href=\"https:\/\/lawandcrime.com\/supreme-court\/supreme-court-turns-away-elon-musk-and-x-complaint-about-jack-smith-warrant\/\" target=\"_blank\" rel=\"noreferrer noopener\">without explanation<\/a>, declining to consider Trump&rsquo;s challenge against Smith&rsquo;s secret warrant.<\/p>\n<div class=\"fdrlst__b89e9-3398f39de0291594bc1c9d7e01104d87 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-3398f39de0291594bc1c9d7e01104d87\"><\/div>\n<p>The Department of Justice (DOJ) first <a href=\"https:\/\/thefederalist.com\/2023\/11\/29\/special-counsel-jack-smith-sought-info-on-anyone-who-favorited-or-retweeted-trump-tweets\/\" target=\"_blank\" rel=\"noreferrer noopener\">soug<\/a><a href=\"https:\/\/thefederalist.com\/2023\/11\/29\/special-counsel-jack-smith-sought-info-on-anyone-who-favorited-or-retweeted-trump-tweets\/\">ht<\/a> the records in January last year, demanding a complete trove of private information including Trump&rsquo;s search history, direct messages, account settings, and activity under the &ldquo;@realDonaldTrump&rdquo; username. <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4145619-special-counsel-won-secret-search-warrant-for-trumps-twitter-account\/\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a> to The Hill, the government obtained a nondisclosure order to bar X from revealing the existence of the warrant, even to the former president.<\/p>\n<p>&ldquo;The company challenged the order, arguing the records were potentially covered by executive privilege and not being able to tell Trump violated the First Amendment,&rdquo; The Hill <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4919240-supreme-court-jack-smith-trump-twitter\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. &ldquo;Court filings show X at one point was fined $350,000 for not timely turning over Trump&rsquo;s data.&rdquo;<\/p>\n<p>Attempts to block Smith&rsquo;s surveillance in the lower courts, however, <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4919240-supreme-court-jack-smith-trump-twitter\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a>. The Supreme Court ultimately refused to hear another challenge to the warrant in Smith&rsquo;s criminal case, which is related to the Capitol riot on Jan. 6, 2021. Last week, roughly a month before Election Day, U.S. District Court Judge Tanya Chutkan <a href=\"https:\/\/thefederalist.com\/2024\/10\/02\/chutkan-drops-jack-smiths-165-page-last-ditch-effort-to-smear-trump-right-before-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">unsealed<\/a> Smith&rsquo;s 165-page&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258148\/gov.uscourts.dcd.258148.252.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>&nbsp;outlining prosecutors&rsquo; evidence against Trump. The move came once it was clear a trial would not convene before November.<\/p>\n<p>X CEO Elon Musk campaigned with Trump on Saturday in Butler, Pennsylvania, at the exact site where the Republican presidential nominee was shot this summer.
