They are seeking a one-month \u200bdelay \u2064to prepare their own evidence and suggest that simultaneous\u200d release of both\u200c sides would help mitigate any potential prejudice and protect\u200b witness anonymity. Former federal prosecutor Elie Honig <a href=\"https:\/\/nymag.com\/intelligencer\/article\/jack-smith-october-surprise-donald-trump.html\" target=\"_blank\" rel=\"noopener\" title>wrote<\/a> in an op-ed in <em>New York<\/em> that Smith flouted the Department of Justice&rsquo;s policy manual, an &ldquo;internal bible,&rdquo; by filing public information that could affect the election.<\/p>\n<p>Trump&rsquo;s attorneys made a similar argument in their request on Thursday, saying that in addition to the general prejudice Smith&rsquo;s filings could cause, &ldquo;the asymmetric release of charged allegations and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-ag-despite-a-crisis-at-the-border-internal-emails-reveal-the-federal-government-is-effectively-abolishing-ice\/\" title=\"Arizona AG: Despite A Crisis At The Border, Internal Emails Reveal The Federal Government Is \u2018Effectively Abolishing ICE\u2019\">related documents<\/a> during early voting creates a concerning appearance of election interference.&rdquo;<\/p>\n<p>The purpose of Smith&rsquo;s evidence submissions was to give the special counsel a chance to defend his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-jury-finds-douglass-mackey-guilty-in-insane-voter-suppression-case-for-sharing-anti-hillary-clinton-meme\/\" title=\"NYC Jury Finds Douglass Mackey Guilty in Insane &quot;Voter Suppression&quot; Case for Sharing Anti-Hillary Clinton Meme\">election interference charges<\/a> against Trump in the wake of the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Supreme-Court\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a> ruling that presidents enjoy some immunity from criminal prosecution for actions they perform as part of their job duties.<\/p>\n<p>Trump is afforded the opportunity to submit responses that are due within a couple of weeks of Smith&rsquo;s submissions. While that response time is standard, Chutkan set a rapid schedule that involved both parties submitting their competing documents during the final stretch of the election. The judge has repeatedly <a href=\"https:\/\/x.com\/asholiver\/status\/1831702705737211906\" target=\"_blank\" rel=\"noopener\" title>said<\/a> she believes the looming election is irrelevant to the case.<\/p>\n<p>Smith <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3175044\/jack-smith-lays-out-2020-election-case-against-trump-in-newly-unsealed-filing\/\" target=\"_blank\" rel=\"noopener\" title>submitted<\/a> his first batch of evidence, a massive 165-page motion, on Oct. 2. Trump asked for a delay to provide his response to it, and Chutkan granted him a delay until Nov. 7.<\/p>\n<p>Trump&rsquo;s postponement request on Thursday came after Chutkan also gave Trump a seven-day buffer last week to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3185167\/trump-appeal-order-unsealing-jan-6-evidence-judge\/\" target=\"_blank\" rel=\"noopener\" title>provide<\/a> the court with any objections to her unsealing the second wave of Smith&rsquo;s evidence. If she denies the request, Chutkan is expected to unseal Smith&rsquo;s evidence later on Thursday.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>In the first filing, prosecutors argued that despite the Supreme Court&rsquo;s ruling that presidential conduct can be immune from criminal prosecution, Trump&rsquo;s conduct should not be immune because his actions were private and made in his capacity as a candidate.<\/p>\n<p>The motion included bits of evidence that painted Trump as desperate and deluded in the aftermath of the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/2020-elections\" target=\"_blank\" rel=\"noopener\" title>2020 election<\/a>, and it attracted heavy media coverage.
