The first case arises from Oklahoma and\u2063 other companies challenging\u200b the \u200bvenue for disputes regarding the EPA&#8217;s ozone \u2063regulations, which have historically been adjudicated \u200bin the D.C.\u200c Circuit Court, known\u2063 for its Democratic\u200c leanings. Circuit, not under a more regional appeals court where the challengers may have an advantage in getting the rule paused.<\/p>\n<p>The case comes as a growing number of states and industry groups have sought relief in regulatory disputes at venues outside of the D.C. Circuit in hopes of finding a venue more favorable to their requests.<\/p>\n<p>For example, the Louisiana-based U.S. Court of Appeals for the 5th Circuit, considered to be one of the most conservative and skeptical of regulatory overreach, <a href=\"https:\/\/lawreview.syr.edu\/fifth-circuit-restricts-scope-of-epas-statutory-authority-to-regulate-new-uses-of-forever-chemicals-under-toxic-substances-control-act\/\" target=\"_blank\" rel=\"noopener\" title>decided on March 22<\/a> to make it much more difficult to prevent a Texas-based plastic company from using fluorination to reinforce plastic packaging, which the agency says contributes to producing &ldquo;forever chemicals&rdquo; and harms the environment.<\/p>\n<p>The justices will hear <em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/oklahoma-v-environmental-protection-agency-2\/\" target=\"_blank\" rel=\"noopener\" title=\"Oklahoma\">Oklahoma<\/a> <\/em>and <em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/pacificorp-v-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\" title=\"Oklahoma\">PacifiCorp v. EPA<\/a> <\/em>in a consolidated argument hearing later this term.<\/p>\n<p>The other dispute granted by the justices on Monday, <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/environmental-protection-agency-v-calumet-shreveport-refining-llc\/\" target=\"_blank\" rel=\"noopener\" title><em>EPA v. Calumet Shreveport Refining<\/em>, LLC<\/a>, surrounds the agency&rsquo;s denial of biofuel waivers for small refineries that requested to be exempt from the Renewable Fuel Standard program&rsquo;s responsibilities under the Clean Air Act.<\/p>\n<p>Calumet&nbsp;presents a similar question to the justices: whether the venue for challenges by small oil refineries seeking such exemptions lies exclusively with the D.C.-based appeals court because they are nationwide in scope, or if other federal appeals courts can decide these types of challenges.<\/p>\n<p>The Supreme Court in recent years has cast a more skeptical eye on the administrative and regulatory state, with moves such as a 6-3 ruling against the EPA in 2022 on the extent that it can <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-epa-vows-to-draft-sweeping-power-plant-rules-despite-scotus-review\/\" title=\"Biden\u2019s EPA Vows to Draft Sweeping Power Plant Rules Despite SCOTUS Review\">regulate carbon dioxide emissions<\/a> on the basis of preventing climate change.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><\/strong><\/a>&nbsp;<\/p>\n<p>This past term, the justices&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3061129\/supreme-court-strikes-down-biden-epas-good-neighbor-pollution-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>&nbsp;5-4 to pause the EPA&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/epa-finalizes-good-neighbor-rule-to-limit-cross-state-pollution-from-coal-plants\/\" title=\"EPA finalizes &#039;good neighbor&#039; rule to limit cross-state pollution from coal plants\">good neighbor rule<\/a>, which sought to strictly limit ozone pollution from power plants and other industrial sources in 23 states, as well as air pollutants that can drift downwind to other states and cause additional harm.<\/p>\n<p>The Supreme Court&rsquo;s <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/102124zor_n758.pdf\" target=\"_blank\" rel=\"noopener\" title>orders list<\/a> on Monday noted that Justice Samuel Alito did not participate in considering the petitions related to the &ldquo;good neighbor&rdquo;
