Michigan officials, including Secretary of State Jocelyn Benson, have emphasized the rarity of such\u200b occurrences\u200b while arguing for the \u200csecurity of elections; however, the situation has prompted calls for stricter voting\u200c legislation. Republicans have\u2064 proposed the\u200b Safeguarding American Voter Eligibility (SAVE) Act, which requires proof of citizenship to register to vote. and Michigan election officials will still count the vote.<\/p>\n<p>The 19-year-old &mdash; who is legally present in the country studying at the University of Michigan but not a citizen &mdash; registered to vote on Sunday, having &ldquo;signed a document identifying himself as a U.S. citizen,&rdquo; according to <a href=\"https:\/\/www.detroitnews.com\/story\/news\/politics\/elections\/2024\/10\/30\/chinese-university-of-michigan-college-student-voted-presidential-election-michigan-china-benson\/75936701007\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Detroit News<\/a>. The student then cast a ballot which &ldquo;was entered into the tabulator.&rdquo; Ann Arbor City Administrator Milton Dohoney Jr. said in an email to council members that &ldquo;based upon the scenario that we&rsquo;re hearing this morning, the student was fully aware of what he was doing, and that it was not legal,&rdquo; according to The Detroit News.<\/p>\n<div class=\"fdrlst__b89e9-810efa7fda170d2201f78a969cddb81e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-810efa7fda170d2201f78a969cddb81e\"><\/div>\n<p>The student has been charged with &ldquo;Unauthorized Elector Attempting To Vote&rdquo; and &ldquo;Perjury &mdash; Making a False Affidavit for Purpose of Securing Voter Registration,&rdquo; according to Michigan Secretary of State Jocelyn Benson.<\/p>\n<p>While noncitizen voting is illegal, the student&rsquo;s vote will ultimately still count. That&rsquo;s because <a href=\"https:\/\/www.legislature.mi.gov\/Laws\/MCL?objectName=MCL-ARTICLE-II-4\" target=\"_blank\" rel=\"noreferrer noopener\">ballots are secret<\/a>, meaning names aren&rsquo;t attached to the ballot itself. Once a vote is cast and run through a tabulator, it is impossible to identify <em>who<\/em> cast the ballot.<\/p>\n<p>Yet Benson, in a <a href=\"https:\/\/www.michigan.gov\/sos\/resources\/news\/2024\/10\/30\/joint-statement-of-secretary-benson-and-washtenaw-county-prosecutor-savit-on-charges-filed\" target=\"_blank\" rel=\"noreferrer noopener\">joint statement<\/a> with Washtenaw County Prosecutor Eli Savit, still claimed that Michigan&rsquo;s elections are &ldquo;secure&rdquo; and that &ldquo;noncitizen voting is an extremely isolated and rare event.&rdquo;<\/p>\n<p>But just because something is &ldquo;rare&rdquo; doesn&rsquo;t mean it&rsquo;s not happening &mdash; or that steps shouldn&rsquo;t be taken to prevent such an occurrence. Yet Democrats have fought Republicans on legislation meant to prevent a scenario like this. The Republican-led House passed the Safeguarding American Voter Eligibility (SAVE) Act, which would amend the 1993 National Voter Registration Act to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/if-voter-id-laws-are-so-racist-why-do-70-of-black-people-support-them\/\" title=\"If Voter ID Laws Are So Racist, Why Do 70% Of Black People Support Them?\">require prospective voters<\/a> to provide documentary proof of citizenship in order to register to vote. Such legislation would have prevented the 19-year-old Chinese national from registering (and voting) on Sunday.<\/p>\n<div class=\"fdrlst__b89e9-5b5dfa21975662bb242db48d6f6cf809 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5b5dfa21975662bb242db48d6f6cf809\"><\/div>\n<p>It also would&rsquo;ve prevented a <a href=\"https:\/\/thefederalist.com\/2024\/09\/25\/iowa-ag-charges-noncitizen-for-voting-the-thing-democrats-insist-never-happens\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent incident<\/a> that unfolded in Iowa in which Jorge Oscar Sanchez-Vasquez was charged for &ldquo;registering to vote and illegally voting on the same day, July 16, 2024, in a special election for the Marshalltown City Council,&rdquo; according to the state&rsquo;s attorney general. <\/p>\n<p>But Democrats &mdash; who keep insisting that a system that lets noncitizens slip onto voter rolls and illegally vote is &ldquo;secure&rdquo; &mdash; <a href=\"https:\/\/x.com\/RepDonaldsPress\/status\/1811062368480206849\" target=\"_blank\" rel=\"noreferrer noopener\">vowed<\/a> to block the legislation. Republicans <a href=\"https:\/\/thefederalist.com\/2024\/09\/19\/government-funding-bill-election-integrity-implode-in-u-s-house\/\" target=\"_blank\" rel=\"noreferrer noopener\">tried to tie<\/a> the SAVE Act to a continuing resolution to keep the government funded, but a majority of House Democrats, alongside 14 <a href=\"https:\/\/www.newsweek.com\/full-list-republicans-broke-trump-government-funding-bill-1956017\" target=\"_blank\" rel=\"noreferrer noopener\">Republicans<\/a>, <a href=\"https:\/\/thefederalist.com\/2024\/09\/27\/failure-to-pass-save-act-proves-republicans-arent-serious-about-winning\/\" target=\"_blank\" rel=\"noreferrer noopener\">voted against<\/a> the stopgap bill.<\/p>\n<p>So what&rsquo;s keeping foreign citizens off the voter rolls and out of the ballot box? A small square box on the <a href=\"https:\/\/amzn.to\/3YuVZYV\">federal voter registration form requiring<\/a> a prospective voter to attest under penalty of perjury that he is a citizen.
