Proponents argue that this amendment reflects a moderate stance, claiming that its rejection would lead to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/all-lives-matter-arkansas-gov-signs-near-total-abortion-ban-that-supporters-hope-will-force-scotus-to-revisit-roe-v-wade\/\" title=\"\u2018All Lives Matter\u2019: Arkansas Gov. Signs Near-Total Abortion Ban That Supporters Hope Will Force SCOTUS To Revisit Roe v. Wade\">total abortion ban<\/a>. However, critics contend that the\u2062 amendment\u2019s vague language would \u2064significantly liberalize \u2062abortion laws in the\u200b state, allowing courts to presume any governmental \u200crestrictions on \u2062abortion as unconstitutional. This could endanger\u2064 parental \u2063consent laws, potentially facilitating minors&#8217; access to\u200d abortion without parental guidance and shielding abusers\u2062 from\u2064 legal consequences.<\/p>\n<p>The amendment includes a provision that allows for abortion\u2064 restrictions\u200c post-&#8220;Fetal \u2063Viability,&#8221; but critics point out\u2062 that \u2064the definition\u2064 of viability is not fixed and can shift with medical advancements. This\u200c ambiguity\u200b raises concerns about how courts would interpret this provision\u2063 and highlights the potential influence of abortion providers in\u200b legal determinations. Furthermore,\u200d the amendment\u200b could \u2063require the state to fund abortions, \u2064which opponents argue infringes on individual conscience rights. there is apprehension that the passage of Amendment 3 \u200bwould impose extreme changes to Missouri&#8217;s abortion \u200dlaws.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Abortion radicalism is on Missouri&rsquo;s ballot. Fresh off post-<em>Dobbs <\/em>victories in ballot referenda to enshrine so<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/with-roe-in-the-balance-blue-states-push-for-abortion-on-demand\/\" title=\"With Roe in the Balance, Blue States Push for Abortion on Demand\">-called abortion rights<\/a> in the constitutions of various red states such as Kansas, Kentucky, and Ohio, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-ohio-voters-to-decide-how-easily-theyll-let-pro-abortion-interest-groups-change-their-constitution\/\" title=\"Ohio voters will determine the level of ease for pro-abortion interest groups to amend their constitution.\">pro-abortion interest groups<\/a> are campaigning for the ratification of <a href=\"https:\/\/www.sos.mo.gov\/elections\/petitions\/2024BallotMeasures\" target=\"_blank\" rel=\"noreferrer noopener\">Amendment 3<\/a>, which would create a constitutional &ldquo;right&rdquo; to abortion in the Missouri Constitution. <\/p>\n<p>As per usual, supporters of the amendment assert that theirs is the moderate position and that failure to pass the amendment will mean a complete abortion ban. But in reality, the amendment&rsquo;s placid and deceptive language would force Missouri abortion laws to the extreme left. This effort must fail.<\/p>\n<p>The ballot initiative asks Missourians if they want to amend our state constitution to &ldquo;establish a right to make decisions about reproductive health care&rdquo; &mdash; the inability to use the term &ldquo;abortion&rdquo; transparently is suspect &mdash; and have courts presume any &ldquo;governmental interference &hellip; invalid.&rdquo;&nbsp;<\/p>\n<p>Note that this language does not include any age restrictions. Further, establishing a fundamental right to abortion would force state courts to presume that <em>any <\/em>restriction on abortion, during <em>any stage <\/em>of pregnancy, is unconstitutional. Parental consent laws? Presumably unconstitutional. Parental notification laws? Same.&nbsp;<\/p>\n<p>On that basis alone, the amendment would allow abortionists to pressure minors into <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/largest-new-york-city-police-union-sues-over-vaccine-mandate\/\" title=\"Largest New York City Police Union Sues Over Vaccine Mandate\">life-changing decisions<\/a> with no outside counsel. More insidiously, this lack of qualification of the &ldquo;right to reproductive health care&rdquo; might shelter child abusers who coerce their victims into clandestine abortions from facing the justice that parental notification or consent laws assure in such cases.&nbsp;<\/p>\n<p>Further, the amendment prohibits the state government from &ldquo;discriminating&rdquo; in appropriation of state funds against those &ldquo;providing or obtaining reproductive health care.&rdquo; Read: State tax revenue will fund abortions. Thomas Jefferson wrote in the <a href=\"https:\/\/www.monticello.org\/research-education\/thomas-jefferson-encyclopedia\/virginia-statute-religious-freedom\/\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia Statute for Religious Freedom<\/a><em>,<\/em> &ldquo;[T]o compel a man to furnish contributions of money for the propagation of opinions which he disbelieves and abhors, is sinful and tyrannical.&rdquo; Passage of Amendment 3 would mandate and perversely consecrate such violations of conscience rights in Missouri.<\/p>\n<p>Those in favor of the amendment contend that its final clause, which allows abortion to be &ldquo;restricted or banned after Fetal Viability except to protect the life or health of the woman,&rdquo; means that late-term abortion could remain illegal in accordance with popular will. But that clause&rsquo;s carveouts are wider than the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/\/2024\/10\/localimages\/37GDTVXBUVDIBCROCS7DMR4XVQ.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">entrance to an Ozark show cave<\/a>.&nbsp;<\/p>\n<p>First, &ldquo;Fetal Viability,&rdquo; capitalized as a proper noun in the amendment as if it had a set definition, is a moving target. Viability is commonly defined as the point at which a baby might survive outside the womb and is usually estimated at 23-24 weeks, or near the end of the second trimester. But medical advances constantly push this boundary further toward conception.<\/p>\n<p>When <em>Roe v. Wade <\/em>was decided in the middle of the last century, babies born before 24 weeks of gestation had <a href=\"https:\/\/www.acog.org\/clinical\/clinical-guidance\/obstetric-care-consensus\/articles\/2017\/10\/periviable-birth#:~:text=From%20the%201950s%20through%201980,%20newborn%20death%20was%20virtually\">virtually no chance of survival<\/a>. Studies on early births in the United States, England, and Australia now show that about half of babies born in week 24 survive, while about a <a href=\"https:\/\/www.acog.org\/clinical\/clinical-guidance\/obstetric-care-consensus\/articles\/2017\/10\/periviable-birth#:~:text=From%20the%201950s%20through%201980,%20newborn%20death%20was%20virtually\" target=\"_blank\" rel=\"noreferrer noopener\">quarter survive when born at 23 weeks<\/a>. Moreover, the baby&rsquo;s chance of survival outside the womb depends on quality of care and myriad variables. As Dr. Rachel Fleishman wrote in an <a href=\"https:\/\/www.nbcnews.com\/think\/opinion\/roe-opponents-babies-born-limits-viability-rcna27557\">NBC News article<\/a> in 2022, &ldquo;Viability is not a line. It is not a concrete fact or a threshold or a date on a gestational calendar with absolute outcomes.&rdquo;&nbsp;<\/p>\n<p>This raises an obvious problem: If &ldquo;viability is not a line,&rdquo; then it is not a judicially discernible question. Courts must then defer to medical experts in determining whether an abortion occurred after that amorphous threshold. To whom would courts defer? The abortion providers with a financial and institutional incentive to circumvent the provision. Ditto for the exception for the mother&rsquo;s &ldquo;health,&rdquo; a word explicitly interpreted by the Supreme Court in the now-defunct <em>Roe v. Wade <\/em>majority opinion to include the mother&rsquo;s <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/410\/113\/%23:~:text=Roe%252520v.%252520Wade:%252520A%252520person%252520may%252520choose%252520to%252520have%252520an\">physical and <em>mental<\/em> health<\/a>. <\/p>\n<p>Including an exception that broad has only one practical purpose: to surreptitiously prohibit any restrictions. In other words, the last clause of the amendment has been inserted to falsely assure voters that late-term abortion can remain broadly illegal. It is an insult to voters&rsquo; intelligence.&nbsp;<\/p>\n<p>The unconditional right to a taxpayer-funded abortion has no place in a just society. Creating such a bogus &ldquo;right&rdquo; on the supposition that no innocent third party exists is a poor substitute for actual compassion and assistance for mothers and families struggling with unplanned pregnancies. <\/p>\n<p>There is no &ldquo;right to do wrong,&rdquo; as <a href=\"https:\/\/www.nlnrac.org\/american\/lincoln#:~:text=Lincoln%20reasoned%3A%20%E2%80%9CSo%20they%20have,a%20right%20to%20do%20wrong.%E2%80%9D\" target=\"_blank\" rel=\"noreferrer noopener\">Abraham Lincoln said of slavery<\/a>, at the heart of our fundamental social contract. The Supreme Court clarified that was still true of the U.S. Constitution in 2022.
