The Court&#8217;s decision followed an emergency request from the state to pause a previous\u2063 ruling by a lower court, \u2064which\u200c had prevented officials from removing approximately 1,600 \u200cindividuals who\u2063 had self-identified as noncitizens from \u2064the\u200b voter registration lists. The lower court&#8217;s ruling, perceived as aligning with partisan lines, was \u200bdelivered by a judge appointed by\u200b President Biden and supported by a panel of judges on\u200c the \u20644th Circuit Court of\u2062 Appeals.<\/p>\n<p>The\u200d conflict began when Virginia&#8217;s Republican Governor Glenn Youngkin\u2062 initiated a review of voter lists and\u2064 called for\u2062 better election security measures, resulting in the \u2062removal of \u200bover 6,000 \u200cnoncitizens from the voter rolls between January \u20632022 and July 2024. \u2064The\u2063 Justice Department argued that these actions \u2064violated federal law, prompting Attorney General Jason Miyares to appeal to\u2062 the Supreme Court. return false;\" title=\"Printer Friendly, PDF &amp; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>On Wednesday, the U.S. Supreme Court struck down an attempt by the Biden-Harris Justice Department to keep noncitizens on Virginia&rsquo;s voter rolls.<\/p>\n<p>In a <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/103024zr_f2ah.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">one-page order<\/a>, the nation&rsquo;s highest court granted an emergency request by the commonwealth to place a stay on a lower court ruling that prohibited state election officials from <a href=\"https:\/\/thefederalist.com\/2024\/10\/28\/virginia-asks-scotus-to-allow-removal-of-1600-self-identified-noncitizens-from-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">removing<\/a> roughly 1,600 &ldquo;self-identified&rdquo; noncitizens from Virginia&rsquo;s voter registration lists. Decided by a Biden-appointed judge, the district court ruling was upheld by a three-judge panel of Democrat appointees on the 4th Circuit Court of Appeals on Sunday.<\/p>\n<div class=\"fdrlst__b89e9-bbce6db49870cd654b311f0d4e61bf75 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-bbce6db49870cd654b311f0d4e61bf75\"><\/div>\n<p>The Supreme Court&rsquo;s granting of Virginia&rsquo;s request seemingly fell along partisan lines, with all three Democrat justices voting to &ldquo;deny the application.&rdquo;<\/p>\n<p>The dispute started in August, when Republican Gov. Glenn Youngkin issued an&nbsp;<a href=\"https:\/\/www.governor.virginia.gov\/media\/governorvirginiagov\/governor-of-virginia\/pdf\/eo\/EO-35-Comprehensive-Election-Security-Ensuring-Legal-Voters-and-Accurate-Counting---vF---8.7.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>&nbsp;directing Virginia agencies to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/va-asks-scotus-if-it-can-take-noncitizens-off-the-voter-rolls\/\" title=\"VA Asks SCOTUS If It Can Take Noncitizens Off The Voter Rolls\">undertake voter list maintenance<\/a> and other election security procedures ahead of the November election. In the order, the governor revealed the state had removed 6,303 noncitizens from the commonwealth&rsquo;s voter rolls from January 2022 to July 2024.<\/p>\n<p>The Biden-Harris DOJ&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/10\/14\/biden-harris-doj-sues-to-stop-virginia-from-taking-noncitizens-off-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed a lawsuit<\/a>&nbsp;against the state earlier this month, alleging that the Youngkin administration&rsquo;s removal of noncitizens and other ineligible individuals from Virginia&rsquo;s voter rolls this close to the <a href=\"https:\/\/amzn.to\/3YuVZYV\">general election violated federal law<\/a>. <\/p>\n<p>Virginia Attorney General Jason Miyares appealed to the Supreme Court on Sunday, shortly after the 4th Circuit panel issued its decision. In his emergency application for stay, the commonwealth&rsquo;s chief law enforcement officer <a href=\"https:\/\/thefederalist.com\/2024\/10\/28\/virginia-asks-scotus-to-allow-removal-of-1600-self-identified-noncitizens-from-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> that the Biden-appointed district court judge based her injunction on a provision within federal statute that &ldquo;does not even apply to the removal of noncitizens and other voter registrations that are&nbsp;<em><a href=\"https:\/\/content.next.westlaw.com\/Glossary\/PracticalLaw\/I41334c8d07ef11ebbea4f0dc9fb69570?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true\" target=\"_blank\" rel=\"noreferrer noopener\">void ab initio<\/a><\/em>,&rdquo; and that &ldquo;even if it did apply to the removal of noncitizens, Virginia&rsquo;s program complied with it anyway.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-e6f19c64165407076e382d05c261e732 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e6f19c64165407076e382d05c261e732\"><\/div>\n<p>The Supreme Court noted in its order that the district court&rsquo;s ruling is &ldquo;stayed pending the disposition of the appeal in the United States Court of Appeals for the Fourth Circuit and disposition of a petition for a <a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/supreme-1\" target=\"_blank\" rel=\"noreferrer noopener\">writ of certiorari<\/a>, if such a writ is timely sought.&rdquo; The stay would be terminated if the Supreme Court ultimately declines to hear the case or agrees to consider the case and hands down judgement on the matter. <\/p>\n<p>Youngkin celebrated Wednesday&rsquo;s ruling in a <a href=\"https:\/\/x.com\/GlennYoungkin\/status\/1851631305353482681\" target=\"_blank\" rel=\"noreferrer noopener\">post<\/a> on X, calling it a &ldquo;victory for commonsense and election fairness.&rdquo;<\/p>\n<p>&ldquo;Clean voter rolls are one important part of a comprehensive approach we are taking to ensure the fairness of our elections,&rdquo; the GOP governor wrote. &ldquo;Virginians also know that we have paper ballots, counting machines not connected to the internet, a strong chain of custody process, signature verification, monitored and secured drop boxes, and a &lsquo;triple check&rsquo; vote counting process to tabulate results.
