The \u200dclosure resulted in a multibillion-dollar settlement that disproportionately affected ratepayers, who were left to shoulder\u200b 70% of the financial burden. Critics allege\u200c that Harris\u200d failed to prosecute \u200dthe company, Southern California \u2062Edison (SCE), \u2063after it was revealed that SCE had been financially contributing to the campaigns of various \u2063state Democrats, coinciding with \u2064her \u2062decision not to pursue legal action.<\/p>\n<p>While investigating, Harris\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biblical-find-fragment-may-be-named-for-famed-biblical-warrior-gideon\/\" title=\"Biblical Find: Fragment May Be Named For Famed Biblical Warrior Gideon\">team found evidence<\/a> of secret meetings\u200d between SCE executives and the California Public Utilities Commission (CPUC) president, \u200cwhere \u200ca \u2062settlement framework was developed that aligned closely with\u200c the final deal.\u200c Despite the\u2064 investigation&#8217;s potential to implicate influential Democrats, including then-Governor Jerry Brown, the inquiry appeared to stall as \u2063Harris shifted focus to her Senate \u2062campaign in 2016. <\/p>\n<p>SCE also allegedly funneled substantial amounts of money to the California Democratic Party during the investigation period, raising questions about political influence in the case. \u2062Former \u200dcolleagues of Harris and other political figures\u2064 criticized\u2064 her for not pursuing the investigation vigorously, suggesting her political aspirations may\u200d have affected her decisions in this controversial \u200bcase.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>When Vice President Kamala Harris was California&rsquo;s attorney general, her team found evidence of corruption after the closure of a nuclear power plant left customer ratepayers to cover the multibillion-dollar settlement bill. Harris was criticized for failing to prosecute. Now, The Federalist has reviewed financial records revealing that the company operating the plant had been giving hundreds of thousands to state Democrats when Harris decided to look away.<\/p>\n<p>The San Onofre Nuclear Generating Station <a href=\"https:\/\/www.pbssocal.org\/shows\/lost-la\/san-onofre-the-epic-journey-to-close-a-nuclear-plant\" target=\"_blank\" rel=\"noreferrer noopener\">permanently<\/a> shut down in 2013, following a <a href=\"https:\/\/abcnews.go.com\/blogs\/headlines\/2012\/02\/san-onofre-nuclear-plant-closed-after-radiation-leak\/\" target=\"_blank\" rel=\"noreferrer noopener\">radiation<\/a> <a href=\"https:\/\/www.nrc.gov\/docs\/ML1209\/ML12090A153.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">leak<\/a> the previous year. The settlement originally left customers with <a href=\"https:\/\/fox5sandiego.com\/news\/cpuc-judge-approves-san-onofre-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">70 percent<\/a> of the financial burden, or <a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">$3.3 billion<\/a>. And it left 3.6 million pounds of <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/aug\/24\/san-onofre-nuclear-power-plant-radioactive-waste-unsafe\" target=\"_blank\" rel=\"noreferrer noopener\">nuclear waste<\/a> on a popular California beach.&nbsp;<\/p>\n<div>\n<p>As attorney general in California, Harris&rsquo;s team uncovered evidence of a secret meeting between an executive of Southern California Edison (SCE) &mdash; the primary owner of the nuclear power plant &mdash; and the then-president of the California Public Utilities Commission (CPUC) to apparently draft the settlement. But as Harris was running for U.S. Senate in 2016, the investigation seemingly began to <a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">trail off<\/a>.<\/p>\n<p>Democrat then-Gov. Jerry Brown &mdash; who <a href=\"https:\/\/archive.gov.ca.gov\/archive\/gov39\/2016\/12\/28\/news19651\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">appointed<\/a> members to the CPUC and <a href=\"https:\/\/www.latimes.com\/politics\/essential\/la-pol-sac-essential-politics-20160501-htmlstory.html#california-gov-jerry-brown-backs-kamala-harris-for-u-s-senate\" target=\"_blank\" rel=\"noreferrer noopener\">endorsed<\/a> Harris&rsquo; bid for Senate in 2016<strong> <\/strong>&mdash; <a href=\"https:\/\/www.sandiegouniontribune.com\/2017\/12\/14\/gov-brown-met-with-edison-over-san-onofre-costs-weeks-before-warsaw-pact\/\" target=\"_blank\" rel=\"noreferrer noopener\">met<\/a> with an SCE executive in 2013, according to the San Diego Union-Tribune. Later that year, SCE funneled $54,400 to his reelection campaign, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ny-suspends-giulianis-law-license-over-false-and-misleading-statements-about-2020-election-accuses-former-mayor-of-inciting-january-6th-riot\/\" title=\"NY Suspends Giuliani\u2019s Law License Over \u2018False And Misleading Statements\u2019 About 2020 Election, Accuses Former Mayor Of Inciting January 6th Riot\">state records show<\/a>. Evidence later revealed another SCE executive secretly met with the then-CPUC president in Poland in 2013. This SCE executive had been a long-time contributor to the campaign of the CPUC president&rsquo;s wife &mdash; who was then a Democrat state senator &mdash; and <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">donated<\/a> nearly $3,700 to her campaign in 2012 alone.<\/p>\n<\/div>\n<p>In reviewing state financial records, The Federalist also learned that while Harris&rsquo; investigation was underway, SCE <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">funneled<\/a> $380,000 to the California Democratic Party from March 2015 to May 2016. The company and its employees have consistently <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">bankrolled<\/a> state campaigns since at least 2001, including for state senate, state assembly, and governor, records show.<\/p>\n<h2>A Secret Meeting Overseas<\/h2>\n<p>SCE and the CPUC <a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> the settlement &ldquo;was the product of hard-fought negotiations between ratepayer advocates and the power company,&rdquo; according to KPBS. But the outlet noted &ldquo;a different story emerged&rdquo; after Harris&rsquo; investigators searched the home of former CPUC President <a href=\"https:\/\/ballotpedia.org\/Michael_R._Peevey\" target=\"_blank\" rel=\"noreferrer noopener\">Michael Peevey<\/a> in January 2015 when investigating a &ldquo;<a href=\"https:\/\/www.sfgate.com\/news\/article\/Agents-search-Michael-Peevey-s-home-in-PG-E-6047151.php\" target=\"_blank\" rel=\"noreferrer noopener\">judge-shopping<\/a>&rdquo; case.<\/p>\n<p>In the process, they <a href=\"https:\/\/web.archive.org\/web\/20160728210239\/https:\/\/www.sandiegouniontribune.com\/news\/2015\/jul\/06\/two-new-warrants-served-in-cpuc-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> <a href=\"https:\/\/thefederalist.com\/2020\/10\/12\/consumer-watchdogs-say-kamala-harris-looked-the-other-way-while-utilities-set-stage-for-wildfires\/\" target=\"_blank\" rel=\"noreferrer noopener\">evidence<\/a> Peevey privately met with SCE executive Stephen Pickett in Poland in <a href=\"https:\/\/www.utilitydive.com\/news\/sce-admits-to-private-conversations-with-peevey-on-songs-closure\/362628\/\" target=\"_blank\" rel=\"noreferrer noopener\">March 2013<\/a>, where the two devised a &ldquo;framework for a San Onofre settlement that closely resembled the final public deal,&rdquo; as KPBS <a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>.<strong> <\/strong><\/p>\n<div>\n<p>The nonprofit Public Watchdogs published the draft <a href=\"https:\/\/publicwatchdogs.org\/secret-meeting-notes-southern-california-edison-doesnt-want-see\/\" target=\"_blank\" rel=\"noreferrer noopener\">notes<\/a> in 2016, and the groups also published an affidavit reviewed by the California deputy attorney general. <\/p>\n<p>&ldquo;[T]here is probable cause to believe that PICKETT knowingly engaged and conspired to engage in a reportable<em>&nbsp;ex parte<\/em> communication with PEEVEY&nbsp;in POLAND to the overall advantage of SCE&nbsp;in&nbsp;the subsequent settlement process pertaining to the closure of SONGS [the nuclear plant],&rdquo; the affidavit <a href=\"https:\/\/publicwatchdogs.org\/wp-content\/uploads\/2016\/09\/18-page-Affidavit_-KMBT_C28015122814410-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>.<\/p>\n<\/div>\n<p>Harris announced her run for Senate in January 2015. Six months after searching Peevey&rsquo;s house, her investigators served warrants to Edison and the CPUC and asked them &ldquo;to turn over all documents and communications related to the San Onofre settlement,&rdquo; <a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to KPBS. But when the CPUC was, as the outlet noted, &ldquo;slow to turn over records,&rdquo; Harris was <a href=\"https:\/\/thefederalist.com\/2020\/10\/12\/consumer-watchdogs-say-kamala-harris-looked-the-other-way-while-utilities-set-stage-for-wildfires\/\" target=\"_blank\" rel=\"noreferrer noopener\">criticized<\/a> for not challenging the commission&rsquo;s apparent stonewalling.<\/p>\n<p>According to an April 2016 KPBS report, a Harris representative issued a <a href=\"https:\/\/www.kpbs.org\/news\/politics\/2016\/04\/29\/deadline-key-allegation-ag-harriss-san-onofre-prob\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> acknowledging that &ldquo;[n]o government agency, and no public utilities company is above the law,&rdquo; but declined to &ldquo;disclose details&rdquo; about ongoing investigations.<\/p>\n<p>&ldquo;While we cannot disclose details of any ongoing criminal investigations &mdash; this investigation will go where the evidence takes us, and any potential charges would be filed on the facts of the case, and not an election cycle,&rdquo; the statement said, according to the outlet.<\/p>\n<h2><strong>Democrat Interests at Play<\/strong><\/h2>\n<p>Then-Rep. Loretta Sanchez, a Democrat <a href=\"https:\/\/www.sacbee.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">also running<\/a> for the U.S. Senate in 2016, <a href=\"https:\/\/www.youtube.com\/watch?v=TPmV0yCa_vc\" target=\"_blank\" rel=\"noreferrer noopener\">accused<\/a> Harris that year of &ldquo;refusing to prosecute well-documented, illegal goings-on at the Public Utilities Commission.&rdquo; Sanchez said on KPBS at the time that &ldquo;the attorney general has made it clear that she would rather protect the P[ublic] U[tilities] C[ommission] and political cronies than the people of California.&rdquo;<\/p>\n<p>Another source<strong> <\/strong><a href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2016\/04\/05\/california-critics-kamala-harris-san-onofre-probe\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> KPBS earlier that year the scandal would &ldquo;very likely implicate&rdquo; powerful Democrats in the state, and theorized that &ldquo;going up against the Democratic Party structure&rdquo; was &ldquo;distressing to [Harris] when [she was] running for U.S. Senate.&rdquo;<\/p>\n<p>Peevey previously <a href=\"https:\/\/energy.ucdavis.edu\/people\/michael-peevey\/\" target=\"_blank\" rel=\"noreferrer noopener\">worked<\/a> for SCE and has given <a href=\"http:\/\/www.allgov.com\/usa\/ca\/officials\/california_peevey_michael?officialid=291\" target=\"_blank\" rel=\"noreferrer noopener\">thousands<\/a> to Democrat candidates. His wife is former state Sen. Carol Liu, a Democrat. Pickett <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">gave<\/a> nearly $3,700 to Liu&rsquo;s campaign in November 2012, just months before the controversial Poland meeting, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pennsylvania-dem-neglected-to-pay-property-taxes\/\" title=\"Pennsylvania Dem Neglected to Pay Property Taxes\">state records reviewed<\/a> by The Federalist show.<\/p>\n<figure><figcaption>\n<div>\n<p>Contributions from then-SCE executive Stephen Pickett to then-state Sen. Brown, who appointed members to the CPUC, <a href=\"https:\/\/www.sandiegouniontribune.com\/2017\/12\/14\/gov-brown-met-with-edison-over-san-onofre-costs-weeks-before-warsaw-pact\/\" target=\"_blank\" rel=\"noreferrer noopener\">met<\/a> with an SCE executive just weeks before Peevey and Pickett secretly met in Poland in 2013, although &ldquo;[r]epresentatives of the Governor&rsquo;s Office and Edison said there was no connection between&rdquo; this meeting and the &ldquo;new settlement push at the utilities commission,&rdquo; <a href=\"https:\/\/archive.is\/sIyg9#selection-197.1-1402.0\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to The San Diego Union-Tribune. That year, SCE funneled <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">$54,400<\/a> to Brown&rsquo;s <a href=\"https:\/\/ballotpedia.org\/Jerry_Brown_(California)\" target=\"_blank\" rel=\"noreferrer noopener\">reelection<\/a> campaign from September to December.<\/p>\n<figure><figcaption>\n<div>\n<p>Contributions via SCE to then-Gov. Jerry Brown in 2013.<\/p>\n<div>\n<p>         <span>Image Credit<\/span>California Secretary of State       <\/p>\n<\/div>\n<\/div>\n<\/figcaption><\/figure>\n<p>SCE also <a href=\"https:\/\/powersearch.sos.ca.gov\/advanced.php\" target=\"_blank\" rel=\"noreferrer noopener\">shuttled<\/a> more than $380,000 to the California Democratic Party between March 2015 and May 2016, according to state financial records<\/p>\n<p>Michael Aguirre, a former San Diego city attorney who later took legal action against the settlement deal, told the Federalist he thinks the investigation into the San Onofre settlement dropped off because the CPUC was so powerful.&nbsp;<\/p>\n<p>&ldquo;The problem was to have the horsepower to take on the P[ublic] U[tilities] C[ommission],&rdquo; Aguirre said. &ldquo;They had a whole army of people. That was going to be a very tough problem to deal with.&rdquo;<\/p>\n<p>Aguirre told The Federalist he helped consumers <a href=\"https:\/\/www.youtube.com\/watch?v=KASlGyCn9TY\" target=\"_blank\" rel=\"noreferrer noopener\">reduce<\/a> their share of the settlement. In 2018, a CPUC judge greenlit a proposed settlement &ldquo;under which the owners of the failed San Onofre nuclear plant agreed to slice hundreds of millions of dollars from the cost to ratepayers of the 2012 breakdown,&rdquo; CBS News previously <a href=\"https:\/\/www.cbsnews.com\/losangeles\/news\/judge-san-onofre-deal-cuts-customer-bills\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n<p>&ldquo;They literally shouldn&rsquo;t have had to pay for any of this,&rdquo; Aguirre said. He called the backdoor-dealing for the settlement &ldquo;purely illegal.&rdquo;<\/p>\n<p>Aguirre said he considers himself an &ldquo;FDR Democrat,&rdquo; but often sues state-level Democrats.<\/p>\n<p>&ldquo;I find myself suing in California the Democrats because the Democrats are in power,&rdquo; Aguirre said. &ldquo;This is corrupt, you know?
