In a narrow 4-3 decision, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/third-degree-murder-charge-against-ex-cop-derek-chauvin-reinstated-by-appeals-court\/\" title=\"Third-Degree Murder Charge Against Ex-Cop Derek Chauvin Reinstated By Appeals Court\">court determined<\/a> that the Butler County Board \u200dof Elections \u2064must accept\u200d provisional ballots from voters whose mail-in ballots were rejected due to issues such as lack of a secrecy envelope or missing information. The\u2063 majority opinion stated that disenfranchising voters for not adhering to mail-in voting instructions, especially when they utilized \u200dthe provisional voting option, contradicted the principles of a fair election. Voters whose mail-in ballots were rejected for lacking the secrecy envelope, missing information, or sporting inaccurate information must now be allowed to vote via provisional ballot.<\/p>\n<p>&ldquo;It is difficult to discern any principled reading of the Free and Fair Election Clause that would allow the disenfranchisement of voters as punishment for failure to conform to the mail-in voting requirements when voters properly availed themselves of the provisional voting mechanism,&rdquo; the majority ruling said.<\/p>\n<p>Butler County residents had sued the election board after their provisional ballots were refused in the 2024 primary.
