This decision follows a ruling from the Pennsylvania Supreme\u2062 Court, which aims \u200dto \u200ballow \u200bmore voters to cast provisional ballots\u200d on Election Day. Justice\u2062 Samuel Alito, while\u2064 not dissenting, noted that siding with the Republicans would have affected only two voters and would not have prevented the feared consequences. Justices Clarence Thomas and Neil Gorsuch joined Alito.<\/p>\n<p>&ldquo;We could not prevent the consequences [the Republicans] fear,&rdquo; Alito wrote.<\/p>\n<p>The Republicans are still in the process of appealing the decision at the state level, meaning the case is not entirely over, though it will not be resolved before Election Day.<\/p>\n<p>The Supreme Court&rsquo;s decision could potentially affect, according to Republicans&rsquo; court filings, &ldquo;tens of thousands of votes&rdquo; in a swing state widely viewed as a must-win for presidential candidates and one that could help tip the balance of power in the Senate.<\/p>\n<p>Attorneys for the Republican groups had argued that the Pennsylvania Supreme Court defied the General Assembly when it <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/voting-lawsuits-that-could-still-have-2024-election-consequences-washington-examiner\/\" title=\"Voting lawsuits that could still have 2024 election consequences - Washington Examiner\">ordered election officials<\/a> to accept provisional ballots on Election Day from people who submitted defective mail-in ballots.<\/p>\n<p>Pennsylvania is unique in that its law gives each of the state&rsquo;s 67 counties significant discretion over whether to offer voters who submit problematic mail-in ballots the option to fix their ballots so that their votes will count, a process known as &ldquo;ballot curing.&rdquo;<\/p>\n<p>The RNC and state GOP attorneys argued that the Pennsylvania Supreme Court&rsquo;s decision &ldquo;effectively creates a [statewide] cure process for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pennsylvania-democrats-urge-supreme-court-to-keep-provisional-ballot-rule-in-place-washington-examiner\/\" title=\"Pennsylvania Democrats urge Supreme Court to keep provisional ballot rule in place - Washington Examiner\">mail-ballot errors &#038;mdash<\/a>; a process everyone agrees the General Assembly has deliberately chosen not to create.&rdquo;<\/p>\n<p>In Pennsylvania, more than 1.5 million mail-in ballots have been cast, a portion of which will inevitably have deficiencies. Those can include missing or mismatched signatures, missing or incorrect dates, or, in the case of the lawsuit brought before the Supreme Court, a missing mandatory inner sleeve for the ballot, called a &ldquo;secrecy envelope.&rdquo;<\/p>\n<p>Pennsylvania Democrats opposed Republicans&rsquo; request, arguing that requiring all counties to offer provisional ballots to those who have turned in faulty mail-in ballots aligned with state law. They said that even though curing options are up to individual counties, provisional ballot rights are uniform across the state.<\/p>\n<p>If voters are informed that they submitted a mail-in ballot that will not be counted, they have the right to submit a provisional ballot since the mail-in vote was never actually cast, the Pennsylvania Democrats said. Republicans noted that not every county gives voters advanced notice that their mail-in ballots will not be counted.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>The Democrats joined two plaintiffs in the case, Faith Genser and Frank Matis.
