\" target=\"_blank\" rel=\"noopener\" title=\"\">finding<\/a> that the application of the charge cannot stand against any single defendant from the riot.<\/p>\n<p>Trump has said he intends to pardon at least some individuals from the Jan. 6 riot, saying at one point he was &ldquo;inclined to pardon many of them.&rdquo;<\/p>\n<p>&ldquo;I can&rsquo;t say for every single one, because a couple of them, probably they got out of control,&rdquo; Trump said on Truth Social in March.<\/p>\n<p>The Nov. 8 hearing for Carnell is slated to discuss the government&rsquo;s intent to seek an obstruction charge against Carnell and establish a sentencing date for misdemeanor convictions. However, recent developments, including Trump&rsquo;s victory and a separate favorable court decision, have altered the defense&rsquo;s strategy. <\/p>\n<p>On Nov. 1, Howell ruled in a similar case, <em>United States v.
