Attorney General Jason Miyares stated\u2062 that only American citizens should participate in elections, \u200das he announced the emergency \u200capplication following a decision from the 4th Circuit Court of Appeals. This court\u2062 upheld a previous ruling by a Biden-appointed district \u2064court \u200djudge which barred the \u2064state from removing noncitizens and ineligible\u200b voters from its registration lists ahead of \u200cthe upcoming election.<\/p>\n<p>The situation originated when \u2064Governor Glenn Youngkin issued an executive order in August, directing agencies\u200c to maintain voter lists and improve\u2062 election security, revealing \u2064the removal of over 6,300 noncitizens \u200cfrom the\u2064 rolls\u200d between January 2022 and July 2024. However, the Department of Justice filed a\u200d lawsuit against Virginia, arguing \u2062that the last-minute removals violated the\u2063 National Voter \u200bRegistration \u2062Act\u2062 (NVRA).<\/p>\n<p>In\u200d the application\u200b for a stay,\u2063 Miyares contended that the \u200cinjunction\u2063 imposed by the district court\u2064 was based on a misinterpretation of the NVRA and could harm Virginia\u2019s sovereignty, confuse voters, and lead to\u200b illegal \u200bvoting by noncitizens.\u2063 He also \u200bclaimed that the \u20644th Circuit ignored the Purcell principle,\u2062 which discourages changes to\u2064 election procedures right before an election. Miyares argues that this judicial\u200d ruling is inconsistent with established legal precedents.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Commonwealth of Virginia asked the U.S. Supreme Court on Sunday to allow state election officials to remove roughly 1,600 &ldquo;self-identified&rdquo; noncitizens from the voter rolls before Election Day. <\/p>\n<p>&ldquo;Americans citizens &mdash; and no one else &mdash; should determine American elections,&rdquo; Attorney General Jason Miyares wrote in a Monday <a href=\"https:\/\/x.com\/JasonMiyaresVA\/status\/1850890877671010318\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> announcing the development. <\/p>\n<p>The emergency application for stay asks the nation&rsquo;s highest court to effectively pause a Sunday decision by the 4th Circuit Court of Appeals. That ruling upheld a <a href=\"https:\/\/thefederalist.com\/2024\/10\/25\/biden-judge-orders-virginia-to-put-more-than-1500-self-identified-noncitizens-back-on-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">Friday decision<\/a> by a Biden-appointed district court judge that prohibits the state from removing noncitizens and other ineligible voters from its voter registration lists ahead of the 2024 election. <\/p>\n<p>The three-judge panel for the 4th Circuit was comprised of all Democrat appointees, according to <a href=\"https:\/\/www.abc27.com\/hill-politics\/virginia-asks-supreme-court-to-greenlight-1600-voter-roll-removals\/\" target=\"_blank\" rel=\"noreferrer noopener\">local media<\/a> and the <a href=\"https:\/\/apnews.com\/article\/virginia-voter-registration-noncitizens-purge-appeal-b1d174ea90a7ac6e6fb1b9c623b7402e\" target=\"_blank\" rel=\"noreferrer noopener\">Associated Press<\/a>. <\/p>\n<p>The entire legal saga began in August, when Republican Gov. Glenn Youngkin issued an <a href=\"https:\/\/www.governor.virginia.gov\/media\/governorvirginiagov\/governor-of-virginia\/pdf\/eo\/EO-35-Comprehensive-Election-Security-Ensuring-Legal-Voters-and-Accurate-Counting---vF---8.7.24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> directing commonwealth agencies to undertake voter list maintenance and other election security procedures ahead of the November election. In the order, the governor revealed the state had removed 6,303 noncitizens from Virginia&rsquo;s voter rolls from January 2022 to July 2024. <\/p>\n<p>The Biden-Harris Department of Justice <a href=\"https:\/\/thefederalist.com\/2024\/10\/14\/biden-harris-doj-sues-to-stop-virginia-from-taking-noncitizens-off-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed a lawsuit<\/a> against the commonwealth earlier this month, alleging that the state&rsquo;s removal of noncitizens and other ineligible individuals from Virginia&rsquo;s voter rolls this close to the November election violated provisions of the 1993 National Voter Registration Act (NVRA). That&nbsp;<a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title52\/subtitle2\/chapter205&amp;edition=prelim\" target=\"_blank\" rel=\"noreferrer noopener\">law<\/a>&nbsp;requires states to complete &ldquo;not later than 90 days prior to the date of a primary or general election for Federal office, any program the purpose of which is to systematically remove the names of ineligible voters from the official lists of eligible voters.&rdquo;<\/p>\n<p>Miyares argues in the state&rsquo;s emergency application for stay that the Biden-appointed district court judge based her injunction on a provision within the NVRA that &ldquo;does not even apply to the removal of noncitizens and other voter registrations that are <em><a href=\"https:\/\/content.next.westlaw.com\/Glossary\/PracticalLaw\/I41334c8d07ef11ebbea4f0dc9fb69570?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true\" target=\"_blank\" rel=\"noreferrer noopener\">void ab initio<\/a><\/em>,&rdquo; and that &ldquo;even if it did apply to the removal of noncitizens, Virginia&rsquo;s program complied with it anyway.&rdquo;<\/p>\n<p>&ldquo;This election-eve injunction is thus based on legal error,&rdquo; the application reads. &ldquo;The injunction, which prohibits the application of a law that has been on the books since the Justice Department precleared it in 2006, will also irreparably injure Virginia&rsquo;s sovereignty, confuse her voters, overload her election machinery and administrators, and likely lead noncitizens to think they are permitted to vote, a criminal offence that will cancel the franchise of eligible voters.&rdquo;<\/p>\n<p>The attorney general further claims the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-hands-texas-a-major-border-win-over-the-biden-administration\/\" title=\"Federal Appeals Court Hands Texas a Major Border Win Over the Biden Administration\">district court&#038;rsquo<\/a>;s injunction violates the <a href=\"https:\/\/ballotpedia.org\/The_Purcell_Principle\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Purcell<\/em> principle<\/a>, which, as described by Ballotpedia, is a legal doctrine adopted by the Supreme Court &ldquo;establishing that courts should not change election rules during the period just prior to an election because it could confuse voters and election officials.&rdquo; Miyares contends the 4th Circuit panel &ldquo;refused to apply Purcell and declined to stay the injunction, holding that &lsquo;appellees do not challenge a state election law&rsquo; and that Purcell is inapplicable to the NVRA.&rdquo;<\/p>\n<p>&ldquo;This ruling is incorrect and violates this Court&rsquo;s precedent. The <a href=\"https:\/\/amzn.to\/3YuVZYV\">district court enjoined enforcement<\/a> of&rdquo; Virginia law, the filing reads. &ldquo;And Purcell applies to eleventh-hour injunctions under the NVRA, particularly where, as here, they order mandatory retrospective relief of adding numerous individuals to a State&rsquo;s voter rolls past the State&rsquo;s deadline for doing so and imminently before an election.&rdquo;<\/p>\n<p>Virginia has asked the high court to issue a stay by Tuesday or that an &ldquo;immediate administrative stay&rdquo; be issued &ldquo;to permit the orderly resolution of this motion.&rdquo;<\/p>\n<p>Chief Justice John Roberts is the &ldquo;circuit justice&rdquo;&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/about\/circuitassignments.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">tasked<\/a>&nbsp;with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-asks-scotus-to-approve-azs-proof-of-citizenship-mandate\/\" title=\"GOP Asks SCOTUS To Approve AZ&#039;s Proof Of Citizenship Mandate\">handling emergency stay applications<\/a> from Virginia.
