Kennedy, Jr. off the presidential ballot when they thought his presence would hurt Vice President Kamala Harris. But after Kennedy dropped out of the race in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-more-votes-than-voters-in-key-swing-states\/\" title=\"Trump: More Votes Than Voters in Key Swing States\">key swing states<\/a> and endorsed former President Donald Trump, Democrats in Michigan and Wisconsin fought to keep Kennedy <em>on<\/em> the ballot despite his objections. And on Tuesday, the U.S. Supreme Court rejected Kennedy&rsquo;s emergency appeal to have his name removed from the ballots in those states.<\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2024\/08\/23\/rfk-jr-eviscerates-democratic-party-for-palace-coup-harris-nomination\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kennedy<\/a>&lsquo;s <a href=\"https:\/\/thefederalist.com\/2024\/10\/28\/rfk-jr-makes-last-ditch-effort-to-withdraw-name-from-blue-wall-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">emergency appeal<\/a> to the high court to have his name removed from the ballot in Michigan and Wisconsin argued that keeping him on the ballot was a violation of his First Amendment right. But the Supreme Court rejected the appeal on Tuesday without any reason. <\/p>\n<div class=\"fdrlst__b89e9-bcf70cdfcbb891a06be706ac86b854c9 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-bcf70cdfcbb891a06be706ac86b854c9\"><\/div>\n<p>The Wisconsin Elections Commission voted 5 to 1 in September to keep Kennedy on the ballot, arguing that <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/8\/20\/8\/a\" target=\"_blank\" rel=\"noreferrer noopener\">state law<\/a> prohibits the removal of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-calls-travel-lid-for-wednesday-an-hour-after-bobulinski-interview-airs\/\" title=\"Biden Calls Travel Lid for Wednesday an Hour After Bobulinski Interview Airs\">presidential nominee<\/a> from the ballot unless the candidate dies. <\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/rfk-jr-to-appeal-decision-letting-michigans-secretary-of-state-keep-him-on-the-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">Michigan<\/a> Secretary of State Jocelyn Benson <a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/rfk-jr-to-appeal-decision-letting-michigans-secretary-of-state-keep-him-on-the-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">originally refused<\/a> to remove Kennedy from the ballot, arguing that the third party under which Kennedy was running wouldn&rsquo;t be able to nominate another candidate before the election. The Michigan Supreme Court and 6th U.S. Circuit Court of Appeals sided with Benson.<\/p>\n<p>Justice Neil Gorsuch <a href=\"https:\/\/x.com\/chrisgeidner\/status\/1851365413759623495\" target=\"_blank\" rel=\"noreferrer noopener\">dissented<\/a> Tuesday in the Michigan case, arguing that lower court judges had thought the timing &ldquo;of Kennedy&rsquo;s original request to be removed wasn&rsquo;t so unreasonable that it should be denied,&rdquo; as reported by <a href=\"https:\/\/apnews.com\/article\/kennedy-supreme-court-ballot-michigan-wisconsin-43d8fed8fe69d8e4bfefd3e2b391e9f5\" target=\"_blank\" rel=\"noreferrer noopener\">The Associated Press<\/a>.<\/p>\n<p>Despite Benson&rsquo;s refusal to remove Kennedy from the ballot, she had no problem kicking third-party candidate <a href=\"https:\/\/thefederalist.com\/2024\/08\/19\/michigan-democrats-boot-third-party-candidate-cornel-west-off-november-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cornel West<\/a> off the ballot in Michigan after a challenge to his paperwork. And in Wisconsin, Green Party candidate <a href=\"https:\/\/thefederalist.com\/2024\/08\/27\/democrats-lose-ploy-to-remove-green-party-ticket-from-wisconsin-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jill Stein was nearly booted<\/a> off the ballot after the Democratic National Committee filed a petition to disqualify Stein , arguing that since there were no Green Party members in state offices or the legislature there would be no one to <a href=\"https:\/\/amzn.to\/3YuVZYV\">nominate presidential electors<\/a>. The Wisconsin Supreme Court rejected the petition in a 4-3 vote.<\/p>\n<div class=\"fdrlst__b89e9-7e02f9e80673813a729e0dfd40512371 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-7e02f9e80673813a729e0dfd40512371\"><\/div>\n<p>But lawfare efforts to kick third-party candidates off the ballot, or in Kennedy&rsquo;s case, keep him <em>on<\/em> the ballot, are politically motivated to help Harris.<\/p>\n<p>In Wisconsin, Stein siphoned more votes away from Hillary Clinton in 2016 than the margin by which Clinton lost to Trump.<\/p>\n<p>And in Michigan, Benson and the left understands that keeping Kennedy on the ballot &mdash; as opposed to other third party candidates &mdash; could siphon votes away from Trump, boosting Harris&rsquo; chances of victory.<\/p>\n<p>&ldquo;&hellip;[I]n a race this close, every swing-state vote matters. So, if those who would vote for Trump in a two-way race pull the lever for Kennedy&rsquo;s ghost ship of a campaign, Democrats will gladly take it,&rdquo; Matt Bennett, co-founder of the center-left think tank Third Way, <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4954034-kennedy-ballot-concerns-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4954034-kennedy-ballot-concerns-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Hill<\/a><\/p>\n<div class=\"fdrlst__b89e9-a2d23ead383479a0f4740a4d50bae856 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-a2d23ead383479a0f4740a4d50bae856\"><\/div>\n<p>Harris leads Trump in Michigan by 0.5 percentage points, according to <a href=\"https:\/\/www.realclearpolling.com\/polls\/president\/general\/2024\/michigan\/trump-vs-harris\" target=\"_blank\" rel=\"noreferrer noopener\">RealClearPolitics<\/a> average.
