The case, titled *Masterpiece Cakeshop v. Scardina*, involved Phillips declining to create a cake celebrating a gender transition for Autumn Scardina.\u200c The court cited procedural errors as the reason \u200cfor \u2064their decision, stating that Scardina should\u200c have appealed a previous Colorado Civil Rights Commission ruling instead of directly suing\u2064 Phillips. \u2062Justice Melissa Hart emphasized the ongoing debate surrounding the balance of rights between transgender individuals and religious business \u200cowners in public commerce. But on Tuesday, the state Supreme Court dismissed the <a href=\"https:\/\/adflegal.org\/client\/jack-phillips\" target=\"_blank\" rel=\"noreferrer noopener\">third<\/a> lawfare challenge against him.<\/p>\n<p>Citing procedural errors, the Colorado Supreme Court <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceColoradoSupremeCourtRuling.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed<\/a> <em>Masterpiece Cakeshop v. Scardina<\/em>. The heart of the case was whether Phillips should be forced &mdash; against his sincerely held religious convictions &mdash; to design a cake for a mentally ill man, Autumn Scardina, who believes he is a woman. The requested cake would have been pink on the inside and blue on the outside, expressing a message that Phillips says violates his religious beliefs.<\/p>\n<div class=\"fdrlst__b89e9-5f03376f3442a09930ab438cb87815cf fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-5f03376f3442a09930ab438cb87815cf\"><\/div>\n<p>The case was &ldquo;calibrated to set Phillips up,&rdquo; as David Harsanyi <a href=\"https:\/\/thefederalist.com\/2023\/10\/05\/authoritarian-thugs-continue-their-persecution-of-jack-phillips\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in these pages. On the same day the <a href=\"https:\/\/thefederalist.com\/2023\/06\/30\/courage-is-a-christians-only-path-forward-from-the-legal-hell-the-winsome-gospel-wrought\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Supreme Court<\/a> agreed to take up a <em>different<\/em> case involving Phillips in 2017 (SCOTUS later <a href=\"https:\/\/www.supremecourt.gov\/opinions\/17pdf\/16-111_j4el.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in Phillips&rsquo; favor), Scardina requested a cake &ldquo;to celebrate and symbolize a gender transition,&rdquo; according to <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Alliance Defending Freedom<\/a>. Phillips declined, and &ldquo;a few months later, Scardina also asked for a cake with Satan smoking a joint, which [Phillips] declined as well,&rdquo; according to Alliance Defending Freedom. Scardina would later admit he made these requests to &ldquo;test&rdquo; Phillips, according to Alliance Defending Freedom.<\/p>\n<p>Ultimately the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/with-new-documents-the-biden-administrations-targeting-of-a-pro-life-dad-just-got-crazier-2\/\" title=\"With New Documents, The Biden Administration\u2019s Targeting Of A Pro-Life Dad Just Got Crazier\">state court dismissed<\/a> the case Tuesday. <\/p>\n<p>&ldquo;The underlying constitutional question this case raises has become the focus of intense public debate: How should government balance the rights of transgender individuals to be free from discrimination in places of public accommodation with the rights of religious business owners when they are operating in the public market?&rdquo; Colorado Supreme Court Justice Melissa Hart wrote for the majority. <\/p>\n<p>&ldquo;We cannot answer that question however, because of a threshold issue of administrative law and statutory interpretation: Could the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ketanji-brown-jackson-calls-illegal-aliens-noncitizens-in-senate-hearing\/\" title=\"Ketanji Brown Jackson Calls Illegal Aliens &#039;Noncitizens&#039; in Senate Hearing\">district court properly<\/a> consider the claims of discrimination presented here? In light of this dispute&rsquo;s procedural journey, it could not,&rdquo; Hart continued. The majority held Scardina should have appealed a Colorado Civil Rights Commission&rsquo;s decision rather than directly sue Phillips. The court found Scardina could not bring a new claim. <\/p>\n<div class=\"fdrlst__b89e9-adb93b063a01ed385e8ff1d962ff9fa6 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-adb93b063a01ed385e8ff1d962ff9fa6\"><\/div>\n<p>Phillips has been the victim of lawfare since 2012 all for being a Christian. A gay couple requested a custom wedding cake, but Phillips informed the couple he could not create a cake celebrating their sexual preference since the cake would express a view that violated his religious beliefs about holy matrimony. Notably, <a href=\"https:\/\/thefederalist.com\/2023\/01\/26\/colorado-condemns-jack-phillips-for-being-a-devout-christian-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">Phillips<\/a> was more than happy to do <a href=\"https:\/\/www.supremecourt.gov\/opinions\/17pdf\/16-111_j4el.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">business<\/a> with the couple for any other item in his shop.<\/p>\n<p>As Zachary Mettler previously <a href=\"https:\/\/thefederalist.com\/2024\/06\/21\/true-tolerance-demands-an-end-to-the-persecution-of-jack-phillips\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in these pages, &ldquo;Jack Phillips serves <em>all<\/em> <em>people<\/em>. He will gladly sell anything in his shop to anyone &mdash; including people who identify as LGBT. But what he won&rsquo;t do is propagate messages that violate his core beliefs. That&rsquo;s why he&rsquo;s also <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> to create custom cakes celebrating Halloween or cakes advocating for the use of marijuana.
