The\u200b evidence, \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-sba-refuses-to-answer-questions-on-approval-of-pp-loans-for-planned-parenthood-affiliates\/\" title=\"Report: SBA refuses to answer questions on approval of PP loans for Planned Parenthood, affiliates\">heavily redacted<\/a>, does not strengthen Smith&#8217;s claims\u2063 that \u2062Trump violated \u200dFirst Amendment rights regarding election \u200dintegrity.\u2063 The focus is not on the\u2064 validity of\u2064 the evidence\u200d but rather on how it \u200cmight be used to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/russia-claims-it-killed-three-americans-in-ukraine-here-are-the-facts\/\" title=\"Russia Claims It Killed Three Americans In Ukraine. Here Are The Facts\">shape public perception<\/a> of Trump \u200cahead of the election. Chutkan recognized that withholding evidence for political reasons\u2062 could be perceived as election interference,\u2064 deciding to release the \u200cinformation regardless.<\/p>\n<p>The unsealing follows Smith&#8217;s previous brief accusing Trump of using false claims of election fraud to\u2063 disrupt the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/electoral-body-suggests-australia-adopt-national-digital-voting-system\/\" title=\"Australia urged to implement national digital voting system by electoral body.\">electoral \u200cprocess<\/a> in 2020. The left has downplayed\u2062 the significance of this unsealed \u200cevidence while also \u200dusing it to further their narrative \u2062against Trump. Media outlets have \u200cportrayed the unsealing in conflicting lights, with some emphasizing the \u200bvolume of evidence against Trump and others \u200bcritiquing its lack of impact.\u200d these strategic moves in the courtroom reflect \u2064ongoing \u200bconcerns about election interference, reminiscent of past instances such \u200cas the FBI&#8217;s investigation into Hillary Clinton&#8217;s emails just before the 2016 election.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>With less than three weeks until Election Day, U.S. District Judge Tanya Chutkan unsealed &ldquo;evidence&rdquo; Special Counsel Jack Smith submitted to justify his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-led-lawfare-gets-3rd-party-candidates-kicked-off-ga-ballot\/\" title=\"Dem-Led Lawfare Gets 3rd-Party Candidates Kicked Off GA Ballot\">lawfare attempts<\/a> against former President Donald Trump. It&rsquo;s certainly not the October Surprise the left was hoping for; the heavily redacted evidence fails to bolster Smith&rsquo;s dubious claim that Trump should be denied his First Amendment right to question the outcome and administration of an election.<\/p>\n<p>Whether the unsealed &ldquo;evidence&rdquo; corroborated Smith&rsquo;s lawfare matters not. What matters is whether Smith, Chutkan, and the propaganda press can leverage it to undermine Trump&rsquo;s chances by influencing public perception ahead of Nov. 5 &mdash; something that leftists once considered taboo when they thought their candidate was in the crosshairs.<\/p>\n<p>Chutkan ordered the unsealing Thursday night, acknowledging the potential impact that doing so would have on the upcoming election. <\/p>\n<p>&ldquo;If the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chutkan-denies-trumps-request-to-delay-release-of-jan-6-evidence-washington-examiner\/\" title=\"Chutkan denies Trump&#039;s request to delay release of Jan. 6 evidence - Washington Examiner\">court withheld information<\/a> that the public otherwise had a right to access solely because of the potential political consequences of releasing it, that withholding could itself constitute &mdash; or appear to be &mdash; election interference,&rdquo; Chutkan <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.265.0_3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. &ldquo;The court will therefore continue to keep political considerations out of its decision-making, rather than incorporating them as Defendant requests.&rdquo;<\/p>\n<p>The unsealing comes just <a href=\"https:\/\/thefederalist.com\/2024\/10\/03\/jack-smiths-trump-lawfare-is-still-a-middle-finger-to-the-first-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">weeks after Chutkan unsealed<\/a> Smith&rsquo;s 165-page brief, which alleges Trump used &ldquo;false claims of election fraud to disrupt the electoral process&rdquo; in 2020. Smith argues that Trump&rsquo;s &ldquo;refuse[al] to say whether he would accept the election results&rdquo; of 2020 (which saw unelected leaders usurp the authority of state legislatures and unilaterally change election procedure) and Trump&rsquo;s expressing concern about potential fraud are grounds for prosecution and jail time.<\/p>\n<p>Chutkan&rsquo;s unleashing of Smith&rsquo;s 11th-hour brief and her subsequent unsealing of &ldquo;evidence&rdquo; have been brushed aside by the left &mdash; even though Chutkan&rsquo;s mention of &ldquo;political consequences&rdquo; is an admission her decision amounts to election interference<strong> <\/strong>&mdash; because they&rsquo;re useful fodder.<\/p>\n<p><a href=\"https:\/\/abcnews.go.com\/US\/trump-asks-judge-jan-6-case-delay-release\/story?id=114892192\" target=\"_blank\" rel=\"noreferrer noopener\">ABC News<\/a> pretended that Chutkan&rsquo;s decision to unseal the &ldquo;evidence&rdquo; was her effort to push &ldquo;back on Trump&rsquo;s argument that the release was politically motivated to influence the 2024 presidential election.&rdquo;<\/p>\n<p>&ldquo;Chutkan faulted Trump&rsquo;s lawyers for peddling what she called political arguments rather than engaging with the relevant factors to justify sealing the evidence in the case,&rdquo; ABC News reported. <\/p>\n<p>Meanwhile, <a href=\"https:\/\/www.newsweek.com\/donald-trump-election-fraud-case-evidence-unsealed-tanya-chutkan-1971312\" target=\"_blank\" rel=\"noreferrer noopener\">Newsweek<\/a> used the unsealing to write a piece about a &ldquo;mountain&rdquo; of &ldquo;evidence&rdquo; against Trump &mdash; even though <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/10\/18\/trump-jan-6-chutkan-appendix-jack-smith\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Washington Post<\/a>, for example, called the unsealing &ldquo;<a href=\"https:\/\/www.facebook.com\/story.php?story_fbid=921615476496995&amp;id=100059456532991&amp;_rdr\" target=\"_blank\" rel=\"noreferrer noopener\">unrevelatory<\/a>.&rdquo;<\/p>\n<p>But such blatantly obvious attempts to sway the public&rsquo;s perception of one of the candidates constitutes election interference &mdash; at least according to the standard used in 2016.<\/p>\n<p>Then-FBI Director James Comey announced in October of 2016 that the agency would be investigating Hillary Clinton&rsquo;s emails. The announcement set off years of blaming Comey for causing Clinton to lose the race.<\/p>\n<p><a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2016\/10\/29\/499868601\/fbi-head-under-fire-for-restarting-clinton-email-investigation-days-before-elect\" target=\"_blank\" rel=\"noreferrer noopener\">NPR<\/a> published a piece days before Election Day in 2016 highlighting the point that Comey&rsquo;s decision came &ldquo;just days before Election Day&rdquo; and that &ldquo;former prosecutors and former Department of Justice officials are questioning what Comey hopes to accomplish by announcing the investigation so close to the election.&rdquo; The article went on to cite several anonymous officials who said the timing of the announcement would impact the election.<\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/2016\/10\/30\/us\/politics\/comey-clinton-email-justice.html?hp&amp;action=click&amp;pgtype=Homepage&amp;clickSource=story-heading&amp;module=a-lede-package-region&amp;region=top-news&amp;WT.nav=top-news\" target=\"_blank\" rel=\"noreferrer noopener\">cited<\/a> &ldquo;senior Justice Department officials&rdquo; who said they &ldquo;did everything short of&rdquo; stopping Comey from &ldquo;sending the letter&rdquo; and argued that Comey&rsquo;s letter could be &ldquo;seen as meddling in elections.&rdquo;<\/p>\n<p>Vox <a href=\"https:\/\/www.vox.com\/the-big-idea\/2017\/1\/11\/14215930\/comey-email-election-clinton-campaign\" target=\"_blank\" rel=\"noreferrer noopener\">published a piece<\/a> in January of 2017 titled &ldquo;4 pieces of evidence showing FBI Director James Comey cost Clinton the election,&rdquo; which went on to say Comey&rsquo;s announcement had an &ldquo;impact&rdquo; on the race and &ldquo;cost Clinton the election.&rdquo;<\/p>\n<p>Comey let Clinton off the hook and never recommended charging her, and her loss could not be attributed to anything but her poor candidacy and lack of appeal. But Democrats and their propaganda press allies took Comey to task for allegedly interfering in the 2016 election just prior to Election Day. <\/p>\n<p>Of course, they&rsquo;ve coincidentally lost their appetite for accountability surrounding politically charged lawfare when Trump is in the crosshairs.<\/p>\n<hr>\n<p>      Brianna Lyman is an elections correspondent at The Federalist.
