Judge Krissa\u200c Lanham ruled that the plaintiffs did not have the legal standing to pursue \u200cthe \u200dcase, stating their claims amounted to a &#8220;generalized grievance&#8221; that failed to demonstrate specific harm or that existing\u2063 voter list maintenance laws were \u2062being violated. The lawsuit intended to compel state election officials to comply with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dhs-secretary-alejandro-mayorkas-opening-doors-for-stateless-migrants\/\" title=\"DHS Secretary Alejandro Mayorkas Opening Doors for &#039;Stateless&#039; Migrants\">federal laws requiring<\/a> the\u2064 removal of noncitizens from voter rolls, especially after reports indicated a significant number of registrants lacked proof of citizenship. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2024\/09\/04\/lawsuit-arizonas-15-counties-are-failing-to-remove-noncitizens-from-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, that lawsuit alleged that the recorders &ldquo;have failed to take the actions required by law to ensure that foreign citizens are removed from their voter rolls.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-bac849791494212db8b82b9f18a0d27d fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-bac849791494212db8b82b9f18a0d27d\"><\/div>\n<p>&ldquo;Plaintiffs are not entitled to a preliminary injunction because they have not made a sufficiently clear showing they have standing,&rdquo; Lanham wrote. &ldquo;Plaintiffs&rsquo; request raises no more than a &lsquo;generalized grievance&rsquo; shared by every Arizona voter that elected officials must follow the law.&rdquo;<\/p>\n<p>SCFA and Cahill had <a href=\"https:\/\/thefederalist.com\/2024\/09\/04\/lawsuit-arizonas-15-counties-are-failing-to-remove-noncitizens-from-the-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> the court to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/suit-az-counties-are-failing-to-take-nonctizens-off-voter-rolls\/\" title=\"Suit: AZ Counties Are Failing To Take Nonctizens Off Voter Rolls\">affirm existing voter list maintenance laws<\/a> and issue an injunction requiring the state&rsquo;s recorders to comply with them. They specifically argued that &ldquo;federal law requires County Recorders to &lsquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/suit-local-election-chief-refuses-to-clean-maricopas-voter-rolls\/\" title=\"Suit: Local Election Chief Refuses To Clean Maricopa&#039;s Voter Rolls\">perform list maintenance&#038;rsquo<\/a>; and to engage in &lsquo;reasonable efforts&rsquo; to ensure that foreign citizens are not registered to vote.&rdquo;<\/p>\n<p>&ldquo;Because it is illegal for foreign citizens to register to vote in federal elections, any foreign citizen who is registered to vote is ineligible,&rdquo; the lawsuit reads.<\/p>\n<p>Lanham noted that she would still deny plaintiffs&rsquo; injunction request &ldquo;[e]ven if [they] had standing,&rdquo; citing the U.S. Supreme Court&rsquo;s <a href=\"https:\/\/ballotpedia.org\/The_Purcell_Principle\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Purcell<\/em> principle<\/a>. As described by Ballotpedia, the <em>Purcell<\/em> principle is a legal doctrine originating from a 2006 Supreme Court case &ldquo;establishing that courts should not change election rules during the period just prior to an election because it could confuse voters and election officials.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-8e40fac8ba3a5011b70754412ce3050d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-8e40fac8ba3a5011b70754412ce3050d\"><\/div>\n<p>&ldquo;Plaintiffs waited until shortly before the election to file this lawsuit despite allegedly suffering irreparable harm since Arizona&rsquo;s 2022 voter list maintenance laws went into effect,&rdquo; Lanham wrote. &ldquo;They have not made a clearcut showing of harm, nor that the action they request is feasible in the midst of a general election.&rdquo;<\/p>\n<p>The Joe Biden-appointed judge further claimed plaintiffs failed to &ldquo;show that the relief they now request &hellip; will redress their claimed imminent harm of &lsquo;disenfranchisement and vote dilution&rsquo; in the November 5 general election.&rdquo;<\/p>\n<p>SFCA Chair Merissa Hamilton told The Federalist the group&rsquo;s attorneys are currently &ldquo;looking at&rdquo; whether to appeal the decision. <\/p>\n<p>Friday&rsquo;s decision comes amid a crisis of confidence in state officials&rsquo; ability to maintain accurate voter rolls devoid of noncitizens. <\/p>\n<div class=\"fdrlst__b89e9-0706f5e894480d3d0e0f7bb376cc247d fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-0706f5e894480d3d0e0f7bb376cc247d\"><\/div>\n<p>Last month, Arizona Secretary of State Adrian Fontes <a href=\"https:\/\/thefederalist.com\/2024\/09\/18\/arizona-finds-100000-voters-lacking-citizenship-proof-on-wrong-list-after-catching-noncitizen-on-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> officials had discovered that roughly 98,000 registrants on the voter rolls lack documentary proof of citizenship (DPOC). Arizonans <a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">must show<\/a> DPOC when registering via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-affirms-arizonas-need-to-keep-noncitizens-off-voter-rolls-but-makes-it-harder-to-do-so\/\" title=\"Court upholds Arizona&#039;s voter roll restrictions for noncitizens, but raises barriers\">state registration form<\/a> in order to cast ballots in state and local races. Those who do not provide DPOC when registering may do so as a &ldquo;federal-only&rdquo; voter and cast ballots in federal races.<\/p>\n<p>An additional 120,000 registrants lacking DPOC were reportedly <a href=\"https:\/\/thefederalist.com\/2024\/10\/01\/oops-arizona-discovers-an-additional-120k-registered-voters-lacking-proof-of-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">discovered<\/a> weeks later, bringing the total of such voters to 218,000.
