However, a Georgia judge, Robert McBurney, blocked the implementation of this rule \u2064just before the election, expressing concerns about the timing and the lack of \u200dadequate training for election workers.\u200b While he acknowledged that the hand count policy\u2062 could be a sound election practice, he\u200c cited the infeasibility\u2063 of\u200d its\u2063 proper execution under the current timeline. <\/p>\n<p>The new\u200d rule mandated that three sworn poll officers manually count\u200c the ballots and reconcile any\u200c discrepancies with machine totals. This rule was one of several passed by the SEB, but\u200b its blocking came amid legal challenges from\u200c Democrats and local election\u200c boards questioning its validity. McBurney argued that the\u2062 inadequacy of guidelines and training, coupled with \u2063the potential\u2062 for operational inefficiency, warranted preventing the rule&#8217;s enactment at\u200d this juncture.<\/p>\n<p>Additionally, the judge&#8217;s decision emphasized that introducing significant changes to the election process so close to \u2064the vote could create confusion and inconsistencies, potentially undermining the electoral process&#8217;s effectiveness and \u2063fairness.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The State Election Board (SEB)&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/georgia-state-election-board-approves-rule-seeking-to-ensure-accurate-ballot-counts\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed a rule<\/a>&nbsp;last month that sought to ensure the number of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ga-seb-approves-rule-seeking-to-ensure-accurate-ballot-counts\/\" title=\"GA SEB Approves Rule Seeking To Ensure Accurate Ballot Counts\">physical ballots counted matches<\/a> the Election Day machine count total at the precinct level.&nbsp;But after Democrats launched a lawfare campaign, a Georgia judge blocked the rule on Tuesday despite acknowledging it would simply provide &ldquo;confirmation that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-judge-sides-with-dems-and-blocks-new-election-security-measure-citing-jan-6\/\" title=\"Georgia Judge Sides with Dems and Blocks New Election Security Measure, Citing Jan. 6\">machine counts match reality<\/a>.&rdquo;<\/p>\n<p><a href=\"https:\/\/sos.ga.gov\/sites\/default\/files\/2024-08\/seb-notice_of_proposed_rulemaking_183_1_12_.12a5_hand_count.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Rule 183-1-12-.12 (a)(5)<\/a> stated that &ldquo;three sworn precinct poll officers&rdquo; shall count by hand the &ldquo;number of ballots removed from the scanner &hellip; until all of the ballots have been counted separately by each of the three poll officers.&rdquo; If the machine count total does not match the hand count total, &ldquo;the poll manager shall immediately determine the reason for the inconsistency; correct the inconsistency, if possible; and fully document the inconsistency or problem along with any corrective measures taken.&rdquo;<\/p>\n<p>Fulton County Superior Court Judge Robert McBurney himself acknowledged the rule &ldquo;may be&rdquo; &ldquo;smart election policy,&rdquo; but that &ldquo;the timing of its passage make[s] implementation now quite wrong.&rdquo;<\/p>\n<p>&ldquo;On paper, the Hand Count Rule &mdash; if properly promulgated &mdash; appears consistent with the SEB&rsquo;s mission of ensuring fair, legal, and orderly elections. It is, at base, simply a check of ballot counts, a human eyeball confirmation that the machine counts match reality,&rdquo; McBurney ruled.<\/p>\n<p>But the judge blocked the rule from going into effect in his Tuesday <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/10\/hand-count-injunction.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>, arguing the rule comes too close to an election and there is not enough time to properly train election workers.<\/p>\n<p>The hand count rule was one of several election rules passed by the Georgia SEB in September. Earlier this month, the elections board of Cobb County <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/10\/2024-10-02-Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> McBurney to invalidate six of the state board&rsquo;s rules. They also asked the judge to specifically stop implementation of the rule requiring counties to double-check machine ballot totals by hand, even though state <a href=\"https:\/\/law.justia.com\/codes\/georgia\/title-21\/chapter-2\/article-12\/section-21-2-493\/\" target=\"_blank\" rel=\"noreferrer noopener\">statute<\/a> already requires a similar reconciliation process, stating that county officials &ldquo;compare the registration figure with the certificates returned by the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/media-cloud-ga-election-integrity-measures-with-disinformation\/\" title=\"Media Cloud GA Election Integrity Measures With Disinformation\">poll officers showing<\/a> the number of persons who voted in each precinct or the number of ballots cast.&rdquo; <\/p>\n<p>The Democratic National Committee and Georgia&rsquo;s Democrat Party <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/09\/2024-09-30-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">along<\/a> with board members from four separate Georgia county boards of elections &ldquo;also filed an emergency motion &hellip; seeking the same relief as to the Hand Count Rule,&rdquo; McBurney wrote. <\/p>\n<p>McBurney&rsquo;s ruling enjoins the SEB from implementing the rule this close to Election Day while the court considers the merit of the complaints.&nbsp;<\/p>\n<p>McBurney feared the rule would make the upcoming election &ldquo;inefficient and non-uniform by the introduction of an entirely new process,&rdquo; even though some Georgia counties have <a href=\"https:\/\/sos.ga.gov\/sites\/default\/files\/forms\/Petition%20-%20Alexander_Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">conducted<\/a> ballot reconciliation by hand before. He further worried about the prospect of &ldquo;thousands of poll workers handling, sorting, and counting actual ballots&rdquo; in this way.<\/p>\n<p>McBurney expressed concern that as of Tuesday, &ldquo;there are no guidelines or training tools for the implementation of the Hand Count Rule&rdquo; and no guidance is &ldquo;forthcoming,&rdquo; since Secretary of State Brad Raffensperger said his office would be unable to &ldquo;provide meaningful training&rdquo; on the rule. Instead of training counties on the rule in the 25 days since it was passed, Raffensperger&rsquo;s office told counties it would do nothing until the court weighed in, according to a <a href=\"https:\/\/thefederalist.com\/2024\/10\/04\/memo-georgia-secretary-of-state-wont-train-counties-to-comply-with-election-boards-rule-yet\/\" target=\"_blank\" rel=\"noreferrer noopener\">memo<\/a> obtained by The Federalist. Both Raffensperger&rsquo;s office as well as the state&rsquo;s attorney general opposed the rule change. SEB member Janelle King previously told <a href=\"https:\/\/thefederalist.com\/2024\/10\/04\/memo-georgia-secretary-of-state-wont-train-counties-to-comply-with-election-boards-rule-yet\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Federalist<\/a> she didn&rsquo;t &ldquo;understand why there are complaints about the rule change being too close to the election while <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/memo-ga-sos-wont-train-counties-to-implement-election-rule\/\" title=\"Memo: GA SOS Won&#039;t Train Counties To Implement Election Rule\">simultaneously delaying training<\/a>.&rdquo;<\/p>\n<p>King told The Federalist she is &ldquo;disappointed for the people of Georgia&rdquo; following McBurney&rsquo;s ruling.<\/p>\n<p>&ldquo;When the Attorney General and Secretary of State express opinions that directly contradict our rules, it places the judge in a difficult position, forcing them to rule on hypothetical scenarios,&rdquo; King said. &ldquo;I am deeply disappointed for the people of Georgia.
