The judge ruled \u200dthat the Georgia State Election \u2064Board had overstepped its \u2063authority \u200din implementing these \u2062changes, which included \u2063measures such\u200d as allowing\u200d county\u200b election officials to hand-count paper ballots on election night\u200c and\u2062 expanding access \u2064for poll watchers. The \u2064Republicans claim these new \u200drules are essential for transparency and security in\u200b the electoral process. \u2064They have appealed to\u2063 the Georgia Supreme Court to reverse\u2064 Cox&#8217;s decision, \u2064arguing \u200bthat the judge&#8217;s\u200c ruling favors Democrats and undermines\u200b the integrity of\u200b elections. Judge Thomas Cox ruled last week that the state&rsquo;s Election Board had exceeded its authority in implementing these changes, arguing that such powers belong to the Georgia General Assembly.<\/p>\n<figure class=\"wp-block-image size-full\"><figcaption class=\"wp-element-caption\">Judge Thomas A. (AP Photo\/Brynn Anderson)<\/figcaption><\/figure>\n<p>The judge &ldquo;exemplified the very worst of judicial activism,&rdquo; RNC Chairman Michael Whatley said on Oct. 17, before the RNC<a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/09\/2024-10-18-Emergency-motion-for-expedited-review-WM.pdf\" target=\"_blank\" rel=\"noopener\" title> asked<\/a> the Georgia Supreme Court on Friday to reinstate the board&rsquo;s recent rule changes that in part would allow <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-secretary-of-state-there-will-be-a-recount\/\" title=\"Georgia Secretary of State: &#039;There Will Be a Recount&#039;\">county election officials<\/a> to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/3190889\/georgia-judge-halts-mandatory-hand-counting-ballots-election-night\/\" target=\"_blank\" rel=\"noopener\" title>hand-count paper ballots<\/a> the night of the election.<\/p>\n<p>&ldquo;By overturning the&nbsp;Georgia&nbsp;State Election Board&rsquo;s commonsense rules passed to safeguard&nbsp;Georgia&rsquo;s elections,&nbsp;the judge&nbsp;sided with the Democrats in their attacks&nbsp;on transparency, accountability, and the integrity of our elections,&rdquo; Whatley added, saying the appeal is necessary to &ldquo;ensure commonsense rules are in place for the election &mdash; we will not let this stand.&rdquo;<\/p>\n<p>At the heart of the dispute are new rules introduced by the Georgia State Election Board, including hand-counting paper ballots and expanding poll watcher access. The new rules were passed Sept. 20, less than 50 days before the general election.<\/p>\n<p>On Oct. 19, GOP petitioners subsequently <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/09\/2024-10-19-Motion-for-supersedeas-WM.pdf\" target=\"_blank\" rel=\"noopener\" title>asked<\/a> the state Supreme Court to pause Cox&rsquo;s ruling and allow the rules to go into effect while the appeal continues. A decision on this request is expected soon, <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/georgia-republicans-challenge-election-board-rules-passed-by-maga-members\/\" target=\"_blank\" rel=\"noopener\" title>according<\/a> to <em>Democracy Docket<\/em>.<\/p>\n<p>&ldquo;After considering the emergency motion for supersedeas, the Court will address the remainder of the Petitioners&rsquo; motion for an expedited appeal,&rdquo; the state Supreme Court said in their Oct. 18 <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/09\/2024-10-18-Order-WM.pdf\" target=\"_blank\" rel=\"noopener\" title>decision<\/a> that agreed to consider the RNC&rsquo;s appeal.<\/p>\n<p>The other six rules Cox struck down would require a &ldquo;reasonable inquiry&rdquo; by local officials before certifying results, <a href=\"https:\/\/amzn.to\/3YuVZYV\">give county election board members access<\/a> to election-related documents generated as the election was being conducted, make absentee ballot deliverers provide a signature and photo ID upon delivery, require surveillance and recording of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-poised-to-end-leftwing-election-shenanigans\/\" title=\"Supreme Court Poised To End Leftwing Election Shenanigans\">authorized drop boxes<\/a> after the close of polls, expand poll-watching areas, and add new rules for the county board of registrars in reporting absentee ballot information.<\/p>\n<p>These rules were set to apply in the presidential election but were blocked by Cox&rsquo;s ruling. Republicans argue that these measures are crucial for transparency and security.
